WILKS AS LIQUOR COMMISSIONER DATE: JULY 14, 2011 SUBJECT: DELETION OF CLASS "S6" LIQUOR LICENSE LETY'S SPORTS BAR & GRILL 1827 WEST ALGONQION ROAD CHANGE OF ADDRESS CLASS "F2" LIQUOR LICENSE TORTAS LOCAS 1839 WEST ALGONQUIN ROAD Background: Tortas Locas Restaurant is currently owned by Mr. Jesus Rosales and operating at 1839 W. Algonquin Road. Tortas Locas holds a Class "F2" liquor license which provides for the service of beer and wine at tables only. Tortas Locas has been at this location since 2003 with no liquor violations. In August 2010 owner Jesus Rosales also opened Lety's Sports Bar & Grill located at 1827 W. Algonquin Road. Due to a number of serious liquor violations at this location a Class "S6" (license with conditions) was issued on May 3, 2011. Request: On June 29, 2011 Mr. Rosales indicated to Village staff that he will be closing Lety's Sport's Bar and Grill permanently and will surrender the liquor license. He is requesting that Tortas Locas be able to move into the Lety's Sport's Bar & Grill location operating as a family restaurant under the current Tortas Locas name and keeping the current "Class F2" classification. Section 13.402(a) of the Liquor Ordinance reads that a liquor license location may be changed upon written request and shall be within the sole discretion of the liquor commissioner. I am requesting adoption of an Ordinance decreasing the number of Class "S6" licenses by one. IRVANA K. WILKS .�•�' Mayor HAADMNIDCJ\LiquoATortas Locas Location Change.docx ORDINANCE NO. _____ AN ORDINANCE AMENDING CHAPTER 13 OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses available in each Classification and shall establish a list specifying the number of Liquor Licenses authorized. Said list is hereby amended by decreasing the number of “Class S-6” Liquor License by One (1) Jesus Family Corporation d/b/a Lety’s Sports bar & Grill at 1827 W.
