AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 706 E. SHA BONEE TRAIL
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Marjorie Y. Kozel has filed an application for variation
with respect to property commonly known as 706 E. Sha Bonee Trail
in the Village of Mount Prospect, Illinois (the "Subject
Property"); and
WHEREAS, the Subject Property is described as follows:
See attached Exhibit "A"
and
WHEREAS, Petitioner seeks a variation from the provisions of
Chapter 14 of the Village Code of Mount Prospect, Illinois, to
allow the construction of a twenty-five foot (25') deep by
eighteen foot (18') wide parking pad in the required rear yard
a Zoning District which has a twenty-five foot (25' rear yard
requirement; and
in
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 49-V-8~) before the Zoning Board
Appeals of the Village of Mount Prospect on the 23rd day of
July, 1987, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 8th day of
July, 1987; and
of
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variations, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.605 of Article VI of Chapter 14 of the Village
Code, and this Board further finds that it would be in the best
interest of the Village to grant the requested variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
'of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.1402.C of
Article XIV of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a twenty-five foot (25') deep by
eighteen foot (18') wide parking pad in the required rear yard
for the parking of private passenger motor vehicles.
SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and ~effect as to the
Subject Property.

SECTION FOUR: In accordance with the provisions of Section
14.604 this variation shall be null and void unless permits are
issued and construction begins within one (1) year of the passage
of this Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
