AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 401 CRAIG COURT
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, John L. Sullivan has filed an application for variation
with respect to property commonly known as 401 Craig Court in the
Village of Mount Prospect, Illinois (the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 13 in Lincoln Circle Subdivision being a Subdivision
of the North 3/4 of the North East 1/4 of the South West
1/4 of Section 10 (except the East 300.0 feet thereof)
in Township 41 North, Range 11, East of the Third Principal
Meridian, in Cook County, Illinois
and
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a single family detached
dwelling to be built on the Subject Property with a three-car
garage and a thirty-one foot (31') wide driveway, within a zoning
district otherwise requiring a two-car garage and an eighteen
foot (18') wide driveway pursuant to Section 14.1103.B.3 of
Article XI and Section 14.116.C of Article I of Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 67-V-86) before the Zoning Board
Appeals of the Village of Mount Prospect on the 18th day of
December, 1986, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the Ist day of
December, 1986; and
of
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variations, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President
Board of Trustees of the Village of Mount Prospect.
and
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variations requested with respect to Section 14.1103.C.3 of
Article XI and Section 14.116.C of Article I of Chapter 14 of the
Village Code of Mount Prospect, Illinois, to allow the
construction of a three car garage and a thirty-one foot (31')
wide driveway subject to the following conditions:
A. The driveway shall taper to eighteen feet (18')
at the sidewalk, and

B. No other accessory structures shall be constructed
on the property, and
C. All costs associated with the relocation of the
existing utility pole shall be paid by the petitioner,
and
D. The construction shall be in conformance with the
Site Plan attached hereto as Exhibit A.
SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
