AN ORDINANCE MODIFYING SECTIONS OF CHAPTER 16
ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE
CODE OF MOUNT PROSPECT
WHEREAS, Salvatore DiMucci, has requested a modification of the
Development Code pertaining to requirements for detention basins;
and
WHEREAS, the Plan Commission of the Village of Mount Prospect,
Cook County, Illinois, has reviewed the proposed modifications to
Chapter 16, Development Code, of the Village Code of Mount
Prospect for property commonly known as the Northeast corner of
Algonquin and Busse Roads, legally described as follows:

and
WHEREAS, the Plan Commission has forwarded its recommendations
relative to modifications to Chapter 16, Development Code, to the
President and Board of Trustees, which recommendations have been
considered at a regular meeting of the President and Board of
Trustees; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined the best interests of the Village
of Mount Prospect will be attained by the adoption of the
recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That modifications from Chapter 16 entitled
"Development Code" of the Village Code of Mount Prospect are
hereby granted, for the property being the subject of this
Ordinance, as to Section 16.405.F is hereby modified to permit a
detention basin on the east property line with a 4:1 side slope
ratio rather than 6:1 required by Code and located forty-five
feet (45') from a structure rather than the seventy-five feet
(75') required.
SECTION TWO: Except for the changes stated herein all other
codes of the Village of Mount Prospect shall apply to the Subject
Property in their entirety.
SECTION THREE: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form as provided by law.

That part of the Northeast 1/4 of Section 22 together with that
part of the Northwest 1/4 of Section 23, Township 41 North, Range
11 East of the 3rd Principal Meridian bounded by a line described
as follows: Beginning at a point on the line between said
Sections 22 and 23, 50.01 feet South of the Northeast corner of
said Section 22 and the Northwest corner of said Section 23, said
point being on the South line of Dempster Street, said South line
being a line 50.0 feet South, measured at right angles, and
parallel with the North line of said Section 23; thence
Southwesterly along a straight line, 65.30 feet to a point
normally distant 50.0 feet West of the East line of the Northeast
1/4 of Section 22; thence Southeasterly along a straight line a
distance of 351.98 feet to a point on the East line of the
Northeast 1/4 of Section 22, normally distant 88.0 feet
Northeasterly of the center line of Algonquin Road as per
Document No. 11195786; thence Southeasterly along a straight line
a distance of 70.0 feet to a point normally distance 60.0 feet
Northeasterly of the said center line of Algonquin Road; thence
Southeasterly parallel with and 60.0 feet Northeasterly of said
center line, a distance of 50.0 feet; thence Southeasterly along
a straight line a distance of 240.02 feet, more or less, to a
point on the Northerly line of Algonquin Road, distant 334.84
feet Southeasterly of (measured along said Northerly line) the
West line of the Northwest 1/4 of said Section 23; thence
Southeasterly along the Northerly line of Algonquin Road, as
aforesaid, 203.41 feet to an intersection with the East line of
the West 478.50 feet, as measured along the North line thereof,
of the Northwest 1/4 of said Section 23; thence North along said
East line, 688.75 feet to a point on the South line of Dempster
Street, aforesaid; thence West along the South line of said
street, 478.50 feet to the place of beginning, in Cook County,
Illinois.
