ORDINANCE NO. 3852
AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1818 AZTEC LANE
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Anthony and Annette Sacco have filed an application for
variation with respect to Droperty commonly known as 1818 Aztec
Lane in the Village of Mount Prospect, Illinois (hereinafter
referred to as the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot One Hundred Seventy-Eight (178) in Brickman
Manor Addition Unit No. Two, being a Subdivision in
the Southwest Quarter (1/4) of Section 24,
Township 42 North, Range 11, East of the Third
Principal Meridian, according to Plat registered in
the Office of the Registrar of Titles of Cook
County, Illinois on February 19, 1965, as Document
Number 2196193;
and
WHEREAS, Petitioners seek a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a driveway to be built on
the Subject Property with a width of twenty seven feet (27'),
within a zoning district otherwise requiring a maximum width of
eighteen feet (18') pursuant to Section 14.116.C of Article I of
Chapter 14 and a parking pad nine feet (9') in width and
twenty-one feet (21') in length adjacent to the attached garage
and located in a part of the required front yard as set forth in
Section 14.1102, resulting in a six foot (6') front yard; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 62-V-87) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 10th day of
September, 1987, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 26th day of August,
1987; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.116.C of Article I
of Chapter 14 of the Village Code of Mount Prospect, Illinois, to
allow the construction of a driveway to be a total width of
twenty-seven feet (27') and a parking pad as stated above and in
accordance with the landscape and site plan attached hereto as
Exhibit "A" and hereby made a part hereof.

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: In accordance with the provisions of Section
14.604 this variation shall be null and void unless permits are
issued and construction begins within one (1) year of the passage
of this Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamDhlet
form in the manner provided by law.
