AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1000 E. ARDYCE LANE.
IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS
WHEREAS, Anthony or Michael Oliveto has filed an application
variation with respect to property commonly know as 1000 E.
Ardyce Lane in the Village of Mount Prospect, Illinois (the"
Subject Property")
and
WHEREAS, the Subject Property is described as follows:
for
Lot 40 in WESTGATE GARDEN SUBDIVISION, being a subdivision of
part of the Northeast 1/4 of the Southwest 1/4 of Section 35,
Township 42 North Range 11 East of the Third Principal Meridian
~n Cook County Illinois.
and
WHEREAS, Petitioner is seeking a variation from Chapter 14,
Section 14.1303 to allow a .41 floor area ratio (F.A.R.) instead
of the normally allowed .35 FAR in order to build a room addition
of 630 feet.
and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 17-V-88) before the Zoning Board
Appeals of the Village of Mount Prospect on the 24th day of
March, 1988, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 7th day of
March, 1988; and
of
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.1003 of
Chapter 14 of the Village Code of Mount Prospect, Illinois, to
allow a floor area ratio (F.A.R.) of .41 in order to build a room
addition of 630 square feet. The variation is granted on the
condition that no additional structure be built on the property.

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: In accordance with the provisions of Section
14.604 this variation shall be null and void unless permits are
~ssued and construction begins within one (1) year of the passage
of this Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
