A RESOLUTION DECLARING THE RESULTS OF THE CONSOLIDATED ELECTION OF THE VILLAGE OF MOUNT PROSPECT HELD APRIL 5, 2011 WHEREAS, the Consolidated General Election was held in and for the Village of Mount Prospect, Cook County, Illinois, on Tuesday, April 5, 2011, for the purpose of electing three Village Trustees for four year terms, and three Library Trustees for six year terms; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect do hereby declare the results of the April 5, 2011 election for said Village. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE That pursuant to the Consolidated Election Laws of the State of Illinois, a regular election was held for the Village of Mount Prospect, Tuesday, April 5, 2011. SECTION TWO That an official canvass was conducted on April 26, 2011 by the Cook County Clerk's Canvassing Board for the Village of Mount Prospect declaring that 2,691 ballots were counted as follows: Village Trustee — 4 -year terms Paul Wm. Hoefert 2,037 Arlene A. Juracek 1,981 A. John Korn 1,931 Library Trustee — 6 -year terms Dale Barbara Draznin 1,946 Brian Gilligan 1,925 Richard T. Tani 1,900 SECTION THREE A) Inasmuch as Paul Wm. Hoefert, A. John Korn, and Arlene A. Juracek each received an uncontested number of votes, they are hereby declared elected to the Office of Village Trustee of the Village of Mount Prospect for four -year terms; B) Inasmuch as Dale Barbara Draznin, Richard T. Tani and Brian Gilligan each received an uncontested number of votes, they are hereby declared elected to the Office of Library Trustee of the Village of Mount Prospect for six -year terms. SECTION FOUR: The Village Clerk is hereby directed to forward a certified copy of this Resolution to the Cook County Election Department and the State Board of Election Commissioners, as provided by law. A RESOLUTION AUTHORIZING EXECUTION OF A GRANT OF LICENSE WITH THE DOWNTOWN MOUNT PROSPECT MERCHANTS ASSOCIATION TO CONDUCT WEEKLY CAR SHOWS hows held in the commuter parking lots; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village would be served by entering into a Grant of License between the Village and the Downtown Mount Prospect Merchants Association in order to conduct the annual Car Shows from May 14, 2011 through September 24, 2011. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the President and Board of Trustees of the Village of Mount Prospect do hereby authorize the execution of a Grant of License to the Downtown Mount Prospect Merchants Association to conduct the Car Show on Union Pacific Railroad property, which property is leased by the Village and under the control of said Village, a copy of the Grant of License is attached hereto and hereby made a part of as Exhibit "A". SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Lisa Angell Village Clerk H:\CLKO\WIN\RESOLUTION\car show resolution2011.doc GRANT OF LICENSE The Village of Mount Prospect hereby grants a license to the DOWNTOWN MOUNT PROSPECT MERCHANTS ASSOCIATION (licensee) for the purpose of operating a Car Show on the parking lots located at the Union Pacific Railroad property located both east and west of Main Street/Elmhurst Road, which property is currently leased by the Village of Mount Prospect from the Union Pacific Railroad Company. This License is subject to the following conditions: 1. The term of the License shall be from May 14, 2011 through September 24, 2011. 2. Each vendor selling food at the Car Show shall utilize a food cart licensed by the Village of Mount Prospect Environmental Health Division and in compliance with all health and sanitation regulations of the Village and the State of Illinois. 3. This License shall be revocable at any time by the corporate authorities of the Village of Mount Prospect if the licensee or any vendor is in violation of state or local laws or this Grant of License. 4. Within ten (10) days of the execution of this Grant of License, the licensee shall submit to the Village Manager a pro forma revenue and expense statement setting forth certification fees and estimated revenues, expenses, management fees, if any, and the proposed disposition of potential net revenues. 5. Prior to November 30, 2011, the licensee shall issue a written report to the Village Manager outlining the financial aspects of running the Car Show, problems encountered in the year 2011 season, along with proposed solutions, proposals for improving the Car Show and the outlook for the future of the Car Show. 6. The licensee shall possess a Certificate of Insurance for public liability insurance in an amount of not less that $1,000,000 per occurrence naming both the Village of Mount Prospect and the Union Pacific Railroad Company as additional insured. 7. The licensee/grantee shall not discriminate against any employee, applicant, volunteer, authorized vendor or event participant because of race, color, religion, sex, sexual orientation, marital status, national origin or ancestry, citizenship status, age, physical or mental handicap unrelated to ability, military status or an unfavorable discharge from military service. NOW, THEREFORE, upon the mutual covenants and agreements hereinafter set forth and other good and valuable consideration, the receipt of sufficiency of which are hereby acknowledged, the GRANTOR has granted a Grant of License to GRANTEE to operate a Car Show within the parking lots located on the Union Pacific Railroad property, located on both the east and west sides of Main Street/Elmhurst Road, which license is conveyed, however, subject to the following terms, covenants and conditions: 1. The GRANTOR may at any future time after the date hereof revoke the License referenced herein and without notice to the GRANTEE and without cost to either the GRANTOR or his/her successors or assigns. 2. Upon such revocation of said License by the GRANTOR, and with written notice of said revocation to the GRANTEE, the GRANTEE shall cease operation of said Car Show. 3. GRANTEE shall at all times, and under all circumstances, indemnify, protect, and save harmless the GRANTOR, its grantees, licensees, agents, lessees and invitees, from and against any and all damages, losses, claims, demands, actions, and causes of action whatsoever (including any reasonable costs, expenses, and attorneys' fees which may be incurred in connection therewith) whether or not the claim, demand or other action asserted by meritorious, and which results from or is alleged to arise as a result of the activity being the subject of this Agreement. 4. GRANTOR shall not be liable to GRANTEE, her grantees, licensees, agents, lessees, or invitees for any damages or injuries (including death) to any person thereof except to the extent that injuries or damages are caused by the negligent, willful, or malicious misconduct of GRANTOR. JANONIS, VILLAGE MANAGER FROM: FINANCE DIRECTOR DATE: APRIL 27, 2011 SUBJECT: PARTICIPATION IN INTERGOVERNMENTAL PERSONNEL BENEFIT COOPERATIVE (IPBC) FOR VILLAGE HEALTH INSURANCE The Village has been a member of the IPBC in 1998. Since that time, the Village has renewed membership in this health insurance cooperative four times, the last time in 2008. There are currently 61 member agencies included in the cooperative consisting of municipalities, park districts, libraries, special service districts and sub- pools of smaller communities. This is up from 43 members at the time of the last renewal. The cooperative is an attractive alternative for agencies wanting to take advantage of the pooled aspects of insurance for shared claims experience and rate stabilization. Attached is an informational piece describing the function of IPBC. The IPBC negotiates HMO and PPO insurance coverage pricing along with individual and aggregate stop loss coverage, life insurance, prescription drug rates and claims administration. The cooperative also negotiates dental coverage where applicable. Member agencies are then able to customize their own health insurance plans based on individual need. This also allows flexibility when negotiating coverage options with any employee groups. Participation in the cooperative allows for the sharing or pooling of risk for major claims. While risk is shared among member agencies, each - rata pooled share based on the number of covered lives as a percentage of the total pool. Therefore, even if the pool experiences a poor claims year, the member agency can receive some benefit by having favorable claims experience compared to the overall pool. Pricing obtained through the cooperative compares favorably to the national trend. The table below illustrates the annual rate increase of IPBC compared to the national trend for both the HMO and PPO plans. Expanded access to more effective cost containment options by negotiating contracts with Blue Cross Blue Shield of Illinois, Cigna and United Healthcare. All of the companies offer an extensive network of physicians and hospitals that help reduce overall plan costs. Access to a wealth of information and support to assist the Village in regard to health care reform, compliance and cost analysis. The cooperative has proven to be a great resource to help the Village through changes in the insurance market. For employees, changing insurance carriers constantly to obtain cheaper insurance is disruptive to them and their dependents that may have to switch doctors to find one within th a management point of view, it is not a productive long-term strategy to keep switching insurance carriers every couple of years, as the insurance market has shrunk and fewer carriers are available from which to choose. One final benefit of membership in the IPBC is the accumulation of an equity reserve that can be utilized as a rate stabilizer during periods where claims experience is poor or to reduce the overall premium for coverage during lean budget times. The terminal reserve is built up over time when actual claims experience is lower than the budgeted monthly premium. The estimated balance in the terminal reserve account at January 1, 2011 was $555,189. Staff would recommend Village Board authorization to approve the attached resolution extending the period of participation in the IPBC for a period of three additional years from July 1, 2011 through June 30, 2014. SECTION 2: The obligation of this municipal corporation to be a Member of the Intergovernmental Personnel Benefit Cooperative shall obligate this municipal corporation to make financial contributions to the Intergovernmental Personnel Benefit Cooperative only to the extent required from time-to-time by the Contract and By-Laws of the IPBC and authorized therewith by the Board of Directors or the Executive Committee. SECTION 3: This Resolution shall take effect immediately upon its passage and approval as provided by law. PROHIBITING THE USE OF GROUNDWATER AS A POTABLE WATER SUPPLY BY THE INSTALLATION OR USE OF POTABLE WATER SUPPLY WELLS OR BY ANY OTHER METHOD BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois, acting in the exercise of their home rule powers, as follows: SECTION ONE: That Section 9.413 Use of Ground Water As A Potable Water Supply Prohibitedof the Village Code of Mount Prospect, as amended, is hereby further amended to delete Section B. 3. Specific Site in its entirety. SECTION TWO: All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed insofar as they are in conflict with this ordinance. SECTION THREE: This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law.
