AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 607 N. EASTMAN
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Gary Haman has filed an application for variation with
respect to property commonly known as 607 S. Eastman in the
Village of Mount Prospect, Illinois (the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 39 in Brickman Manor, being a Subdivision of part
of the Northeast Quarter of the Northeast Quarter of
Section 34, Township 42 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois;
and
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a single family detached
dwelling addition to be built on the Subject Property with a
separation between the existing detached garage and the proposed
addition of three and one-half feet (3 1/2'), within a zoning
district otherwise requiring a minimum ten foot (10') separation
between the principal structure and any accessory structure
pursuant to Section 14.102.B.1 of Article I of Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 73-V-87) before the Zoning Board
Appeals of the Village of Mount Prospect on the 29th day of
October, 1987, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 8th day of
October, 1987; and
of
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of theVillage to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President
Board of Trustees of the Village of Mount Prospect.
and
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.102.B.1 of Article
I of Chapter 14 of the Village Code of Mount Prospect, Illinois,
to allow the construction of an addition to the existing home
with a separation between the existing detached garage and the
proposed addition of three and one-half feet (3 1/2') subject to
the design and construction of the addition and RETRO-fitting the
existing garage to improve fire safety in accordance with the
requirements of the Code Enforcement Department and that drainage
patterns on the lot shall not be disturbed as approved by the
Engineering Division.

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: In accordance with the provisions of Section
14.604 this variation shall be null and void unless permits are
issued and construction begins within one (1) year of the passage
of this Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
