& APPROVE BILLS Mayor Wilks stated the next item on the agenda, "MONTHLY FINANCIAL REPORT AND
APPROVE BILLS" is listed for approval under the Consent Agenda. However, as there were
no other items for approval by consent, she asked for a motion to approve the Monthly
Financial Report and Bills.

MAYOR'S REPORT MAYOR'S REPORT
A. Proclamation: "Stop and Remember — September 11, 2011"
STOP AND In recognition of the ten (10) year anniversary of the tragic events of September 11, 2001
REMEMBER- Mayor Wilks presented the proclamation "Stop and Remember — September 11, 2011."
SEPTEMBER 11, Mayor Wilks, Trustee Juracek, Trustee Korn, Trustee Polit and Trustee Zadel shared in the
2011 reading of the proclamation honoring those who lost their lives and the heroic efforts of the
public safety personnel and volunteers who responded.
Village Manager Janonis accepted the proclamation on behalf of the Village. The Village of
Mount Prospect will observe the national moment of remembrance beginning at 12 noon on
September 11

SCHOOL'S OPEN B. Proclamation: "School's Open Safety Week," August 21 — 27, 2011
SAFETY WEEK Mayor Wilks presented the proclamation to Police Commander John Gross. Commander
Gross encouraged all Mount Prospect residents to drive safely and cautioned drivers to be
especially cognizant of traffic laws specific to school zones.
PEER JURY C. Recognition: Peer Jury Graduates
GRADUATES Ms. Jill Friedrichs, Volunteer Coordinator of the Mount Prospect Police Department Peer
Jury Program presented an overview of the program which was implemented in 1996 to
provide a meaningful and remedial method of dealing with selected juvenile offenders. Ms.
Friedrichs and Police Investigator and Prospect High School Police Liaison, Scott Filipek
recognized the Peer Jury Graduates and presented those in attendance a padfolio and
Certificate of Appreciation.

Mayor Wilks requested Village Board approval to designate Trustee Zadel as Interim Mayor
Pro Tern during that time.

SOUTH ELM (Circular Drive) for property located at 801 South Elm Street.

Community Development Director William Cooney provided background information stating
the Petitioner is constructing a new single - family residence at 801 South Elm Street and is
seeking a Conditional Use permit for a circular drive in the exterior side yard.

The Petitioner's site plan indicates the lot width as 123 feet along Elm Street, which is in
compliance with the Village Code's minimum seventy -five foot (75') lot width requirement for
circular driveway. The proposed thirty percent (30 %) lot coverage of the property's exterior
side yard also complies with the Village Code's lot coverage standards; maximum thirty -five
percent (35 %) exterior side yard coverage.
The Planning and Zonig Commission recommended approval of the Conditional Use by a
vote of 7 -0.
The owner of the property, Mr. Michael Munao was unable to attend but was represented by
his father Mr. Munao. Mr. Munao stated his son was raised in Mount Prospect and was
very pleased to be moving back the Village.
Trustee Polit thanked the Planning and Zoning Commission for the thorough review and for
asking pertinent questions; allows the Village Board to move through their decision making
with the necessary information.

CENTRAL ROAD Mayor Wilks stated the agenda listed two (2) ordinances to be presented for a first (1)
reading 1) an ordinance granting a Conditional Use (Drive- Through Lanes) and 2) an
ordinance granting a Variation (Light Standards) for property located at 299 West Central
Road.
As the Petitioner submitted a written request to withdraw the request for a Variation (Light
Standard) the only item for Village Board consideration in case PZ -16 -11 is for approval of
an ordinance granting a Conditional Use (Drive- Through Lanes).
Mr. Cooney provided background information stating the Petitoner is seeking a Conditional
Use to construct a drive - through bank. The existing building, currently occupied by Little
America Restaurant, will be demolished and a new commercial building for a Mount
Prospect State Bank will be constructed. The bank will include three (3) drive - through lanes
on the east side of the building and requires Conditional Use approval for the drive - through
lanes. Mr. Cooney provided an overview of the project; 1) constructed out of brick veneer
with cast stone along the base of the building; 2) 24 parking spaces; 3) eight foot (8')
wooden fence along the east property line; and 4) upgraded landscape plan to comply with
Village standards.

The Petitioner's request to construct a drive - through bank meets the standards for a
Conditional Use; the use as a bank complies with the Village's Comprehensive Plan and will
be constructed according to Village Code. The Planning and Zoning Commission
recommended approval of the request for Conditional Use by a vote of 7 -0. The Petitioner
has requested waiver of the rule requiring two (2) readings of an ordinance.

individuals associated with the project and in attendance to respond to questions.

Mr. Eilering introduced Mr. Jim Carver, Mount Prospect State Bank and Mr. Nick
Papanicholas and Mr. Nick Papapnicholas, Jr., General Contractors for the project. He also
recognized and thanked Mr. Revel and Mr. Tsiropoulos for operating Little America
Restaurant, a Mount Prospect landmark known for its friendly atmoshphere and as a social
gathering site for many residents.
Mr. Eilering stated the existing bank located at 20 East Northwest Highway needs a location
that will allow for drive - through lanes. With an opportunity to purchase the Little America
property from the retiring owners, it was determined this location would accommodate the
desired drive - through lanes. In order to start the project as soon as possible, Mr. Eilering
requested a waiver of the rule requiring two (2) readings of an ordinance.
Village Board Comments
• Thanked the owners of Little America for creating a welcoming restaurant; place for the
community to meet.
• Little America an important institution
• Hate to see Little America leave but understand owner's desire to retire
• Appreciate the bank's plan to leave property with an open type atomosphere; pedestrian
friendly.
• Thanked the bank for choosing to stay in Mount Prospect.

AN ORDINANCE GRANTING A CONDITIONAL USE (DRIVE- THROUGH LANES)
ORD 5871 FOR PROPERTY LOCATED AT 299 WEST CENTRAL ROAD

NORTH ELMHURST Mayor Wilks presented for a first (1 reading of an ordinance granting a Conditional Use
ROAD (drive- through lanes) and Variations (parking lot setback, foundation and and landscaping)
for property located at 950 North Elmhurst Road.
Mr. Cooney presented background information stating the Petitioner is seeking approval of
1) a Conditional Use to construct a drive - through restaurant; 2) a Variation to decrease the
parking lot setback along the north and south property lines; and 3) a Variation to decrease
the foundation landscaping along the north, east, and south building elevations. The
Petitioner's plan includes demolition of the existing building and construction of a 4,866
square foot drive - through restaurant. As proposed, the restaurant includes two (2) drive -
through lanes that taper down to one (1) lane at the pickup window located along the south
property line.
Additionally, the Petitioner seeks a Variation to reduce the parking lot setback from ten feet
(10') to six feet (6') and six inches (6 ") along the north property line and from ten feet (10') to
three feet (3') and eight inches (8 ") along the south property line; and 3) a Variation to
reduce the foundation landscaping from ten feet (10') to six feet (6') and eleven (11 ") wide
along the north building elevation, eight feet (8') wide along the east building elevation, and
zero feet (0') along the south building elevation. Mr. Cooney provided illustrations of building
elevations; north building elevation (main entrance), and south elevation (pick -up window.)
The Planning and Zoning Commission approved the requests for Conditional Use and
Variations by a vote of 7 -0.
Mr. Cooney responded to questions from the Village Board regarding signage and traffic
flow. The Planning and Zoning Commission denied the Petitioner's request for a Variation to
increase the number of wall signs from four (4) to five (5). The Petitioner subsequently
agreed to four (4) signs; no signage on west side.
Mr. Jason Hill, PE with the project engineering firm of Woolpert, Inc. was in attendance and
provided additional information in response to questions from the Village Board.
• Project site designed to try and alleviate traffic; two (2) entrances- Rand and Elmhurst
Road and three (3) ways to exit - Rand Road, north on Elmhurst Road /Randhurst
Village. Currently working with staff and IDOT on intersection; Randhurst Village.
• Residential property adjacent to project site (owner doe not support the proposed project);
owner's fence encroaches on Chick -fil -A property. Chick -fil -A will remove old fence and
install new six foot (6') fence and landscaping to buffer yard of residential property.
• Fifteen (15) to twenty (20) employees per shift; hours are 6:30 a.m. to 10:30 p.m.
Trustee Polit asked Mr. Hill if he was aware this site was frequently used as a cut - through for
traffic leaving Randhurst. Mr. Hill indicated he was unaware of that practice; use of this site
for cut - through traffic will be evaluated for remedy.
Trustee Juracek requested additional details regarding management of the Grand Opening
with respect to traffic individuals camping out on property; first (1st) 100 customers receive
free chicken meal for a year.

Mr. Hill stated this grand opening event has occurred at other locations without incident; only
first (1 100 are allowed on property and Chick -fil -A manager works with community
representatives to ensure the event goes off without problems /disruption to the area.

meeting at 8:35 p.m.
D. PZ- 15 -11, 1500 West Central Road, Mt. Prospect Park District
PZ- 15 -11, 1500 Mayor Wilks presented for a first (1 reading an ordinance granting a Conditional Use for a
WEST CENTRAL lighted driving range and football /soccer fields and Variations (increase the height of light
ROAD standards and building setbacks.)
Mr. Cooney presented background information as well as aerial shots of the site. The
Petitioner proposes to construct a driving range over the existing detention pond and install
light standards on the existing football /soccer fields and the new driving range. The overall
recreation plan for Melas Park, as approved by the Village of Mount Prospect, Mount
Prospect Park District and the Arlington Heights Park District in 1991, allows for the lighted
athletic fields and golf driving range. The Village Zoning Code requires Conditional Use
approval for the proposed light standards. In addition, the Petitioner seeks 1) a Variation to
decrease the required building setback for a driving range control building; building setback
to be four feet (4') — Village Code requires fifteen foot (15') building setback; and 2) a
Variation to increase the height of the light standards from thirty feet (30') to seventy feet
(70'); six (6) light standards would be located to light the existing football /soccer fields and
six (6) would be located to light the new driving range.
The Planning and Zoning Commission recommended approval of 1) Conditional Use to allow
lighted football /soccer fields and a lighted driving range by a vote of 6 -1, and by a vote of 7 -0
recommended approval of 1) a Variation to increase the height of light standards from thirty
feet (30') to seventy feet (70') and 2) a Variation to reduce the building setbacks from fifteen
feet (15') to four feet (4') along the west property line.
In response to questions from the Village Board specific to the light standards Mr. Cooney
provided the following;

• Light poles direct light onto fields not residential properties
• Higher lighting allows you to see better; covers more area
Trustee Polit stated the higher lighting at Randhurst Village does not spill over onto the
adjacent residential properties.
Mr. Louis Ennesser, Director of Parks and Planning for the Mt. Prospect Park District
provided additional background information including the Melas Park Master Plan and
development history which included renovation of the nine (9) acre parcel for the athletic
fields.
Mr. Ennesser stated the driving range would be in operation from March through December
1 St and the soccer /football fields would be used in the spring and fall. He stated the original
application indicated the hours of operation would be until 11:00 pm but in consideration of
the youth the closing time was changed to 10:00 p.m. However, the Park District agreed to
the conditions approved by the Planning and Zoning Commission at August 25 hearing; 1)
primary lights to be turned off at 9:00 p.m. and 2) secondary lights to be turned off at 9:30
p.m.
In response to questions regarding the Village's use of the retention basin for flood control,
Mr. Ennesser stated the driving range needs to be approved by the Metropolitation Water
Reclamation District (MWRD) before moving forward with submittal of drawings to the
Village. The Park District is not seeking the Village's permission to construct the driving
range only a Variation to the lighting standards.
Mayor Wilks stated the retention basin is critical to the Village's water control system; if the
MWRD denies the request, the driving range cannot be constructed.
In response to questions reqarding the Arlington Heights Park District baseball field lights
Mr. Ennesser stated the baseball field lights are old technology.
Public Comments
Mr. Dan Dowd, Attorney

Mr. Dowd represents Mr. and Mrs. Gilmore who reside at 106 South Kenilworth Avenue.
Mr. Dowd stated there were deficiencies in the zoning case specific to Village Zoning
Ordinance requiring the Petitioner to meet standards for approval of a Conditional Use. The
law requires someone with the proper training /expertise to give testimony to whether the
Conditional Use will affect property value. The only testimony given at the Planning and
Zoning hearing was from Mr. Ennesser, based on his conversation with realtors. The
Petitioner needs to bear proof with expert testimony that property values will not be
impacted. He further stated the 1991 Master Plan does not obviate the Petitioner's need to
meet standards.
Mr. Dowd suggested the Village Board remand the zoning case back to the Planning and
Zoning Commission.

Concerned quality of life will be impacted; 1) lights will be visible from residential properties;
2) safety issues; 3) noise pollution 4) increased traffice and garbage. Asked if the Park
District gets in bind scheduling games — will the games be allowed to go later. She
requested the Village Board deny the Park District's request.

Mayor Wilks responded, if the terms of Conditional Use are violated, the Conditional Use can
be revoked.

Stated the Park District's request would be detrimental to the neighborhood;. 1) can see
baseball lights from his property; will see lights from football /soccer fields if they go up;
parking from athletic events spills over into neighbor. Would like lighting for walking path.

There are 570 youth participants; practice at Lions Park and Maryville practice is usually
done by 4:30 but always by 8:00 pm; lighting at Lions is inadequate and Maryville adds
travel time for parents. Each year the teams have less and less space for practice /games.
Football games at Melas cannot be scheduled past 4:00 p.m. The lighted football fields
would allow scheduling games on all three fields; improved spacing of the games — would
alleviate parking congestion and overflow and enhance safety.

No compelling reason the Village should grant the Park District's request. She attended the
hearings in 2003 when the lights were installed; she sees baseball fields lights from her
home. Despite the better technology; lights will still be visible.

Resides across the street from Prospect High School. Installation of the new athletic field
lights at Prospect High School best thing that happened; lights stay on field — no spill over.
Fencing around Park District's fields is good — protects fields. 9:00 p.m. shut -off is good and
good for the community.

Fields are already there; need lights. Competing teams outside of Mount Prospect have
lighted fields.

Youth participants are excited about playing under the lights. It appears focus is on what
residents want; need to think about our youth.

Understands benefits to youth but would prefer not to have lights. Residents who live in the
area would be stuck with the lights; housing market makes it difficult to move. If approved
residents must live with the Village Board's decision; decision that negatively impats their
quality of life.

Referenced Chapter 14 of the Village Code; granting of Conditional Use must not be
injurious and granting of a Variation shall not be granted without facts based on evidence
Asked Park District to provide findings of fact and the Village Board to make an informed
decision. Mr. Gilmore also clarified that the vote for approval of the Conditional Use by the
Planning and Zoning Commission was 6 -1 not 7 -0.

same standard according to Village Code.

At the last meeting Park District indicated the fields would not be used for practice. Same
people are now saying the fields will be used for practice.

Mt. Prospect Park District
Mt. Prospect Park District is deficient in populous it serves. With close to 60,000 residents
and the Park District having no other acreage Melas needs to be available for use. The
development of Melas Park has been in the plans for years; the 2010 renovation of the
playing fields, concession stand and fencing was the number one (1) Park District Board
project. Melas is not a neighborhood park; it is a community park moving toward being a
regional park.

Worked with Park District over the last thirty (30) years. Park District is deficient in total
acreage; no vacant land. Park District is looking to expand, working with Master Plan that is
constantly evolving. Tonight's issue is the Park District's need for lighting at Melas.
Recreational lights do need to be better when installed in residential areas. Lighting
technology has improved; lighting is focused and directed. The ability to utilize the
improved lighting makes this the right time to seek approval of the Conditional Use.
Stating this was the first (1 reading of the ordinance, Mayor Wilks thanked those
individuals who spoke for their comments.
Village Board Comments
Trustee Polit provided additional background information regarding the Park's District efforts
to purchase additional property dating back to 1995. Recognizing the lack of available
vacant land, in 1991 the Park District Board committed to maximizing the use of Melas Park
for recreational purposes. Need to provide locations for youth sports /activities. Trustee Polit
also addressed the issue of the conflict that can arise when trying to strike a balance in
determining what is best for the larger community while remaining cognizant of
"neighborhood concerns. Using his neighborhood as an example he stated property owner's
in his neighborhood must balance the negative impact of cut - through traffic from Randhurst
and the benefit Randhurst brings to the entire community. Need to find common ground;
solution that works for everyone.
Trustee Juracek thanked Mr. Dowd for his comments regarding standards for Conditional
Use and Variations; important reminder of Zoning Standards. Planning and Zoning hearings
user friendly process to try and reach reasonable compromise. In reference to appraisal of
residential properties she noted appraisals can be subjective. Stated the Village Board
values and appreciates the comments presented from both sides of the issue. Trustee
Juracek suggested there may be ways to get to a "yes" on this request and asked the

1) can the Park District do additional ground level screening to block reflective light off the
field; 2) Park District provide additional screening options; 3) traffic from park — review by
Transportation Commission and 4) neighborhood traffic — is there a need for parking
restrictions.
Trustee Korn stated data regarding property values may not be known until lights go up and
property is sold. Stated the parking concerns and cutting through yards to access the park
were not raised as issues this evening. Village Board needs to address those concerns.
Questioned if the Village Board approves the request how stringent are the time restrictions.
[Mr. Cooney stated any change in time would require the Park District to go through the
same process for Conditional Use.
Trustee Zadel stated at both the Planning and Zoning hearing and tonight's meeting
residents presented compelling arguments regarding their quality of life as did the Park
District in their efforts to meet community recreational needs. Support letting this item stand
for a second reading; continue to review and consider everything brought forward. Trustee
Zadel requested staff to obtain the Village Attorney's opinion regarding the burden of proof.
Mayor Wilks stated it was also important to allow Trustee Hoefert and Trustee Matuszak to
participate in the discussion and decision regarding the Petitioner's request. The second
(2 reading of the ordinance granting a Conditional Use for a lighted driving range and
football /soccer fields and Variations (increase the height of light standards and building
setback) will be presented at the September 6, 2011 Village Board meeting.
MANAGER'S VILLAGE MANAGER'S REPORT
REPORT A. Recommendation to award professional services contract for specified investigative and
analytical engineering services related to severe flooding event on July 23, 2011.
Public Works Director Sean Dorsey presented background information and staff
recommendation.
Mr. Dorsey stated the severe weather that struck the Village on July 23 resulted not only in
a record - setting rainfall event; it also appears to have set a record for damage to Mount
Prospect homes. To date, almost 700 homeowners have report basement or other structural
damage to their homes. While the damage appears to be distributed throughout the Village,
the way in which homes flooded varied. It is staff's intention to investigate each complaint as
thoroughly as possible using designated protocol.
At this juncture, staff has identified two (2) areas that warrant further examination; Hatlen
Heights residential subdivision and the single - family homes situated in the general vicinity of
North Pine Street and North Wille Street. In addition, staff identified a need to supplement
existing forces in order to investigate the 700 flooding complaints received to date in a timely
manner; anticipate completion of 200 building inspections utilizing in -house forces. Staff
requested proposals from two (2) consulting engineering firms to provide specified
profession engineering services necessary to investigate and analyze the flooding problems
in the remaining 500 homes.
Staff recommends the Village Board accept the lowest cost proposal to perform specified
professional engineering services related to the investigation and analysis of flooding in the
Hatlen Heights and North Pine /North Wille areas as submitted by Burns & McDonnell of
Downers Grove in an amount not to exceed $44,500.
Trustee Zadel recused himself from voting on this request; his employer, Illinois Tollway,
engages in business with both vendors While he has no issue with either vendor and
strongly supports outside assistance for the study, in accordance of the ethical standards of
elected officials he will not vote.

Trustee Zadel stated it is important for the Village to move forward with this investigation and
analysis to get to the bottom of flooding issues.
Trustee Juracek expressed her support of staff's recommendation. She requested additional
data be obtained during the investigation; 1) natural water table depth in these areas 2)
hydrology of soils and drainage and 3) assessment of each home to include whether there
were overhead sewers and /or downspouts. This information will assist the Village in
focusing on its efforts to address flooding.
Trustee Polit stated there is a plethora of items throughout the Village that may have
contributed to flooding. He has concerns related to determination of the cause of overland
flooding and resident response if problem created by homeowner(s). Indicated overhead
sewers may be beneficial.
In response to Trustee Polit's question regarding a home where the older part of the home
took in water and the newer addition did not, Mr. Dorsey stated it was due to the water table.
New construction tapping into drainage areas that have never been tapped.
Trustee Korn stated this study is important. Similar to the Lake Briarwood study, Village will
learn what contributed to the problem and what needs to be done. Encouraged residents to
contact the Village regarding flooding if they have not done so. Village has committed to a
follow -up meeting with residents to share results of the investigation.
Mayor Wilks stated this study will provide information critical to moving forward in addressing
flooding issues.
Trustee Korn, seconded by Trustee Polit, moved for approval of request to accept the lowest
cost proposal submitted by Burns & McDonnell for Hatlen Heights and North Pine /North
Wille area flood studies in an amount not to exceed $44,500.

Trustee Polit recognized and thanked the Lions Club Farmers' Market vendors for their
continued generous donation of surplus food to the Community Connections Center; the
food is distributed to Mount Prospect families in need. The vendors donate approximately
500 -700 pounds of food each week following the Sunday market.
