AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 221 WEST PROSPECT AVENUE
WHEREAS, Carl D. Cucco, (hereinafter referred to as
Petitioner) has filed an application for variations from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, for property commonly known as 221 West Prospect Avenue
(hereinafter referred to as Subject Property), legally described on
Exhibits A attached hereto and hereby made a part hereof; and
WHEREAS, the Petitioner seeks variations from the following
provisions of Chapter 14, To Wit:
A variation to Section 14.1805.A to allow the existing
six (6) off-street parking spaces instead of the
normally required 21 parking spaces.

A variation to Section 14.1805.B to waive the
requirement of the off-street loading space where one
would be normally be required by Code.
A variation to Section 14.1802.A to allo~ an existing
two foot (2') front yard setback on South Elmhurst
Avenue instead of the normally required minimum front
yard of 20 feet (20').
A variation from Section 14.1802.B to allow an existing
south side interior yard setback of zero feet instead of
the normally required 10 feet (10').

A variation from Section 14.1802.C to allow an existinG
one foot rear yard setback instead of the normally
required 20 feet by Code.
WHEREAS, a public hearing was held on the variations
requested being the subject of ZBA Case No. 15-V-88 before the Zoning
Board of Appeals of the Village of Mount Prospect on the 24th
day of March, 1987, p~rsuant to due and proper notice thereof
published in the Mount Prospect Herald on the 7th day of March, 1988;
and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect and the President and Board
of Trustees of the Village have given further consideration to the
variations requested and have determined that the same satisfies the
standards set forth in Section 14.605 of Article VI Chapter 14 of
the Village Code and the Board of Trustees further find that it would
be in the best interest of the Village to grant the variations as
specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as flndlngs of fact by the President and Board of
Trustees of the Village of Mount Prospect.

SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variations requested with respect to Chapter 14 as follows:
Section 14.1805.A
To allow the existing six off-street parking spaces instead

SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and Regulations shall
remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance w~th the provisions of
Section 14.604 the variations being the subject of th~s Ordinance
shall be null and void unless permits are issued and construction
begins within one (1) year of the passage of this Ordinance for any
portion of the property.
SECTION FIVE: This Ordinance shall be in full force and
effect from and after its passage, approval and publication In
pamphlet form ~n the manner provided by law.
