AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1685 W. IMPERIAL CT
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Davdan, Inc. has filed an application for variation with
respect to property commonly known as 1685 W. Imperial Court in
the Village of Mount Prospect, Illinois (the "Subject Property");
and
WHEREAS, the Subject Property is described as follows:
Lot 5 (except the west 40.0 feet thereof) in
Algonquin-Busse Industrial Park, being a subdivision
of part of the West half of the Northwest Quarter
of Section 23, Township 41 North, Range 11, East
of the Third Principal Meridian, according to the
plat thereof recorded July 29, 1968 as Document
20565713 in Cook County, Illinois;
and
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of an Industrial building to
be built on the Subject Property with a rear (south) yard of ten
feet (10') for building and parking, a front (north) minimum yard
of six feet (6') for parking spaces and loading, a side (west)
yard of zero feet (0'), a side (east) yard of zero feet (0') for
building and three feet (3') for parking and sidwalk; a lot area
of .735 acres, and a lot coverage greater than the maximum
allowed, within a zoning district otherwise requiring a twenty
foot (20') rear yard for building, a front yard of thirty feet
(30'), a side yard for parking of ten feet (10') and for building
of thirty feet (30'), a minimum lot area of 4 acres, and a
.maximum lot coverage of .80. pursuant to Section 14.2202,
14.2203, and 14.2205 of Article XXII of Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 37-V-87) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 18th day of June,
1987, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 2nd day of June, 1987; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.2202, 14.2203, and
14.2205 of Article XXII of Chapter 14 of the Village Code of
Mount Prospect, Illinois, to allow the construction of an
Industrial Building with a rear south yard of ten feet (10') for

building and parking, a front (north) minimum yard of six feet
(6') for parking spaces and loading, a side (west) yard of zero
feet (0'), a side (east) yard of zero feet (0') for building and
three feet (3') for parking and sidewalk; a lot area of .735
acres, and a lot coverage greater than the maximum allowed,
subject to construction on the site to conform to the site plan
attached Exhibit I, and landscaping on the site to be approved by
the Department of Planning and Zoning.
SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
