AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1003 HEMLOCK AVE
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Alan and Cyndi Brown, have filed an application for
variation with respect to property commonly known as 1003 Hemlock
Avenue in the Village of Mount Prospect, Illinois (the "Subject
Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 469 in "Brickman Manor First Addition, Unit
Number four" being a subdivision in the South 1/2
of Section 26, Township 42 North, Range 11, East
of the Third Principal Meridian, in Cook County,
Illinois;
and
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 21 of the Village Code of Mount Prospect,
Illinois, to allow the construction of an above ground swimming
pool to be built on the Subject Property with a setback of ten
feet (10') from the rear property line and extending seven feet
(7') beyond the building line, with the Code otherwise requiring
a minimum setback of fifteen feet (15') from the rear property
line and NOT extending beyond the building line pursuant to
Section 21.921.B of Article IX of Chapter 21; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 84-V-87) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 17th day of
December, 1987, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 2nd day of
December, 1987; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
~further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation~
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 21.921.B of Article
XI of Chapter 21 of the Village Code of Mount Prospect, Illinois,
to allow the construction of an above ground swimming pool with a
setback of ten feet (10') from the rear property line and
extending seven feet (7') beyond the building line.
SECTION THREE: The pool shall be installed in accordance with
the site plan attached hereto and designated as Exhibit A,
further provided the pump/filter shall be relocated outside the
easement and shall conform to the variation setbacks provided
herein.

SECTION FOUR: No permit shall be issued until and unless the
safety requirements of the Village Code, being fifteen feet (15')
horizontal separation of pool and any electrical carrying
devices, shall be accomplished; incl~=-~ding but not limited to the
air conditioning unit, electrical service lines, and transmission
lines along the rear property line for any utility company..
SECTION FIVE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION SIX: In accordance with the provisions of Section
14.604 this variation shall be null and void unless permits are
issued and construction begins within one (1) year of the passage
of this Ordinance.
SECTION SEVEN: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
