AN ORDINANCE AMENDING THE ZONING MAP WITH
RESPECT TO THE ZONING OF CERTAIN PROPERTY
FROM R-3 TO B-2 IN THE
VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Carl Cucco,M.D. has filed an application to rezone
certain portions of property hereinafter described from a R-3
Business District to a B-2 District as provided in Article XXII
of Chapter 14 of the Village Code of Mount Prospect, Illinois;
and
WHEREAS, the property is commonly known as 221 W. Prospect Avenue
in the Village of Mount Prospect, Illinois (the "Sub3ect
Property"); and is legally described as follows:
Lots 43, 44 and 45 in H. Roy Berry Company's Colonial
Manor, being a subdlvlslon of part of the Northwest 1/4
Section 11, and part of the Northwest 1/4 of Section 12
all in Township 41 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois.

WHEREAS, said rezoning request is for the purpose of legalizing
an existing medical/professional office building; and
WHEREAS, a public hearing was held on the variation request
(designated as ~ase No. ZBA 14-Z-88) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 24th day of March
1988, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 7th day of March 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested rezonlng; and
WHEREAS, this Board has considered the flndlngs and
recommendations of the Zoning Board of Appeals and does hereby
determine it to be in the best interests of the Village to grant
the requested rezoning.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The official zoning map pertaining to Chapter 14
entitled "Zoning" of the Village Code of Mount Prospect,
Illionls, as amended, is hereby further amended by reclassifying
certain portions of the R-3 District to a B-2 District, which is
legally described as above.
SECTION THREE: Except for the changes stated here~n all other
codes of the Village of Mount Prospect shall apply to the Subject
Property in their entirety.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
