Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 4th day of February, 1987. ORDINANCE NO. 3744 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 410 CRAIG COURT IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Kerry Building Corporation. has filed an application for variation with respect to property commonly known as 410 Craig Court in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 6 in Lincoln Circle Subdivision being a Subdivision of the North 3/4 of the North East 1/4 of the South West 1/4 of Section 10 (except the 300.0 feet thereof) in Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family detached dwelling to be built on the Subject Property with three (3) car garage and a thirty foot (30') wide driveway,tapering to an eighteen foot (18') wide driveway at the sidewalk , within a zoning district otherwise requiring a maximum two (2) car garage with a maximum eighteen foot (18") foot wide driveway pursuant to Section 14.1101.B.3 of Article XI and Section 14.116.C of Article I, respectively of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 68-V-86) before the Zoning Board Appeals of the Village of Mount Prospect on the 8th day of January, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 22nd day of December, 1986; and of WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1101oB.3 of Article XI and Section 14.116.C of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction age 2 ZBA 68-V-86 with a three (3) car garage and a driveway, tapering to an eighteen sidewalk. thirty foot (30') wide foot (18') wide driveway at the SECTION THREE: The variations granted herein shall be conditioned upon no additional accessory structures shall be permitted on the Subject Property and the petitioner shall install and perpetually maintain decorative lighting on the two concrete strips adjacent to the driveway. SECTION FOUR: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall from and after its passage, approval form in the manner provided by law. be in full force and effect and publication in pamphlet PASSED and APPROVED this 3rd day of February , 1986.
