ORDINANCE NO. 3832
AN ORDINANCE MODIFYING SECTIONS OF CHAPTER 16
ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE
CODE OF MOUNT PROSPECT
WHEREAS, The Alter Group has requested modifications from the
Development Code pertaining to requirements for public
improvements and,
WHEREAS, the Plan Commission of the Village of Mount Prospect,
Cook County, Illinois, has reviewed the proposed modifications to
Chapter 16, Development Code, of the Village Code of Mount
Prospect for property commonly known as
Attached Exhibit "A" and "B"
and
WHEREAS, the Plan Commission has forwarded its recommendations
relative to modifications to Chapter 16, Development Code, to the
President and Board of Trustees, which recommendations have been
considered at a regular meeting of the President and Board of
Trustees; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined the best interests of the Village
of Mount Prospect will be attained by the adoption of the
recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD oF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That modifications from Chapter 16 entitled
"Development Code" of the Village Code of Mount Prospect are
hereby granted, for the property being the subject of this
Ordinance, as to the following:

Section 16.403.A to allow a sixty-six foot (66')
right-of-way and pavement width of thirty-five
feet (35') (back of curb to back of curb) instead
of the eighty foot (80') right-of-way and thirty-
eight foot (38') pavement;

Section 16.403.A to allow a structural number of
3.5 for dedicated roads instead of the required
4.0;

Section 16.403.A to allow a minimum horizontal curve
for roadways of one hundred fifty feet (150') instead
of four hundred feet (400') and to waive the
requirement for a minimum tangent between reverse
curves of one hundred feet (100') in order to construct
the roadway in accordance with the Preliminary Plans
submitted and attached hereto;

Section 16.403.A.9 to allow sidewalks on one (1) side
of the interior streets instead of both sides;

Section 16.403.C.4 to allow rear yard utility easements
to be ten feet (10') instead of the required twenty feet
(20');

Section 16.403.A.9 to allow the required sidewalk along
Algonquin Road, West of the proposed Wall Street to be
installed upon Village staff request at a later time, to

be secured by a restrictive covenant against the
property, instead of immediate construction;
Section 16.408.A.1 to allow the property owner to plant
the required parkway trees, with the approval of size,
species, location, and planting method by the Village
Forester, instead of the Village planting the trees.
Section 16.408.A.3 to allow hydroseeding of the parkway
instead of sod with the approval of the Village
Forester and subject to installation of an acceptable
subsurface sprinkler system.
Section 16.403.F.1 to allow detention basins within
twenty-five feet (25') of a building instead of
seventy-five feet (75').
SECTION TWO: The modifications approved herein are subject to
construction in conformance with the Preliminary Plan submitted
and attached hereto.
SECTION THREE: Except for the changes stated herein all other
codes of the Village of Mount Prospect shall apply to the Subject
Property in their entirety.
SECTION FOUR: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form as provided by law.
