CITIZENS TO BE COMMUNICATIONS AND PETITIONS – CITIZENS TO BE HEARD
HEARD A number of homeowners impacted by the July 23, 2011 storm/flooding were in attendance;
sign-in sheet is attached. The following is a list of the homeowners who addressed the
Village Board with their concerns/comments/questions regarding: flooding, personal losses,
Village response during and after storm/flooding and questions/suggestions for preventive
measures. (Several residents showed pictures of the flooding “aftermath,”; pictures were
given to the Village Clerk.)
Mr. Joseph Bonomo

Mr. Bonono stated the Village needs to determine what is creating the flooding. His home

has flooded twice in five years. July 23 storm - four (4) feet of water in the street, neighbor;
had ten feet (10’) of water in basement.

Police and Public Works response to flooding and calls for assistance unacceptable.
Village policy not to assist residents with private property issues - unacceptable when homes
are flooded/residents are in distress. He noted flood waters went down very quickly after
media was notified.
Village Manager Michael Janonis responded there was no “secret” shut-off valve the Village
could have or should have used to avert the flooding; try to manage water with detention

basins. The July 23 storm generated an incredible amount of water in a very short time;
the Village’s system was overwhelmed; Weller Creek was so full, Crumley Basin could not
dump in to it. The water disappeared once the system was able to catch up; hydraulics.
He further stated the rain storm affected the entire Village which required Village staff
throughout the community.
Mayor Wilks stated she has signed four (4) disaster declarations this year; very difficult year
for weather. With each disaster Village assesses procedures, and what, if anything can be
done to improve community response and services.

Stated there were homes with seven (7’) to ten (10’) feet of water – no one from Village
checking on residents. Important to have someone from Village check on residents.
Indicated another community allowed Village staff to assist residents with pumping out
basements. Believes Village should allow staff to assist residents with private property
flooding. He referenced the use of a valve during Weller Creek construction – water was
shut down. Questioned why the valve was not used to stop the flow of water that created
flooding. There is no where for the water to go. Can water be diverted to Melas Park
detention basin? If Bonita and Hatlen continue to flood during heavy rains can the water
system be re-engineered.
Public Works Director Sean Dorsey stated the Melas Park detention basin services the
northern part of Mount Prospect and part of Arlington Heights. Water from Hatlen Heights
drains to Weller Creek.
Village Manager Janonis stated when the work was done at Weller Creek, water diversion
was within the bank itself; crews worked with flow of water.
Village Manager Janonis stated the Village’s water management system is designed for the
most frequent type of rainfall; cost prohibitive to design system for the rare yet extremely

intense storms the Village experienced July 23.
Ms. Lane stated the Village Board needs to restore the trust of the community. Flooding
victims have suffered tremendous losses in the flood with little or no insurance coverage.
In the future the Village needs to respond to calls for help from residents in distress from
flooding.
Trustee Zadel acknowledged Village staff were following Village policy to not go on private
property to assist with pumping. However, the Village Board recognizes these extreme

circumstances; perhaps need to re-evaluate the policy. The July 23 rainfall was a record
in Illinois; the Village will assess response/procedures to the storm/flooding. Committed to
modifying procedures as appropriate in response to community needs.
Mr. Marty Malone

Mr. Malone stated in the last eight (8) years he has taken water in his basement three times;

this is not a rare occurrence. As a result of the July 23 rain he had 5 feet of sewage water
in his basement; now has foundation problems.

Property at 411 N. Wille is foreclosed/vacent – believes that property must have water as
well. Would like to hear that Village has plan to eliminate flooding.
Mayor Wilks stated Village staff will follow-up with foreclosed property. Tonight is dedicated
to listening to the comments/concerns of residents. Village to use the information to assess
worse situations; no answers tonight.
Ms. Tracy Wanatowicz

Ms. Wanatowicz stated she had 4-5 inches of sewer water in her basement; appreciated the
additional garbage service for flood debris. Would like information as to why the flooding is
happening. What can the Village do to remediate the problem; what can she do to
remediate the problem. She indicated Arlington Heights offers residents a rebate up to
$5,000 for flood remediation. She also stated she made 16 attempts to reach 911 – never
got an answer. She did get through to the Police non-emergency on her first try.
Mayor Wilks stated the Village has an overhead sewer system program for residents; limited
to homes with certain sewers. Recommend she contact the Public Works Department for
additional information. She further stated keeping tree roots out of the sewer system helps
minimize sewer backup.
Ms. Wanatowicz requested information on the Village’s combined sewer study.
Mr. Dorsey stated the study was done to assess the structural integrity of the combined
sewer and establish plan to bolster existing lining. The study was not done to look at
separating the sewers. The study will be made available to Ms. Wanatowicz.
Mr. Rich Karbowiak

New addition to home three (3) years ago; has three (3) sumps. July 23 storm there was
five (5) feet of water; a $140,000 in damage. Sump pumps could not keep up with water. In
2008 had four (4) feet of water in basement.
Residents were left without support from Village – no assistance in pumping basements.
Questioned how one neighbor’s drainage could work flawlessly – while other neighbors were
flooded. What is the Village going to do to prevent the flooding from happening again.
He also hopes to see an improvement in the Village’s emergency response.
Mayor Wilks stated the Village will address the failure to connect with 911.

Mr. Subeck requested additional information regarding the IEMA/FEMA process and if
money will be available to residents. IEMA – Illinois Emergency Management Agency.
FEMA – Federal Emergency Management Agency.
Village Manager Janonis stated it is not a quick process but the Village immediately initiated
efforts by submitting a local disaster proclamation to Cook County. Cook County is
collecting for submittal to IEMA. IEMA will make an assessment according to their formula;
loss per capita. If the assessment of the Village meets the criteria, IEMA will submit to
FEMA with recommendation to declare community as a disaster.
Even if the Village of Mount Prospect is declared a disaster area; unlikely money will trickle
down to residents. Under certain circumstances homeowners may get money from FEMA; if
the flooding impacts living space. FEMA standards do not qualify basements as living
space. Funding may be given in low interest loans or grants.

Declaration of disaster may not be known for several months.
Village Manager Janonis and Mr. Dorsey responded to questions regarding the MWRD
Deep Tunnel.
The Deep Tunnel is operated by the MWRD; the Village has no control over when it is
rd
opened. The decision to release the sewer water into Lake Michigan following the July 23
rain event was made by MWRD; Village not part of the decision making.
Mr. Dorsey gave background information on the deep tunnel. The Village has a number of
sewer systems; interceptor sewers flow into the deep tunnel.
Ms. Fran Zalewski

Ms. Zalewski stated three (3) years ago she had three feet (3’) of water in her basement. To
reduce flooding at that time the EPA opened the storm gates to Lake Michigan.

As a result of the July 23 flooding (sewer backup) she lost everything in her basement;
power was out so the three (3) sump pumps were not working. The flood water covered the
fire hydrants, her front yard and her basement. The Village’s response to the resident’s plea
for help was “there is nothing we can do.” After contacting Channel 7, Public Works came
out and within a very short time the water was gone.
There is a definite problem in the Hatlen Heights area. She now sees Public Works trucks in
the area; why are they there now?
Mr. Dorsey stated the Village wishes there was a valve or number to the EPA that could be
utilized to eliminate/minimize flooding. But no valve or number to the EPA to divert the flow
of flood water exists.
In response to a number of residents comments that indicated the Police Department was
telling them about the EPA “valve” Village Manager Janonis stated he will follow-up with the
Police. He asked, what purpose would the Village have in flooding resident’s homes. He
reiterated the decision to open up the deep tunnel gates and let raw sewage into the Lake
Michigan is not the Village’s call.
Trustee Matuszak stated the Village’s sewer system flows into the deep tunnel; a larger
sewer system under the control of the MWRD. The MWRD is under heavy environmental
regulations and as a governing body meets regularly to discuss issues.
Ms. Zalewski stated the Village Board should be present at those meetings for the benefit of
the community.
In response to a question from Trustee Zadel regarding storm water in the Hatlen Heights
area Mr. Dorsey explained the water management system for this area and how the backup
of water occurred with the intense rain; both Crumley Basin and Weller Creek were full.
For combined sewer overflow there is a MWRD interceptor pipe that will open; the

interceptor pipe was open on July 23.
Mr. Dorsey stated the Public Works Department is currently in the area to do an assessment
of the water/sewer drainage system; inspecting and televising to determine if there was a
problem.
Ms. Zalewski requested the Village share the results of the evaluation with the residents;
follow-up meeting.

Trustee Hoefert stated a neighborhood meeting will be conducted once Public Work’s
evaluation is complete. The results of the assessment will be shared with residents. If
there is a problem(s) with Village sewers, it will be fixed.
Mr. Dorsey stated the Public Works Department is also collecting data to provide a more
accurate assessment of what happened; determining how water/sewage entered homes.

Mayor Wilks provided clarification on the manner in which information is being collected; the
on-line disaster assessment form from Cook County and direct contact with Public Works.
She stated residents will be notified when the follow-up meeting is scheduled.
Mr. Dorsey stated residents can call or email Public Works with information. In addition to
collecting information, Public Works will make site-visits.
Trustee Polit encouraged residents to contact Public Works and complete the Cook County
Assessment form.
Ms. Eileen Duffy

Ms. Duffy stated her home had sewer backup and water was over her deck. She had no-
where to pump water.
When she was still trying to clean-up/sanitize her home from the raw sewage she was
notified by Public Works not to use the water for a twelve (12) hour period. She questioned
why she only received a 24 hour notice regarding the water restriction when Public Works
knew the work was scheduled far in advance of the notification.
Mr. Dorsey stated the notice to not use the water was because of the sewer lining project.
The twelve (12) hour period was needed for the curing process. In hindsight, another stretch
of the project could have been worked on to allow the residents impacted by the flood to
complete clean-up.
Mr. Tim Joyce

Mr. Joyce stated he lost both of his cars and his living space was flooded. He is floored at
the lack of communication by his local government. Not only was there no communication

during the flooding but this is the first (1) he is learning the Public Works Department is
collecting information from residents; hearing this ten (10) days after the fact is very
frustrating.
Trustee Polit provided clarification regarding the initial request for data from residents for
Cook County disaster assessment and the Village’s request for information for its evaluation
process.
Mr. Dorsey responded to Mr. Joyce’s questions regarding the use of restrictors in water
drainage system. There are commercial properties that utilize restrictors to meet detention
requirements and restrictors are used in the Village’s backyard drainage program; rain
gardens. Restrictors are not used in the Village’s main system.
Mr. Dorsey stated, Weller Creek does not drain into the Melas Park detention basin and
provided background regarding drainage for Weller Creek and Melas Park detention basin.
Mr. Joyce asked if the Village would consider giving residents who are left with massive
reconstruction costs, a waiver on their permit fees.

Mayor Wilks stated the request was certainly valid and the Village Board could move to
assist residents in this manner.
Village Manager Janonis stated the Village’s sewer system is complicated and cuts across
other municipalities; a regional system. There is no easy answer; flooding can occur in
many ways.
The Village has invested millions of dollars to improve and maintain system. The Village
works to keep system clear of blockage. Understands residents frustrations; intensity of
storm overwhelming. A weather related event that impacted many municipalities.
Mr. Justin Pappas (owner) Mr. Paul Solarz (father-in-law)

Mr. Pappas stated the drain on the east side of street drains fine; drain on the west side of
the street does not drain at all. He doesn’t see any reason why sewer should be plugged.
He too stated he was told the EPA would not allow “valve” to be opened.
He stated every time it rains, regardless of intensity, there is three (3) feet of water in the
street and spills over to his property. The storm drains that were installed in the parkway on
Verde do not work. He has communicated on a regular basis with Public Works about the
on-going problems with no resolution. He now has a sink hole in front of his house.
Mr. Solarz stated when he arrived at 6:30 a.m. the backyard of the home was completely
flooded. Concerned with the seemingly “lackadaisical” attitude of Public Works.
Ms. Edith Leone

Ms. Leone stated she only had inches of water as did most residents on her side of town.
She asked if the development at Randhurst contributed to flooding; can system handle? Ms.
Leone also asked why Stevenson Lane has new sewers but no sewers in curb.
Trustee Polit stated that Randhurst manages all water drainage on-site. Rainwater does not
leave that site.
Mayor Wilks stated the Village Board is diligent with enforcement of lot coverage
requirements; does not allow excessive lot coverage.
Mr. Dorsey stated drainage of on Stevenson Lane is done via surface to an existing inlet.
Mr. Lester Grygo

Mr. Grygo stated before buying his home in 2008 he asked about flooding; he was told
flooding was not an issue. The pumps he had working during/after the rain were useless.
He believes the Village has a responsibility to help residents. During a disaster residents
need Village staff to help.
Ms. Eileen Gross

Ms. Gross questioned why information is being given to FEMA if the agency is not going to
help residents recover from the flood. She requested if money is allocated residents be
informed where it is going. If her area continues to flood she asked for Village assistance in
having the area declared a flood plain.
Ms. Gross asked for recommendations/direction from the Village regarding her property; can
her family use the basement – is her family’s home safe from future flooding.

Mr. Paul Van Buskirk

Mr. Van Buskirk stated every time it rains he gets water; Village needs to look at Colonial
Heights drainage system. Village needs to improve response to residents need for
assistance.
Ms. Rosemary Pope

Ms. Pope stated when she flooded in 1987, FEMA money was available to help victims
cover their losses.
Village Manager Janonis stated FEMA guidelines are now more restrictive. Assessment
damage considerations are limited to “living space.” Do not consider basements living space.
He encouraged Ms. Pope and all residents to keep pictures of damage and save receipts.
Ms. Kathy Zielinski

Ms. Zielinski stated her backyard and garage have flooded for several years. For the last
three (3) years she has been working with Public Works and the problem remains

unresolved. In addition to the thousands of dollars she lost as a result of the July 23
flooding, she has to pay $3,000 to replace sewer tile that was damaged from parkway tree
roots. She also requested improved communication and suggested guidelines and
procedures be made available to residents.
Mr. Dorsey stated he would talk to the Village Engineer regarding the Village’s backyard
drainage program, “rain garden,” for her property.
Ms. Zielinski asked if older homes will be required to comply with updated Building Code
requirements.
Trustee Hoefert responded in some cases the Village does allow for grandfathering of old
building code requirements.
[All residents addressing the Village Board shared concerns regarding communication during
and after the storm which include 911 calls (no response), robo calls and information given
out by staff. Although the robo calls were viewed favorably suggestions were made as to
how to improve and expand on information. A consistent suggestion was also made
regarding the collection of flood debris; residents should have been given more than one
week to get rid of debris and be allowed to set the flood debris at the curb prior to the
allowable time.]
Village Board Comments
Each member of the Village Board acknowledged the tremendous loss and frustration the

residents had endured as a result of the July 23 flooding. The Village Board thanked the
residents for attending the meeting and sharing their comments and recommendations.
Trustee Korn stated the Village Board could not provide any concrete answers this evening.
However, the comments/suggestions were well taken and there will be discussion on how to
improve response as well as consideration of residents requests a; 1) personnel policy
change – assist with pumping basements 2) waiver of building permit fees 3) financial help
to residents 4) collection of flood debris and 5) clear, accurate and timely information to
residents.
Trustee Matuszak stated it was very important to hear residents and see their pictures. In
addition to the items already mentioned he stated the Village Board is committed to
evaluating its water management system and related flooding.

Village needs to ask MWRD to review their policy. The follow-up meeting with residents is
essential.
Trustee Hoefert stated it is critical for the Village to know how many homes were affected
rd
and how the water entered. While the July 23 storm was of great intensity, it is troubling
when homes are taking water every time it rains. Village needs to address flooding issue.
He appreciated comments to improve communication. He reiterated the Village Board’s
commitment to a follow-up meeting with residents.
Trustee Polit stated without this type of interaction, you miss the human side of the losses
and frustrations residents have endured. He stated this Village Board tries to find long-term
solutions to community problems. There is $16 million in the General Fund to address
flooding issues.
Trustee Juracek stated the residents were right to inform the Village Board of their concerns,
personal losses and request for resolution to the flooding. The Village Board is on the same
page; agree an evaluation needs to be conducted. Village Board needs to determine what
the plan should be to fix the problem. $16 million for storm water improvement over the next
five (5) years. Hatlen Heights area has a lot problems. Please inform the Village when you
are helping your neighbors with flooding issues – Village needs to know when problem is
happening.
Trustee Zadel stated he agreed with comments from other Trustees and supports the
approach to address flooding. He greatly appreciated the civility in which the residents
shared the concerns, personal losses and frustrations. While he did not live it – he has great
empathy for the flood victims.
Mayor Wilks also thanked the residents and encouraged them to communicate by email or
phone if they had additional concerns or questions. She also expressed her empathy for the
residents noting that she too has experienced flooding. As a result she no longer considers
her basement a usable space.
Mayor Wilks called for a recess at 10:28 p.m. Mayor Wilks reconvened the August 2, 2011
Village Board meeting at 10:41 pm.

A. PZ-17-10, 501 Midway Drive, Niagara Educational Services, Inc.

PZ-17-10, 501 2 reading of an ordinance granting a Conditional Use to operate a Community
MIDWAY DRIVE Center and School for property located 501 Midway Drive.
At the May 17, 2011 meeting the Village Board approved the request to defer the
nd
second (2) reading of the ordinance granting a Conditional Use to operate a
community center and school center until the August 2, 2011 Village Board meeting.
Mayor Wilks stated the petitioner had contacted Deputy Community Development Director
Brian Simmons indicating Niagara would be requesting additional time to secure financing.
Deputy Community Development Director Brian Simmons stated he received updated
information from the petitioner indicating financing had not been secured but the bank (Fifth
Third Bank) was very close to issuing a letter of financial commitment.

The petitioner was in attendance to request additional time to secure financing.
Mr. Yasar Serlik, Niagara Educational Services addressed the Village regarding the request

to defer the second (2 ) reading of the ordinance. Mr. Serlik stated the bank has indicated
a letter of of financial commitment for the project will be issued by July 26, 2011. He asked
nd
for a thirty (30) to forty-five (45) day extension for the second (2) reading of the ordinance.
The Village Board held a brief discussion as to an acceptable extension period. Trustee
Hoefert recommended a sixty (60) day extension period. There was a general consensus to
nd
defer the second (2) reading to the October 4, 2011 Village Board meeting.

A. Request Village Board approval for Façade Rebate Reimbursement in the amount of
FAÇADE REBATE $10,000 for Emerson Ale House Restaurant, 113 South Emerson Street.

113 SOUTH Mayor Wilks presented the request for Façade Rebate Reimbursement for Emerson Ale
EMERSON STREET House Restaurant.
Deputy Community Development Director Brian Simmons stated the Petitioner is renovating
the former Michael’s Restaurant to operate a sports bar and restaurant. The Petitioner has
made several improvements to the interior of the building and will be doing additional work to
the storefront; total expenditures for this project will exceed $250,000. Per program
guidelines the restaurant is eligible for a $10,000 Façade Rebate grant.
Mr. Sam Papageorge, owner, was in attendance and provided additional information about
the remodeling of the restaurant. He anticipates remodeling should be completed within 2-3
weeks. He will provide required paperwork for reimbursement to the Community
Development Department.
Trustee Zadel stated he and his wife had an opportunity to walk through the restaurant and
were very pleased with the interior; the restaurant will be a nice addition to the downtown.
Trustee Matuszak stated he too was excited about what he was happening to the restaurant.
Trustee Juracek thanked Mr. Papageorge for the submittal of the business plan; a required
component for program.

B. Resolution in support of 601 Carboy, LLC, 601 Carboy Road, Mount Prospect making
CLASS 6B TAX
application for Cook County Class 6b Tax Abatement

Mayor Wilks presented the Resolution in support of the Cook County Class 6b Tax
Abatement for 601 Carboy, LLC.
Mr. Simmons stated the applicant is seeking approval of the Class 6b abatement so they can
competitively recruit prospective tenants for the property at 601 Carboy Road.

The property has been vacant for approximately two (2) year and qualifies for the 6b
designation with special circumstances. Staff recommend approval of the applicants
request.
Mr. Zachary Kafitz, attorney for the applicant, was in attendance.
He stated should the Village Board grant the Class 6b classification the property will be
leased to Quality Glass.
Village Board Comments
Even with the abatement taxes are still higher than taxes on a vacant property.
Granting of the Class 6b is not just filling a vacancy but creating jobs in the Village.

MANAGER’S VILLAGE MANAGER’S REPORT
REPORTA. Request Village Board approval to accept bid for 2011 Retention Basin Dredging
Project, Kensington Business Park – Basin #5A in an amount not to exceed $148,269.
2011 RETENTION Public Works Director Sean Dorsey presented background information and staff
BASIN DREDGING – recommendation for the bid award.
BASIN #5A
Mr. Dorsey stated the project involves the removal of silt material from the retention pond.
Prior to bidding the project, soil samples of the silt were taken and the results were provided
to each bidder. The sample analysis indicated the excavated material was impacted by
contaminants and would need to be disposed in a landfill. The bid documents specified the
contractor is responsible for the lawful disposal of all excavated material.
Following the bid opening discussions with the low bidder revealed the disposal of the silt
would be other than a landfill. The bidder indicated that an additional $40,000 would be
required for landfill disposal, which made their bid higher than the second low bidder.

The second (2) low bidder, Copenhaver Construction, Inc. confirmed their bid price is valid
for the required landfill disposal. Staff recommend the Village Board reject the apparent low
bid submitted by Earth Works Corporation because of its failure to conform to bid
specifications and award the construction contract to Copenhaver Construction, Inc. in an
amount not to exceed $148,269; this amount included a 10% contingency.
Trustee Matuszak stated the U. S. Navy is also involved with major dredge projects. Since
Illinois requires landfilling of contaminants the U. S. Navy is sending silt to Indiana.
Trustee Polit stated when the Mt. Prospect Park District dredged ponds they used a system
to let the soil drain so there was less weight when it was moved.
Mr. Dorsey stated the same method will be used by the contractor to reduce the landfill
costs.
Trustee Polit stated at one time the dredged soil was acceptable for limited uses but the laws
have become more restrictive; used as filler at Melas Park.

Trustee Matuszak stated in July of this year additional changes were made to the law.
Trustee Hoefert, seconded by Trustee Juracek, moved for approval of request to reject the
apparent low bid submitted by Earth Works Corporation and award the construction contract
to Copenhaver Construction, Inc. in an amount not to exceed $148,269; includes 10%
contingency.
