ORDINANCE NO. 3801
AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 2105 PRENDERGAST LANE
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Frank Panzarino, has filed an application for variation
with respect to property commonly known as 2105 Prendergast Lane
in the Village of Mount Prospect, Illinois (the "Subject
Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 33 in St. Cecilia Subdivision, being a
Resubdivision of lot 2 and parts of lot 3 and
6 in Meier Brothers Subdivision, being a
Subdivision of parts of sections 10 and 15,
Township 41 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois;
and
WHEREAS, Petitioner seeks a variation to amend the variation
granted by Ordinance No. 3585 approved on December 3, 1985, and
from the following provisions of Chapter 14 of the Village Code
of Mount Prospect, Illinois, to allow the continuation of a patio
and driveway built on the Subject Property which patio encroaches
to within six feet (6') of the rear property line and which
driveway is twenty three feet (23') in width rather than tapering
to eighteen feet (18') as authorized by Ordinance No. 3585,
within a zoning district otherwise requiring a twenty-five foot
(25') setback from the rear property line and a maximum driveway
width of eighteen feet (18') pursuant to Section 14.1102.C of
Article XI and Section 14.116.C of Article I of Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 48-V-87) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 25th day of June,
1987, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 10th day of June, 1987; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested and amend Ordinance No. 3585 with respect to
Section 14.1102.C of Article XI and Section 14.116.C Article I of
Chapter 14 of the Village Code of Mount Prospect, Illinois, to
allow the continuation of a patio and driveway built on the
Subject Property which patio encroaches to within six feet (6')
of the rear property line and which driveway is twenty three feet
(23') in width, in accordance with Exhibit I attached hereto.

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
