AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 923 S. WE-GO TRAIL
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, William T. Whaley has filed an application for variation
with respect to property commonly known as 923 S. We-Go Trail in
the Village of Mount Prospect, Illinois (the "Subject Property");
and
WHEREAS, the Subject Property is described as follows:
Lot 44 in Schavile and Knuth, Inc. "Sunset Heights"
a subdivision of the East 110 Feet (as mesured on the
North Line) of that part of the East Half of the
Northwest Quarter of section 14, Township 41 North
Range 11, East of the Third Principal Meridian, lying
North of the East Quarter (Except the East 7.38 chains
thereof, as measured on the North line thereof), in and
of Section 14, aforesaid, lying North of the North Line
of Golf Road, in Cook County Illinois, according to Plat
Recorded November 21, 1955 as Document Number 16426536.
and
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 21 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a six foot (6') high fence
in front of the rear building line on the Subject Property,
within a zoning district otherwise limiting fences to the area
behind the home pursuant to Section 21.601.A of Article VI of
Chapter 21; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 14-V-87) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 23rd day of
April, 1987, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 6th day of
April, 1987; and
WHEREAS~ the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 21.601.A of Article VI of Chapter 21 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 21.601.A of Article
IV of Chapter 21 of the Village Code of Mount Prospect, Illinois,
to allow the construction of a six foot (6') fence running
parallel to Golf Road to the Southwest corner of the existing
residence as indicated on the attached Exhibit "A".

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: This Ordinance shall be in full force
from and after its passage, approval and publication
form in the manner provided by law.
