INVOCATION INVOCATION Northwest Assembly of God Pastor, Russell Bechtold gave the invocation. Pastor Bechtold also serves as the Chaplain for the Mount Prospect Fire and Police Departments. MINUTES APPROVAL OF MINUTES Trustee Hoefert, seconded by Trustee Korn, moved to approve the minutes of the special meeting held April 12, 2011. Upon roll call: Ayes: Hoefert, Juracek, Korn, Polit, Zadel Nays: None Motion carried. Trustee Zadel, seconded by Trustee Polit, moved to approve the minutes of the regular meeting held April 19, 2011. Trustee Juracek requested correction of the minutes under "Other Business" to accurately reflect the information she shared regarding the Mount Prospect Historical Society's Colony Crown Revolutionary event on May 14 and 15 Minutes read: She added that AMC theatres donated two (2) — one (1) year passes for movies; winner and one guest. Cost of admission enters participant in drawing. FINANCIAL REPORT MONTHLY FINANCIAL REPORT AND APPROVE BILLS & APPROVE BILLS Mayor Wilks stated the next item on the agenda, "APPROVE BILLS" was noted by an asterisk, and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote, as business item "IX. CONSENT AGENDA." MAYOR'S REPORT APPOINTMENTS Mayor Wilks presented the following appointment for Village Board approval: Minutes of the Regular Meeting Page 1 of 8 May 3, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect Economic Development Commission Norman Kurtz Term expires May 2015 Mr. Kurtz's appointment fills the unexpired term of Mr. Bennett Trapani. Trustee Zadel, seconded by Trustee Polit, moved to approve the appointment as listed above: Upon roll call: Ayes: Hoefert, Juracek, Korn, Polit, Zadel Nays: None Motion carried. Mr. Kurtz was in attendance and thanked the Village Board for the opportunity to work with the Commission, Village Board and staff to enhance economic development in the Village. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Mr. Jim Peterson Peterson Roofing 603 East Kensington Road Mr. Peterson thanked the Village Board and staff for their support and assistance during the relocation of Peterson Roofing to the Village of Mount Prospect. He is very pleased to be a part of the community and will be expanding his involvement. Mr. Peterson invited the Village Board and members of the community to attend the ribbon cutting ceremony and Open House on May 21 CONSENT AGENDA CONSENT AGENDA Trustee Hoefert, seconded by Trustee Juracek, moved to approve the following business FINANCIAL REPORT items: & BILLS 1. A RESOLUTION AUTHORIZING EXECUTION OF A GRANT OF LICENSE WITH THE MOUNT PROSPECT DOWNTOWN MERCHANTS ASSOCIATION TO RES 15 -11 CONDUCT WEEKLY CAR SHOWS 4. A RESOLUTION EXTENDING THE PERIOD OF PARTICIPATION IN THE INTER - VBA 21 -11 GOVERNMENTAL PERSONNEL BENEFIT COOPERATIVE FOR A PERIOD OF THREE ADDITIONAL YEARS (July 1, 2011 — June 30, 2014) VBA 22 -11 5. Request Village Board approval to accept proposal for catch basin and inlet repair in an amount not to exceed $65,110.00. VBA 23 -11 6. OLD BUSINESS OLD BUSINESS PZ- 17 -10, 501 Midway Drive, Niagara Educational Services, Inc. 2 nd reading of an ordinance granting a conditional use to operate a community center and school for property located at 501 Midway Drive. Minutes of the Regular Meeting Page 2 of 8 May 3, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect Village Manager Michael Janonis stated the petitioner submitted a request for further deferral of the 2nd reading of the ordinance; defer to the May 17, 2011 Village Board meeting. The first reading of the ordinance was held at the March 1, 2011 Village Board meeting; this is the petitioner's third request for deferral. He stated it was the prerogative of the Village Board to grant or deny the request for deferral. Trustee Polit, seconded by Trustee Juracek, moved to approve petitioner's request to defer PZ- 17 -10, request for conditional use permit, until the May 17, 2011 Village Board meeting. Upon roll call: Ayes: Hoefert, Juracek, Korn, Polit, Zadel Nays: None Motion carried. Mayor Wilks stated this item will be brought back as a second (2 reading at the May 17, 2011 Village Board meeting. NEW BUSINESS NEW BUSINESS Mayor Wilks presented a resolution declaring the results of the April 5, 2011 Consolidated 2011 CONSOLIDATED Election. ELECTION Paul Wm. Hoefert, Arlene A. Juracek and A. John Korn each received an uncontested number of votes and were declared elected [re- elected] to the Office of Village Trustee of the Village of Mount Prospect to four (4) year terms. Dale Barbara Draznin, Richard T. Tani, Brian Gilligan each received an uncontested number of votes and were declared elected to the Office Library Trustee of the Village of Mount Prospect for six (6) year terms. Trustee Zadel, seconded by Trustee Juracek, moved for approval of Resolution No. 13 -11: A RESOLUTION DECLARING THE RESULTS OF THE CONSOLIDATED RES 13 -11 ELECTION OF THE VILLAGE OF MOUNT PROSPEC, APRIL 5, 2011 Upon roll call: Ayes: Hoefert, Juracek, Korn, Polit, Zadel Nays: None Motion carried. MAYOR AND VILLAGE MAYOR AND VILLAGE BOARD REMARKS BOARD REMARKS In extending their congratulations to Trustee Hoefert, Trustee Juracek and Trustee Korn, Mayor Wilks, Trustee Zadel and Trustee Polit expressed their appreciation for having the opportunity to work with this Village Board; ethical and dedicated individuals committed to the residents they serve. Trustee Hoefert, Trustee Juracek and Trustee Korn each expressed their appreciation to the residents of Mount Prospect for their support as well as their personal commitment to sere in the best interests of the community. Additional Village Board Comments • Low voter turn -out - encouraged greater participation in the election process; vote at local level more direct impact than state /federal elections. • Individuals sere on Board out of love for community. • Recognized former Mayor Gerald "Skip" Farley and former Trustee Leo Floros who were in attendance. • Productive Board to sere on; treat each other as colleagues. • Village of Mount Prospect is a great community. "National Police Week, May 15 — 21, 2011" Mayor Wilks presented the proclamation to Police Chief John Dahlberg. Chief Dahlberg thanked the Mayor and Village Board for their support of the Police Department. In reference to the number of police officers killed in the line of duty in 2010, Chief Dahlberg stated the number of deaths in 2011 are expected to exceed the 2010 deaths. Seventy (70) police officers have already lost their lives this year; most killed by vehicles during traffic stops. To help prevent these senseless deaths the State of Illinois enforces "Scott's" law which requires moving vehicles to move into the lane away from the lane used by the officer. PUBLIC WORKS B. "National Public Works Week, May 15 — 21, 2011" WEEK Public Works Director Sean Dorsey thanked the Mayor and the Village Board for their support of the Public Works Department. He extended an invitation to the community to attend the 32nd annual Public Works Open House, Saturday, May 14 9:00 a.m. — 1:00 p.m. A fun and educational day; learn about what Public Works does and why. Mayor Wilks stated residents could go from the Public Works Open House to the Colony and Crown Revolutionary War re- enactment sponsored by the Mount Prospect Historical Society at Lions Park. AMEND CHAPTER 13 C. Amend Chapter 13; Jesus Family Corporation, d /b /a Lety's Sports Bar and Grill (ALCOHOLIC Mayor Wilks presented for a first (1 reading an ordinance amending Chapter 13 (Alcoholic LIQUORS) Liquors) of the Mount Prospect Village Code. This ordinance amends the Village Code by decreasing the number of Class "S -3" liquor licenses by one (1) issued to Jesus Family Corporation, d /b /a Lety's Sports Bar and Grill, 1827 West Algonquin Road and increasing the number of Class "S -6" liquor licenses by one (1) for Jesus Family Corporation, d /b /a Lety's Sports Bar and Grill, 1827 West Algonquin Road. Minutes of the Regular Meeting Page 4 of 8 May 3, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect Mayor Wilks stated Lety's has submitted their renewal application and fees for 2011/2012 and as the Liquor Commissioner she has the authority to renew licenses if the renewal applications and fees are properly submitted. However, creation, deletion or change in license classifications must be approved by the Village Board. Due to the number and seriousness of violations under their Class "S -3" liquor license she is requesting issuance of a Class "S -6" liquor license for Lety's. Class "S -6" liquor license classification — a liquor license with special conditions. AMEND CHAPTER 13 D. Amend Chapter 13; Osaka Corporation d /b /a Nina Restaurant (ALCOHOLIC Mayor Wilks presented for a first (1 reading an ordinance amending Chapter 13 (Alcoholic LIQUORS) Liquors) of the Mount Prospect Village Code. This ordinance amends the Village Code by decreasing the number of Class "S -6" liquor licenses by one (1) issued to Osaka Corporation, d /b /a Nina's Restaurant, 1776 West Golf Road and increasing the number of Class "F -3" liquor licenses by one (1) for Osaka Corporation, d /b /a Nina's Restaurant, 1776 West Golf Road. Mayor Wilks stated since 2008 Nina's Restaurant has operated under a liquor license classification "license with conditions" and complied with all regulations during the three (3) year period. In consideration of Nina's 2011/2012 liquor license application she felt the restrictions could be lifted. The change in classification requires Village Board approval. AMEND CHAPTER 13 E. Amend Chapter 13; Alemar Inc. d /b /a Las Islas Marias, 1784 West Golf Road (ALCOHOLIC Mayor Wilks presented for a first (1 reading an ordinance amending Chapter 13 (Alcoholic LIQUORS) Liquors) of the Mount Prospect Village Code. Minutes of the Regular Meeting Page 5 of 8 May 3, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect This ordinance amends the Village Code by decreasing the number of Class "F -1" liquor licenses by one (1) issued to Alemar, d /b /a Las Islas Marias, 1784 West Golf Road. Mayor Wilks stated the owner of Las Islas Marias has decided not to renew their existing liquor license; the restaurant will continue to operate without liquor service. NEW BUSINESS NEW BUSINESS A. Amend Chapter 9; Delete Item B.3. Specific Sites under Section 413, New Wells AMEND CHAPTER 9, Prohibited. PUBLIC UTILITIES, Mayor Wilks presented for a first (1 reading an ordinance amending Chapter 9, "Public PAVEMENT AND Utilities, Pavement and Tree Regulations," by deleting Item "B.3" Specific Sites Under TREE REGULATIONS Section 413, "New Wells Prohibited." Village Manager Janonis provided background information stating this is a housekeeping ordinance that reflects a change in how future ground water ordinances are processed; specific sites will no longer be incorporated into the municipal code. The ordinances for individual sites will be maintained by the Village Clerk in the same record keeping manner as all other ordinances. VILLAGE MANAGER'S VILLAGE MANAGER'S REPORT REPORT Village Manager Janonis stated the Public Works Department had a request for approval of work at Station 16 Reservoir and Booster Station. STATION 16 A. Station 16 Reservoir and Booster Station RESERVOIR AND 1. Public Works Director Sean Dorsey presented the bid results and recommendations for BOOSTER STATION the cleaning and painting of Reservoir 16 in an amount not to exceed $285,890. Minutes of the Regular Meeting Page 6 of 8 May 3, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect Mr. Dorsey stated roof repairs to the reservoir have been completed and the tank is ready for painting. The Village's engineering consultant prepared plans and specifications for the cleaning and painting of the tank; project includes the cleaning and over - coating of the exterior, complete sandblasting and painting of the tank. After the tank is painted new cathodic protection netting must be reinstalled, at which time the tank will also be disinfected, sampled and placed back in service; anticipate the tank will be back in service by the end of June 2011. Mr. Dorsey stated the bids were reviewed by the Village and consulting engineer. Based on the consultant's review, it was concluded that the low bidder, Eagle Painting and Maintenance appeared to be sufficiently experienced, qualified and responsive to the bid. Staff recommend the Village Board award the bid contract for the cleaning and painting of Reservoir 16 to Eagle Painting and Maintenance of Lansing, Illinois in an amount not to exceed $285,890; includes a 10% contingency of $25,990. [Engineer's estimate for this project was $430,000 — $480,000.] Mr. Dorsey provided the following in response to questions from the Village Board: • Low bid was significantly less than highest bid and engineer's estimate. Several reference check were made; all satisfactory. • Interior painting - two part painting system, industrial paint used in all tanks. • Ceilings — holding up well. • Cathodic protection — rust protection, reduce electrical transfer between metal and water. Trustee Zadel, seconded by Trustee Polit, moved for approval of request to accept bid for the cleaning and painting of Reservoir 16 in an amount not to exceed $285,890.00. Public Works Director Sean Dorsey presented the proposal and recommendations for professional services agreement for engineering assistance for cleaning and painting of Reservoir 16 in an amount not to exceed $18,200.00. Mr. Dorsey stated staff is recommending the continued use of consulting engineer, Tank Industry Consultants of Bolingbrook, Illinois on a part -time basis. Benefit to having engineer on -site; their knowledge and experience is important to project. Trustee Zadel, seconded by Trustee Polit, moved for approval of request to accept proposal for professional services agreement for engineering assistance for the cleaning and painting of Reservoir 16 in an amount not to exceed $18,200.00. At the request of Mayor Wilks Mr. Dorsey also responded to questions regarding the water main break that occurred today at Central Road and Northwest Highway. • Major water main break - 12 inch water main, 10 feet down • Staff able to repair break; based on staff assessment rest of main is in good shape • Repair done without water turn off. • Police great assistance with traffic control; Central Road down to two lanes. • Public Works staff did a fantastic job — anticipate work complete and all lanes on Central Road open by 9:00 pm this evening. Trustee Korn also commented that non - residents have made positive remarks regarding the Village's beautiful landscaping. [Mr. Dorsey stated Forestry/Grounds Division is to be credited for the beautiful design and plantings.] • Mayor Wilks stated the Mayor's Annual Prayer Breakfast will be held May 5 7:30 a.m., Bristol Courts Sponsored by Inter -Faith Council and Mount Prospect Chamber of Commerce • Mayor Wilks clarified why the payment for her blackberry is under Approval of Bills; she pays for her own account. • Mayor Wilks stated as part of the Village's budget reduction, the Village is no longer a member of the U.S. Conference of Mayors. • Trustee Polit thanked Trustee Hoefert for running the Saturday night Car show; every Saturday night, May 14 — September 24 th . [ Car show started in 1989.] In response to questions from Trustee Hoefert regarding deterioration of a number of the Village's brick sidewalks, Mr. Dorsey provided the following: • Inspection and repair of sidewalks begins in the spring; cleaning and sealing program. • Sealant protects and extends the life of the bricks.
