AN ORDINANCE GRANTING A SPECIAL USE FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1740 W DEMPSTER STREET
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, the Illinois Petroleum Company, Inc. has filed an
application for variation with respect to property commonly known
as 1740 W Dempster St in the Village of Mount Prospect, Illinois
(the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
That part 'of Lot Two (2) in Edward Busse's Division of part
'of the Southeast Quarter (1/4) of Section 15, and the Northeast
Quarter (1/4) of Section 22, Township ~41 North, Range 11,
East of the Third Principal Meridian, as Recorded December
17, 1919, as Document Number 6696216, in Cook County,
Illinois described as follows:..Beginning at a point in the
old center line of Algonquin Road which is 210 feet East of
(measured at right angles to) the West line of the East Half
(1/2) of said Southeast Quarter (1/4) ; thence North along
a line 210 feet East'~Of~and parallel with the West line of
the East Half (1/2)'of'said Southeast Quarter, a distance of
103.05 feet to an a angle point; thence Northeasterly along
a diagonal line drawn from said angle point to a point in
the East line of said Lot 2 ehich is 326.25 feet North of
the South line of said Section 15 (as measured along the
East line of said Lot 2) a distance of 333.85 feet to a
point (said point being 636.08 feet Southwesterly of the
East line of said Lot42,-as'measured along said diagonal
line); thence Southeasterly along a line drawn at right
angles to said South line, a distance of 219.82 feet to the
South line of said Southeast Quarter (1/4); thence West
along said South line, a distance of 259.56 feet to the
Intersection of said South line with said Old center line of
Algonquin Road; thence Northwesterly along said old center
line a distance of 121.80 feet to the point of Beginning,
(excepting the Easterly 128.05 feet, as measured at right
angles to the Easterly line thereof), also.excepting from
the above described tract the South 50 feet thereof taken
for Dempster Street per Document Number 9967970 and except
that party lying Southwesterly of the Northeasterly line of.
Algonquin Road aT widened per Document Number 11195781, in
Cook County, Illznois.
WHEREAS, Petitioner seeks to rezone the property from the B-3
Business District to the B-4 Business District to allow operation
of a FAIR Automotive muffler shop; and
WHEREAS, a public hearing was held on the rezoning request
(designated as Case No. ZBA-60-V-86) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 23rd day of
October, 1986, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 6th day of
October, 1986; and
WHEREAS, the Zoning Board of Appeals has reviewed the request for
map amendment and recommeded an alternative of a Special Use for
an Automotive Maintenance and Service Center subject to certain
conditions to the President and Board of Trustees of the Village
of Mount Prospect; and

WHEREAS, the President and Board of Trustees have given further
consideration to the Special Use request and have determined that
the same satisfies the standards set forth in Section 14.704 of
Article VII regarding the Special Use of said Chapter 14 of the
Village Code, and this Board further finds that it would be in
the best interest of the Village to grant the request for Special
Use provided that same is accomplished pursuant to the conditions
hereinafter set forth.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property
a Special Use for the operation of an Automotive Maintenance
and Service Center in the B-3 Business District.
SECTION THREE: The subject Special Use shall be granted upon
the following conditions:
(1
The improvements shall be constructed in accordance
with the site plan attached as Exhibit A, as, modified
by the additional conditions herein.
(2
Two drives, each 24 foot wide, will be allowed.
drive on Dempster and one on Algonquin, each
perpendicular to the roadway.

The asphalt area must be reduced to the greatest
extent possible. Excessive asphalt should be replaced
with landscaping. The parking stalls on the east end
of the property should be pulled back west to meet
with the driveway. Any remaining asphalt between the
stalls and the east property line should be replaced
with landscaping.
(4 Any remaining gas tanks and pumps must be removed.
(5) A landscaping plan must be submitted and approved by
the Planning and Zoning Department.
(6) Sidewalks must be installed along all street frontages.
(7) This building should be connected into the Village
sanitary sewers if it is not already so.
(8) The building should be upgraded in appearance and
properly maintained.
(9)
The developer will be responsible to curb all parking
areas so that the cars do not overhang onto private
property.
(10) The developer will be responsible for three street
lights on Algonquin and Dempster.
SECTION FOUR: With the Exception for the variation granted
herein, all other applicable Village of Mount Prospect Ordinances

and Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
