AN ORDINANCE PROPOSING TO ENLARGE THE BOUNDARIES
OF SPECIAL SERVICE AREA NO. 5 IN THE VILLAGE OF
MOUNT PROSPECT, ILLINOIS AND PROVIDING FOR
PUBLIC HEARING AND OTHER PROCEDURES IN CONNECTION THEREWITH
WHEREAS, pursuant to the provisions of Article VII, Section 6,
Paragraph 1, of the Constitution of the State of Illinois and
Sections 1301 through 1311 of Chapter 120 of the Illinois Revised
Statutes (1985), the Village of Mount Prospect did on
November 30, 1982 adopt Ordinance No. 3284 to establish Special
Service Area No. 5 for the purpose of providing the necessary
funding of the Village's portion of the cost of constructing and
installing the necessary water distribution mains and pumping
stations in order to transport and provide Lake Michigan water to
the territory contained within said Special Service Area, which
territory consisted of all the territory within the corporate
limits of the Village of Mount Prospect, except for that portion
thereof which is provided water service by Citizens Utilities
Company; and
WHEREAS, pursuant to said Ordinance No. 3284, the Village of
Mount Prospect did adopt a further Ordinance No. 3292 providing
for the issuance of unlimited ad valorem tax bonds in the amount
of $1,900,000 of the said Special Service Area No. 5 in order to
pay the cost of such water improvements and the levy of a direct
annual tax sufficient to pay the principal and interest on said
bonds, which Ordinance was adopted on December 7, 1982; and
WHEREAS, subsequent to the establishment of Special Service Area
No. 5, other territory, representing less than 5% of the assessed
valuation of the entire area within Special Service Area No. 5
and not contained within the water service area of Citizen
Utilities Company has been annexed to the Village of Mount
Prospect and will derive the benefits of the water improvements
provided in Special Service Area No. 5; and
WHEREAS, in order for this annexed territory to be added to and
to become a part of Special Service Area No. 5, it is necessary
for a public hearing to be held by the President and Board of
Trustees of the Village of Mount Prospect with respect to adding
such territory to Special Service Area No. 5 with notice of such
hearing to be published and to be mailed to the owners of the
territory proposed to be added to Special Service Area No. 5, in
accordance with the provisions of Sections 1305, 1306 and 1308 of
Chapter 120 of the Illinois Revised Statutes (1985).
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

the area described in Exhibit "A" attached hereto and hereby
made a part hereof.
Said area is contained within the boundaries of the Village
of Mount Prospect and consists of various properties all of
which are contiguous to the boundaries of Special Service
Area No. 5.
Said area will benefit especially from the municipal services
to be provided by Special Service Area No. 5 and will be
subject to all taxes levied therein after such area becomes a
part of Special Service Area No. 5, and said area shall

further become additional security for bonded indebtedness
outstanding at the time that it is added to and becomes a
part of Special Service Area No. 5.
SECTION TWO: A public hearing shall be held on_A~o,7~r 4, 1987
at 7:30 P.M. in the Senior Center Building, 50 S. Emerson Street,
Mount Prospect, Illinois, to consider the enlargement of the
boundaries of Special Service Area No. 5 by the addition of the
area described in the attached Exhibit "A".
SECTION THREE: Notice of Hearing shall be published at least once
not less than 15 (fifteen) days prior to the public hearing in
the Mount Prospect Herald, a newspaper in general circulation
within the Village of Mount Prospect. In addition, Notice by
mailing shall be given by depositing said Notice in the U.S.Mail,
addressed to the person or persons in whose name the general
taxes for the last preceding year were paid on each lot, block,
tract or parcel of land lying within the area proposed to be
added to the boundaries of Special Service Area No. 5. Said
Notice shall be mailed not less than ten (10) days prior to the
time set for the public hearing. In the event taxes for the last
preceding year were not paid, the Notice shall be sent to the
person last listed on the tax rolls prior to that year as the
owner of said property. The Notice shall be in substantially

NOTICE IS HEREBY GIVEN that on the 4th day of Nove~er ,
1987 at the hour of 7:30 P.M.in the Meeting Room of the Senior
Center, 50 S. Emerson Street, Mount Prospect, Illinois, a hearing
will be held by the President and Board of Trustees of the
Village of Mount Prospect to consider enlarging the boundaries of
Special Service Area #5 by adding thereto the territory described
below, being territory which is presently within the corporate
limits of the Village of Mount Prospect, is contiguous to the
present boundaries of Special Service Area #5 and is not within
the water service area of Citizens Utilities Company. An
accurate map of Special Service Area No. 5 and of the territory
proposed to be added thereto is on file in the Office of the
Village Clerk and is available for public inspection.
Ail interested persons, including all owners of real estate
within Special Service Area No. 5 or within the territory
proposed to be added thereto, will be given an opportunity to be
heard at the hearing regarding the enlargement of the boundaries
of Special Service Area No. 5 by the addition of the described
territory, and objections may be filed regarding the enlargement
of the boundaries of said Special Service Area 95 as proposed.
The hearing may be adjourned by the Board to another date without

further notice upon a motion to be entered upon the minutes
fixing the time and place of its adjournment.
If a Petition signed by at least 51% of the electors residing
within Special Service Area No. 5 and by a least 51% of the
owners of record of the land included within the boundaries of
Special Service Area No. 5 is filed with the Village Clerk
within sixty (60) days following the final adjournment of the
public hearing, objecting t~ the proposed enlargement of the
boundaries of Special Service Area No. 5, no such enlargement of
the boundaries of Special Service Area No. 5 shall take place.
