AN ORDINANCE VACATING A CERTAIN KNOWN RIGHT-OF-WAY
COMMONLY KNOWN AS ELM STREET, BETWEEN NORTHWEST HIGHWAY AND
EVERGREEN AVENUE AND EVERGREEN AVENUE BETWEEN
ELM STREET AND MAPLE STREET
WHEREAS, the Plan Commission of the Village of Mount
Prospect did consider the vacation of certain Village-owned
right-of-way commonly known as Elm Street, between Northwest
Highway and Evergreen Avenue and Evergreen Avenue between Elm
Street and Maple Street and did forward their recommendation to
vacate the subject property to the President and Board of
Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees, pursuant to
proper legal notice, held a Public Hearing at their regular
meeting on March 1, 1988 for the purpose of considering the
vacation of Elm Street, between Northwest Highway and Evergreen
Avenue and Evergreen Avenue between Elm Street and Maple Street;
and
WHEREAS, the President and Board of Trustees of the Village
of Mount Prospect have determined that the vacation of Elm
Street, between Northwest Highway and Evergreen Avenue and
Evergreen Avenue between Elm Street and Maple Street would be in
the best interests of the residents of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the President and Board of Trustees find
and determ~'ne t~"~t it is in the best interest of the Village of
Mount Prospect to vacate Village-owned right-of-way commonly
known as Elm Street, between Northwest Highway and Evergreen
Avenue and Evergreen Avenue between Elm Street and Maple Street,
legally described as follows:
That portion of Elm Street located South of the Southerly
right-of-way of Evergreen Avenue and North of the Northerly
right-of-way of Northwest Highway together with that part of
Evergreen Avenue located West of the Westerly right-of-way
of Elm Street, and located adjacent to Lots 13, 14, and 15
in Block 11 in the aforesaid Busse and Wille's Resubdivision
and adjacent to Lots "A" and "B" in the resubdivision of
Lots 2 to 6 in the resubdivision of Block 10 of aforesaid
Busse and Wille's Resubdivision; all lying in the East 1/2
of the Northwest 1/4 of Section 12, Township 41 North Range
11 East of the Third Principal Meridian in the Village of
Mount Prospect, Cook County, Illinois.
SECTION TWO: That upon passage of this Ordinance and filing
of the plat of vacation, all improvements located within the said
right-of-way shall be removed and relocated into existing
.easements or other rights-of-way.
SECTION THREE: That upon passage and approval of this
Ordinance, the Village Clerk is hereby authorized and directed to
file a certified copy of this Ordinance, together with an
accurate map thereof, a copy of which is attached hereto, with
the Recorder of Deeds of Cook County, Illinois.
SECTION FOUR: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
in pamphlet form as provided by law.

south line of Evergreen Avenue at the east line of Elm Street and curving northwesterly on a radius of 66 feet
to a point of tangency with the west line of Elm Street at the north line of Evergreen Avenue; and that part
of Evergreen Avenue lyiqg South and West of the above described curved line and South of Lots 13, 14, and 15
of Block ll of Busss'a and Willie's.Reaubdtvision in Mount Prospect, according to the Plat thereof recorded
3/31/1906 as document N~. 3839591 and on 4/18/1906 as Torrens Document No. 3945; and lying East of the west
line of said Lot 13 eltended to the centerline of Evergreen 'Avenue and East of the the west line of Lot B in
Block "C" in the Resahdivision of Lots 2 thru 6 in the subdivision of Block 10 in Buase's and Wlllle's
Reaubdiviaion in Mount~ Prospect recorded on 3-16-1918 as Torrens Document No. 81952; extended North to the
said centerline of Evergreen Avenue; and North of the north line of Lots A and B in said Block "C": all in
Mount Prospect, Cook C~qnty, Illinois.
