ORDINANCE NO. 3766 AN ORDINANCE ESTABLISHING VILLAGE OF MOUNT PROSPECT SPECIAL SERVICE AREA N~{BER 6 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, as follows: SECTION 1: Authority to Establish Special Service Area Number 6. Special Service Area Number 6 is established pur- suant to the provisions of an "Act to provide the manner of levying or imposing taxes for the provision of special services to areas within the boundaries of home rule units and non-home rule municipalities and counties," and pursuant to the Revenue Act of 1939, as amended, Ill.Rev. Stat. Ch. 120 § 1301 et seq. §6 of the Constitution of the State of Illinois. Findings. The President and Board of Trustees and Article VII, SECTION 2: find: A. That the question of the establishment of the area hereinafter described as a special service area is considered by the President and Board of Trustees pursuant to an Ordinance entitled: "An Ordinance Proposing the Establishment of a Special Service Area in the Village of Mount Prospect and Pro- viding for a Public Hearing and Other Procedures in Connection Therewith" adopted December 30, 1986, and is considered pursuant to a hearing held on January 20, 1987, by the President and Board of Trustees Pursuant to Notice duly published in the Mount Prospect Herald on January 2, 1987, a newspaper of general circulation within the Village of Mount Prospect, at least fifteen (15) days prior to the hearing and pursuant to Notice by mail addressed to the person or persons in whose name the general taxes for the last preceding year were paid on each lot, block, tract or parcel of land lying within the special service ~area. Said Notice was given by depositing said Notice in the United States mails not less than ten (10) days prior to the time set for the public hearing. In the event taxes for the last preceeding year were not paid, the said Notice was sent to the person last listed on the tax rolls prior to that year as the owner of said property. Said Notices conformed in all respects to the requirements of Chapter 120, § 1301 et s~., Ill.Rev. Stat. B. That a public hearing on the questions set forth in the Notice was held on January 20, 1987. Ail interested per- sons were given an opportunity to be heard on the questions of the creation oz the proposed special service area; the provid- ing of special municipal services to the area, including the cost of construction and other related costs including install- ation of low profile curb and gutter throughout (27 feet back to back); the construction or new inlets, catchbasins, and cer- tain sections of new storm sewers; the widening of existing pavement, strip off (mill) the existing bituminous surfaces; the placing of reflective crack control material (Petromat); the repaying of the entire 'surface (24 feet); the replacement of all driveway aprons; the replacement of sidewalk where nec- essary; the landscaping of parkways and such other incidental work deemed necessary; the issuance of General Obligation Bonds in an amount not to exceed $370,000.00 at an interest rate not to exceed ten percent (10%) per annum and to mature within twenty (20) years, the proceeds of which shall be used to pay an amount not to exceed fifty percent (50%) of the cost of said special services; the levy of a direct tax to pay the interest on such bonds as it falls due and to discharge the principal thereof at maturity, said tax to be levied upon all taxable property within the proposed special service area; and the payment of the remaining portion of the cost of said special services, from General Obligation Bonds to be issued with respect to the Village and from Capital Improvement Repair and Replacement Funds. C. That no valid petition was filed with the Clerk of the Village of Mount Prospect within 60 days after adjournment of said public hearing objecting to the creation of proposed Village of Mount Prospect Special Service Area Number 6, the issuance of bonds for special services to the area or the imposition of a tax to pay the principal and interest on such bonds. D. That after considering the data, as presented at the public hearing, the President and Board of Trustees find that it is in the public interest and in the interest of the Village of Mount Prospect proposed Special Service Area Number 6 that said proposed special service area, as hereinafter described, be established. E. That said proposed area is compact and contiguous and constitutes a portion of the Village of Mount Prospect which in- eludes streets which are either unimproved, not paved or in need of resurfacing or repair. F. That it is in the best interests of said proposed special service area that the improvements proposed be considered for the common interests of said proposed area. G. That said proposed area will benefit specially from the municipal services to be provided and that the proposed municipal services are special and in addition to municipal services pro- vided to the Village of Mount Prospect as a whole. SECTION 3: Village of Mount Prospect Special Service Area Number 6 Established. A Special Service Area to be known and designated as "Village of Mount Prospect Special Service Area Number 6" is hereby established and shall consist of the follow- ing described territory, a map of said territory being attached hereto as Exhibit 1, to-wit: illage of Mount Prospect Special Service Area Number 6 is also established so that bonds may be issued, for the purposes afore- said, payable from taxes levied on all taxable property in the special service area in addition to all other Village taxes so levied, provided no bonds shall be issued in excess of the principal amount of $370,000.00 or at an interest rate to exceed ten percent (10%) per annum on said bonds to mature within twenty (20) years from the date of issuance of said bonds, the proceeds of which shall be used to pay an amount not to exceed fifty per- cent (50%) of the cost of said special services; and'the payment of the remaining portion of the cost of said special services to come from General Obligation Bonds to be issued with respect to the Village and from Capital Improvement Repair and Replacement Funds. SECTION 5: Effective Date. This Ordinance shall be in full force and effect from and after its adoption and approval. PASSED this 8th day of April 1987. ALSO: Parcel B: That part of the East half of the Southeast Quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, described as follows: Lots 32 through 49 in Maplewood Heights, being a sub- division recorded May 18, 1926 as Document No. 9278692, all in Cook County, Illinois. SECTION 4: Purpose of Area. Village of Mount Prospect Special Service Area Number 6 is established to provide special municipal services to said area in addition to services provided to the Village generally. Included in said purposes.shall be the following within Special Service Area Number 6: the construction and installation of low profile curb and gutter throughout (27 feet back to back); construct new inlets, catchbasins, and certain sections of new storm sewers; the widening of existing pavement, strip off (mill) the existing bituminous surfaces; the plac- ing of relective crack control material (Petromat); the repaying of the entire surface (24 feet); the re- placement of all driveway aprons; the replacement of sidewalk where necessary; and the landscaping of park- ways and such other incidental work deemed necessary.
