AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 506 MARINA
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Emilio Vargilio has filed an application for variation
with respect to property commonly known as 506 Marina in the
Village of Mount Prospect, Illinois (the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 4 in Sakowicz First Addition to Mount Prospect
being a Subdivision of part of the East 1/2 of the
Southeast 1/4 of Section 12, Township 41 North, Range
11, East of the Third Principal Meridian, in Cook
County, Illinois;
and
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow a rear yard to be fourteen foot (14') from the
lot line for a 15'X20' concrete patio on the Subject Property,
within a zoning district otherwise requiring a rear yard to be
twenty-five foot (25') from the lot line pursuant to Section
14.1102.C of Article I of Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 17-V-87) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 23rd day of
April, 1987, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 6th day of
April, 1987; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.1102.C of Article
I of Chapter 14 of the Village Code of Mount Prospect, Illinois,
to allow the construction of a patio fourteen feet (14') from the
rear yard lot line in accordance with Exhibit "A" attached
hereto.

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
