ORDINANCE NO. 3813
AN ORDINANCE MODIFYING SECTIONS OF CHAPTER 16
ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE
CODE OF MOUNT PROSPECT
WHEREAS, Davdan, Inc. has requested a modification of the
Development Code pertaining to requirements for sidewalks,
street lights, parking lot design and construction, benchmarks,
storm and sanitary sewer construction, and underground utilities;
and
WHEREAS, the Plan Commission of the Village of Mount Prospect,
Cook County, Illinois, has reviewed the proposed modifications to
Chapter 16, Development Code, of the Village Code of Mount
Prospect for property commonly known as
Lot 5 (except the west 40.0 feet thereof) in
Algonquin-Busse Industrial Park, being a subdivision
of part of the West half of the Northwest Quarter
of Section 23, Township 41 North, Range 11, East
of the Third Principal Meridian, according to the
plat thereof recorded July 29, 1968 as Document
20565713 in Cook County, Illinois;
and
WHEREAS, the Plan Commission has forwarded its recommendations
relative to modifications to Chapter 16, Development Code, to the
President and Board of Trustees, which recommendations have been
considered at a regular meeting of the President and Board of
Trustees; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined the best interests of the Village
of Mount Prospect will be attained by the approval of the
modifications.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That modifications from Chapter 16 entitled
"Development Code" of the Village Code of Mount Prospect are
hereby granted, for the property being the subject of this
Ordinance, as to Section 16, Artical IV is hereby modified to
permit:
Section 16.403.A.8 Pavement Design and
Specifications shall be modified to allow the
existing parking lot layout to continue and
allow the continuation of the existing lot base
and paving until such time as the lot is
damaged or needs reconstruction at which time
i~ shall be rebuilt to Village specifications;
and
Section 16.403.A.9 Sidewalks shall be
modified to allow the execution of a covenant
to ensure installation of the public sidewalk
by the property owner upon notification by the
Village, a copy of said is attached hereto; and
Section 16.404.B.4.b Minimum Sewer Size shall
be modified to allow a sanitary sewer service
to be four inches (4") in diameter rather than
six inches (6"); and
D. Section 16.405.B.6.a Storm Sewers shall be
modified to allow the storm sewer for the
age 2
section from the building to the parking lot to
be eight inches (8") rather than twelve inches
(12"); and
Section 16.409.A.1 Benchmarks shall be
modified to eliminate the required benchmark
from the subdivision; and
Section 16.410 Repair of Utilities shall be
modified to require repair or replacement of
existing utilities only if damage occurs during
construction.
Section TWO: Except for the changes stated herein all other
codes of the Village of Mount Prospect shall apply to the Subject
Property in their entitety.
SECTION THREE: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form as provided by law.
