ORDINANCE NO. 3871 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 215 WELLER LANE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Russell Warner has filed an application for variation with respect to property commonly known as 215 Weller Lane in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 1 in Weller Lane Resubdivision of lots 18 and 19 of Gettysburg Estates, being a subdivision of part of the southwest 1/4 of the northwest 1/4 of Section 11, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a three (3) car garage with a gross floor area of seven hundred sixty one (761) square feet and a driveway thirty-two and one-half feet (32 1/2') in width to be built on the Subject Property, within a zoning district otherwise requiring a two (2) car garage with a maximum gross floor area of six hundred (600) square feet and a maximum driveway width of eighteen feet (18') pursuant to Sections 14.1103.B.3, 14.102.B.4, and 14.116.C of Article I and XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 72-V-87) before the Zoning Board Appeals of the Village of Mount Prospect on the 29th day of October, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 8th day of October, 1987; and of WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President Board of Trustees of the Village of Mount Prospect. and SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Sections 14.1102.B.3, 14.102.B.4, and 14.116.C of Article I and XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a three (3) car garage with a gross floor area of seven hundred sixty-one (761) square feet and a driveway thirty-two and one-half feet (32 1/2') in width provided that the following conditions are met: A. The driveway shall be tapered to a width of eighteen feet (18') at the property line; and age 2 ZBA 72-V-87 The driveway shall maintain a minimum separation of two feet (2') from the North property line; and The driveway apron in the parkway shall be constructed of concrete or asphalt per the Development Code requirements. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force from and after its passage, approval and publication form in the manner provided by law. and effect in pamphlet PASSED and APPROVED this 1 st day of December 1987.
