A RESOLUTION AUTHORIZING EXECUTION OF A GRANT OF LICENSE
WITH THE MOUNT PROSPECT LIONS CLUB

WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have determined that
the best interests of the Village would be served by entering into a Grant of License between the Village

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS A HOME RULE MUNICIPALITY:
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect do hereby
Market on Union Pacific Railroad property, which property is leased by the Village and under the control
of said Village, a copy of the Grant of License is attached hereto and hereby made a part of as Exhibit
"A".
SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and
approval in the manner provided by law.

GRANT OF LICENSE
The Village of Mount Prospect hereby grants a license to the MOUNT PROSPECT LIONS CLUB
Pacific Railroad property located both east and west of Main Street/Elmhurst Road, which property
is currently leased by the Village of Mount Prospect from the Union Pacific Railroad Company. This
License is subject to the following conditions:
1. The term of the License shall be from June 12 through October 16, 2011.
2.
Insurance in an amount not less than $100,000 per occurrence and shall execute a Hold
Harmless Agreement, a copy of which is attached hereto and hereby made a part of as
Exhibit "B".
3. This License shall be revocable at any time by the corporate authorities of the Village of
Mount Prospect if the licensee or any vendor is in violation of state or local laws or this Grant
of License.
4. The licensee must issue written rules applicable to all vendors and must certify each vendor
as qualified prior to the vendor's participation in the Market. The licensee shall ensure all
applicable Village food code regulations (Chapter 12 of the Mount Prospect Village Code)
are followed and enforced. The licensee shall cooperate fully with duly authorized Village
employees for enforcement of Village codes including but not limited to prequalification, spot
inspections, etc.
5. Within ten (10) days of the execution of this Grant of License, the licensee shall submit to
the Village Manager a pro forma revenue and expense statement setting forth certification
fees and estimated revenues, expenses, management fees, if any, and the proposed
disposition of potential net revenues.
6. Prior to November 30, 2011, the licensee shall issue a written report to the Village Manager
outlining the financial aspects of running the Market, problems encountered in the year
2011 season, along with proposed solutions, proposals for improving the Market and the
outlook for the future of the Market.
7. The licensee shall possess a Certificate of Insurance for public liability insurance in an
amount of not less that $1,000,000 per occurrence naming both the Village of Mount
Prospect and the Union Pacific Railroad Company as additional insured.

8. The licensee/grantee shall not discriminate against any employee, applicant, volunteer,
authorized vendor or event participant because of race, color, religion, sex, sexual
orientation, marital status, national origin or ancestry, citizenship status, age, physical or
mental handicap unrelated to ability, military status or an unfavorable discharge from military
service.
This Grant of License is personal to the MOUNT PROSPECT LIONS CLUB and may not be
transferred to any other person or entity.

WHEREAS, MOUNT PROSPECT LIONS CLUB ("GRANTEE") has requested permission of the
corporate authorities of the Village of Mount Prospect, ("GRANTOR") to operate a Farmer's Market
within the parking lots located on the Union Pacific Railroad property, located both east and west of
Main Street/Elmhurst Road; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect did adopt
Resolution No. -11 on May 17, 2011, entitled "A Resolution Authorizing Execution of a License to
the Mount Prospect Lions Club to Conduct t
NOW, THEREFORE, upon the mutual covenants and agreements hereinafter set forth and other
good and valuable consideration, the receipt of sufficiency of which are hereby acknowledged, the
GRANTOR has granted a Grant of License to GRANTEE to operate a Farmers Market within the
parking lots located on the Union Pacific Railroad property, located on both the east and west sides
of Main Street/Elmhurst Road, which license is conveyed, however, subject to the following terms,
covenants and conditions:
1. The GRANTOR may at any future time after the date hereof revoke the License referenced
herein and without notice to the GRANTEE and without cost to either the GRANTOR or
his/her successors or assigns.
2. Upon such revocation of said License by the GRANTOR, and with written notice of said
3. GRANTEE shall at all times, and under all circumstances, indemnify, protect, and save
harmless the GRANTOR, its grantees, licensees, agents, lessees and invitees, from and
against any and all damages, losses, claims, demands, actions, and causes of action
whatsoever (including any reasonable costs, expenses, and attorneys' fees which may be
incurred in connection therewith) whether or not the claim, demand or other action asserted
by meritorious, and which results from or is alleged to arise as a result of the activity being
the subject of this Agreement.
4. GRANTOR shall not be liable to GRANTEE, her grantees, licensees, agents, lessees, or
invitees for any damages or injuries (including death) to any person thereof except to the
extent that injuries or damages are caused by the negligent, willful, or malicious misconduct
of GRANTOR.

The Petitioner has requested a second extension of the zoning approvals granted by the Village in 2068 for a
Conditional Use Permit and Variations to construct a three -unit rowhome development. The Village
previously extended the approvals on January 19, 2010. However, the Petitioner has yet to construct the
development due to the current economic downturn. Therefore, the Petitioner is seeking approval to renew
the requests for an additional 2 years in hopes that the residential markets will improve.
Attached is a letter from the Petitioner requesting the extension of the Conditional Use and Variation
approvals. As the letter indicates, the Petitioner did not obtain a building permit within the time frame of
the zoning approvals due to the poor residential market. The Petitioner hopes to start construction in
the near future.
Please forward this memorandum and attached letter to the Village Board for their review and
consideration at their May 17 meeting. The Village Board would need to approve a motion to extend
the Conditional Use and Variations granted pursuant to Ordinance #5692. Staff will be present at this
meeting to answer any questions related to this matter.

As per our recent conversation, please extend the "conditional use" permit which,
unbeknown to me, expired in January 2011.
Due to the present economic conditions, and so I won't have to waste the Village's time,
please extend the "conditional use" permit for two years. Naturally, during this two year
period we will be watching the market. If it continues to improve, we will commence our
building plans as soon as possible.

ORDINANCE NO. 5692
AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT AND VARIATIONS
FOR PROPERTY LOCATED AT 309 -317 WEST PROSPECT AVENUE,
MOUNT PROSPECT, ILLINOIS
WHEREAS, Paul Swanson Associates ("Petitioner"), has filed a petition fora Conditional Use permit
to allow dwelling units on the ground floor of a three unit rowhome development and Variations with
respect to property located at 309 -317 West Prospect Avenue ( "Property ") and legally described on
the attached Exhibit "A "; and
Property Index Numbers: 08 -11- 205 -010, 08 -11- 205 -011, 08 -11- 205 -012; and
WHEREAS, the Petitioner seeks a Conditional Use permitto construct a three (3) unit rowhome with
dwelling units on the ground floor; and
WHEREAS, the Petitioner seeks Variations to allow the following setbacks and building height: 13'
front yard (Prospect Avenue), a 25' rear yard setback (Busse Avenue) and 31.25 building height
(midpoint) as shown on the Petitioner's site plan and elevations dated November 8, 2007.
WHEREAS, a Public Hearing was held on the request for a Conditional Use permit and Variations
being the subject of Case No. 38 -07 before the Planning and Zoning Commission of the Village of
Mount Prospect on the 27 day of March, 2008, pursuant to proper legal notice having been
published in the Mount Prospect Journal & Topics on the 10 day of October, 2007; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect in support of the request
being the subject of PZ- 38 -07; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given
consideration to the requests herein and have determined that the requests meet the standards of
the Village and that the granting of the proposed Conditional Use permit to allow construction of a
three (3) unit rowhome with dwelling units on the ground floor and Variations would be in the best
interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE
OF THEIR HOME RULE POWERS:
SECTION ONE The recitals set forth hereinabove are incorporated as findings of fact by the
President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO Approval of the Conditional Use permit is subject to compliance with the following
conditions:
A. Consolidation of the three separate lots as shown on Exhibit "A"
B. Right -of -way squared off at the intersection of Busse Avenue and Elmhurst Avenue.

E. Prior to obtaining the Certificate of Occupancy, the Petitioner must submit homeowner's
association documents for staff to review and approve that include text stating on- street
over night parking is prohibited;
F. The Petitioner shall construct all units according to all Village Codes and regulations,
including, but not limited to: the installation of automatic fire sprinklers.
SECTION THREE The President and Board of Trustees of the Village of Mount Prospect do
hereby grant approval of a Conditional Use permit and Variations as provided in Section 14.203.F.7
and Section 14.203.C.7 of the Village Code, for a three (3) unit rowhome development with
dwellings on the ground floor, all as shown on the Site Plan dated November 8, 2007 a copy of
which is attached and made a part this ordinance.
SECTION FOUR The Village Clerk is hereby authorized and directed to record a certified copy of
this Ordinance with the Recorder of Deeds of Cook County.
SECTION FIVE This Ordinance shall be in full force and effect from and after its passage, approval
and publication in pamphlet form in the manner provided by law.

SUBJECT.: PZ -08 -11 11015 N. ELMHURST ROAD I VARIATION (WALL SIGNAGE
FOR OLD NAVY) ! BRIGHT LIGHT SIGN COMPANY
The Planning & Zoning Commission denied the petitioner's request to allow wall signage that exceeds
the maximum area and height permitted for the property located at 1015 N. Elmhurst Road, as
described below. The petitioner is appealing the Planning & Zoning Commission's denial of the
Variation requests.
The Petitioner proposes to install a projecting sign on the front elevation of the Old Navy store currently
under construction at Randhurst Village. The Village's Sign Code permits projecting signs up to sixteen
(16) square feet in area and up to fourteen (14) feet in height. The Petitioner' projecting sign measures
twenty three (23) square feet in area and thirty two (32) feet in height, which exceeds the maximum
area and height permitted by sixteen (16) square feet and eighteen (18) feet respectively.
In addition to the projecting sign, the Petitioner proposes to install a wall sign on the front fagade of the
Old Navy store. As proposed, the wall sign will measure one hundred and twenty five (125) square feet
in area. Per the Village Sign Code, a projecting sign and a wall sign may be placed on the same wail
provided the size of the wall sign does not exceed twenty five percent (25 %) of the maximum size
permitted by code. In this case, the maximum size permitted for a wall sign is thirty seven and one half
(37..5) square feet. The proposed wall sign exceeds the maximum size permitted by eighty seven and
one half (87.5) square feet.
The Planning & Zoning Commission conducted a public Bearing to review the requests on Thursday,
April 28, 2011, and by a vote of 3 -2, with two members.absent, denied the petitioner's requests to allow
wall signage that exceeds the maximum area and height permitted. Details of the proceedings and
items discussed during the Planning and Zoning Commission hearing are included in the attached
minutes.
Please forward this memorandum and attachments to the Village Board for their review and
consideration .at their May 17 ; 2011 meeting. Staff will be present to answer any questions related to
this matter.

Chairman Rogers called the meeting to order at 7:30 p.m. The minutes of the March 24, 2011 Planning and
Zoning Commission meeting were approved 4 -0 with Mr. Donnelly abstaining. After hearing three previous
cases, Chairman Rogers introduced Case PZ- 08 -11, 1015 N. Elmhurst Road, at 8:13 p.m.
Ms. Andrade said the Petitioner for PZ -08 -11 was seeking Variations for wall signage that exceeded the
maximum area and height permitted for the Old Navy store currently under construction at Randhurst Village.
Ms. Andrade stated the Petitioner proposed to install a projecting sign and an oval wall sign on the front facade of
the new store. The projecting sign would be located on an architectural fin that would be perpendicular to the
front fagade and would measure twenty -three (23) square feet in area and thirty -two (32) feet in height. The wall
sign would measure 125 square feet in area.
Ms. Andrade discussed the Petitioner's proposal with the Village Sign requirements:

Ms. Andrade said the Village's Sign Code permitted projecting signs up to sixteen (16) square feet in area and up
to fourteen (14) feet in height. The Petitioner's projecting sign would exceed the maximum area and height
permitted by sixteen (16) square feet and eighteen (18) feet respectively.
Ms. Andrade stated per the Village Sign Code, a projecting sign and a wall sign may be placed on the same wall
provided the size of the wall sign does not exceed twenty -five (25) percent of the maximum size permitted by
code. In this case, the maximum size permitted for a wall sign is thirty -seven and one half (37.5) square feet. The
proposed wall sign exceeded the maximum size permitted by eighty -seven and one half (87.5) square feet.
Ms. Andrade said required findings for Sign Variations are contained in Section 7.725 of the Village of Mount
Prospect Sign Code. The section contains specific findings that must be made in order to approve a variation: A
summary of the findings are that
The hardship is created by unique circumstances and not serve as a convenience to the petitioner,
The variation will not be materially detrimental to the public welfare or injurious to other property or
improvements in the neighborhood; and
The variation will not impair visibility to the adjacent property, increase the danger of traffic
problems or endanger the public safety.
Ms. Andrade stated per the Petitioner, the allowable square footage the Village Sign Code permits is a very small
sign in comparison to the Old Navy storefront. The Petitioner was seeking the Variations to increase the
maximum size permitted for signage that would be in proportion to the storefront. Ms. Andrade said the
Petitioner further noted that the proposed signage is aesthetically pleasing and conforms to the national Old Navy
image.
Ms. Andrade said the projecting sign would be located on the building's architectural fin that would extend out
from the store's front fagade. The architectural fin is a unique building design element that would be consistent
with the overall design and character of the Randhurst Village shopping center. Staff has reviewed the
Petitioner's Variation requests and finds that the proposed signs will not be detrimental to the public welfare or
injurious to other property or improvements.
Ms. Andrade stated Staff recommended that the Planning and Zoning Commission approve the motions listed in
the Staff Report.
There was discussion regarding the distance between the bus stop and the projecting sign. It was determined that
there was a distance of at least twenty -five (25) feet between the bus stop and projecting sign
Mr. Floros asked Staff what is a projecting sign. Ms. Andrade stated that it is a sign that projects out from the
building. It is perpendicular to the building fagade. For the subject case, the vertical proposed sign on the
architectural fin is the projecting sign.
Chairman Rogers swore in the Petitioner, Bill Holley, 310 Telser Road, Lake Zurich, Illinois. Mr. Holley stated
that he is the owner of the sign company. He discussed the projecting part of the sign. He said that this was not
on the corner of the building, so there was at least forty (40) feet between the projecting sign and the bus stop.
Mr. Holley discussed how Old Navy was reimaging the exterior and interior of their stores. Old Navy is changing
the wall signs from individual channel letters to an oval box sign. Mr. Holley stated most of the signs that would
be in Randhurst Village would have individual letters without a background. The square footage of the proposed
sign due to the colorful background increases the overall square footage. Mr. Holley said the ID portion of the
oval are three (3) feet tall. He stated that the sign is not that large; the background increases the size to 125 square
feet.

Mr. Holley stated when Old Navy builds new stores; they try to incorporate the architectural fin. He said the fin
is the projection portion of the sign. The letters on the projection sign are flush mounted individual LED channel
letters. They are up high on the fin on each side and are designed so the store front can be seen when the wail
sign cannot.
Chairman Rogers asked if the fin was part of the building or part of the sign. Mr. Holley stated the fin was part of
the building. The sign would be installed on the fin. Mr. Holley said the letters are above the normal allowable
height per Village Code. The letters and fm are slightly above the roofline.
Chairman Rogers discussed how some of the buildings in Randhurst Village are set back far from the roads that
they have allowed larger signs due to the visibility. He said the only concern was the projecting sign since the
Commission has not seen one like the proposed sign before.
Mr. Donnelly asked if the fin design could take a portion off on the bottom and leave only the top for the sign.
Mr. Holley said the fin is part of the national campaign and is consistent with other locations. He stated stores in
Niles and Morton Grove have both types of signs and look identical at their subject location.
Mr. Donnelly asked if Old Navy would be featured on the ground signs for Randhurst Village. Mr. Simmons said
per discussions with the developer, Old Navy would be granted panels on some of the ground signs. They have
not submitted for sign permit, the intent was that Old Navy would be on those signs. Mr. Donnelly stated that he
questioned the ground sign due to the visibility comment. He discussed how the fin would only be seen within
the property. Mr. Holley agreed that the projecting sign was only to identify Old Navy within the subject
property.
There was additional discussion regarding visibility and the design features of the proposed signs.
Mr. Donnelly asked if the Commission voted down the fin, it would still be there with bricks. Mr. Holley stated
he believed so. Mr. Simmons clarified that the fin has already been constructed at the subject property. It is an
architectural facade element of the building. The Variation that was being requested for the projecting sign is
only for the Old Navy letters. Mr. Simmons said the blue fin wall is permitted.
Mr. Donnelly asked if the fin was permitted even if it existed outside of the tenant's lease line. Mr. Simmons
confirmed the fin was permitted. Mr. Donnelly asked Staff if the side was outside the tenant's property line,
would it be considered an off-premise sign. Mr. Simmons stated it would not be considered an off - premise sign.
The tenant is leasing the square footage inside the space; the developer provides the shell/box for the facility. Mr.
Simmons said the blue fin wall is part of Old Navy's facade element.
Mr. Foggy confirmed with the Petitioner that the wall sign and the projecting signs would be lit.
Chairman Rogers asked if there was anyone else in the audience to address this case. Hearing none, he closed the
public portion of the case at 8:32 p.m. and brought the discussion back to the board.
Mr. Donnelly asked Staff if there is a distance between signs that needs to be followed; he wanted to know if the
wall sign and projecting signs were too close to one another. Ms. Andrade responded that the Village Code did
not have a required distance for wall signs. Mr. Simmons stated the only separation distance in the Village Code
was for freestanding signs.
Mr. Floros made a motion, seconded by Mr. Youngquist to approve:
1. A Variation to increase the maximum size permitted for a projecting sign from sixteen
(16) square feet to twenty -three (23) square feet;

2. A Variation to increase the maximum height permitted for a projecting sign from
fourteen (14) feet to thirty-two (32) feet; and
3. A Variation to increase the maximum size permitted for a wall sign which is placed on a
fagade with a projecting sign from thirty -even and one half (37.5) square feet to one 125
square feet, as shown on the Petitioner's exhibits for the property at 1015 N. Elmhurst
Road.

Motion was defeated 3 -2. The Planning & Zoning Commission's decision was final for this case.
There was additional discussion after the vote. Chairman Rogers said his issue was with the projected sign. He

AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR SIGNAGE
FOR PROPERTY LOCATED
AT 1015 NORTH ELMHURST ROAD, MOUNT PROSPECT, ILLIONOIS
WHEREAS, The President and Board of Trustees of the Village of Mount Prospect passed and approved
Ordinance No. 5705 on August 19, 2008, the Ordinance granted a Conditional Use permit for a Planned Unit
Development (Randhurst Village Commercial Planned Unit Development (PUD)), certain Variations and a
Special Use for Signage for Property located at 999 North Elmhurst Road ( "Property "); and
WHEREAS, Variations and amendment to the Special Use for Signage with respect to Ordinance 5705 for
the property located at 999 North Elmhurst Road ( "Property ") were granted on November 16, 2010, pursuant
to Ordinance No: 5821; A Special Use was granted to allow Signs Associated with a Large Scale
Development specific to ground signs. Future wall signs for individual tenant spaces are to conform to the
Village's sign regulations; and
WHEREAS, Bright Light Sign Company (Petitioner) filed an application for Variations for wall signage that
exceeds the maximum area and height permitted for the Old Navy Store currently under construction at
Randhurst Village at property located at 1015 North Elmhurst Road (Subject Property) and legally described
as follows;
Parcel 1: Lots 1 and 2 (excepting from said lot one that part taken by Department of Transportation
State of Illinois in Case No 871-51078 and also excepting from said Lot One that part conveyed to the people
of the State of Illinois Department of Transportation pursuant to that certain quit claim deed recorded
September 29, 1995 as document No. 95664230) in Randhurst Center Resubdivision — No.1 being a
Resubdivision of Lot One in Randhurst Center, being a subdivision of part of the southeast 1 /4of Section 27,
Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County Illinois according to the plat
of said Randhurst Center Resubdivision —No.1 recorded July 241987 in the office of the Recorder of Deeds of
Cook County Illinois as Document No. 87408581 and registered in the office of the Registrar of Title of said
office of the Registrar of Titles of said County as document No LR3637429.
Parcel 2: Lot 3 in Randhurst Center Resubdivision- No.1 being a Resubdivision of Lot One in Randhurst
Center being a subdivision of part of the Southeast'/ of Section 27 Township 42 North, Range 11 East of the
Third Principal Meridian in Cook County, Illinois according to the Plat of said Randhurst Center Resubdivision
—No. 1 recorded July 24,1987 in the Office of the Recorder of Deeds of Cook County, Illinois as Document
No. 87408581 and registered in the office of the Registrar of Titles of said County
as document No. LR3637429.
Parcel 3: North 70feet of the West 70 feet of the South 120 feet of the East 1/2 of the Southeast 1/4 of
Section 27, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County Illinois.
Property Index Number(s) 03 -27- 401 - 040 / 261/262/264/265 /267/268/269/270 03 -27- 401 -271; and
WHEREAS, the "Petitioner" seeks Variations to allow: (1) an increase in the maximum size permitted for a
projecting sign from sixteen (16) square feet to twenty three (23) square feet and (2) an increase in the
maximum height permitted for a projecting sign form fourteen (14') feet to thirty -two (32') feet; and 3) an
increase in the maximum size permitted for a wall sign which is placed on a fagade with a projecting sign from
thirty seven and one -half (37.5) square feet to one hundred and twenty five (125) square feet, as shown on the
Petitioner's exhibits prepared by Walton Signage dated January 3, 2011 and attached as Exhibit "A "; and
WHEREAS, a Public Hearing was held on the request for Variations (Wall Signage) being the subject of PZ -8-
11 before the Planning and Zoning Commission of the Village of Mount Prospect on the 28 day of April, 2011,
pursuant to proper legal notice having been published in the Mount Prospect Journal & Topics on the 13 day
of April, 2011; and
WHEREAS, the Planning and Zoning Commission denied the request for Variations (Wall Signage) at the
April 28, 2011 Public Hearing by a vote of 3 -2; and

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the
requests for Variations (Wall signage) meet the standards of the Village and that the granting of the requests
would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR
HOME RULE POWERS:
SECTION ONE The recitals set forth above are incorporated as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO The following Variations are granted:
1) An increase in the maximum size permitted for a projecting sign from sixteen (16) square feet to
twenty three (23) square feet;
2) An increase in the maximum height permitted for a projecting sign form fourteen (14') feet to thirty -two
(32) feet;
3) An increase in the maximum size permitted for a wall sign which is placed on a fagade with a
projecting sign from thirty seven and one -half (37.5) square feet to one hundred and twenty five (125)
square feet, as shown on the Petitioner's exhibits prepared by Walton Signage dated January 3, 2011
and attached as Exhibit "A"
SECTION THREE The Village Clerk is hereby authorized and directed to record a certified copy of this
Ordinance with the Recorder of Deeds of Cook County.
SECTION FOUR This Ordinance shall be in full force and effect from and after its passage, approval and
publication in pamphlet form in the manner provided by law.
