AN ORDINANCE GRANTING A SPECIAL USE FOR THE
PROPERTY COMMONLY KNOWN AS LEXINGTON HOMES
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Lexington Homes has filed a petition for a special use
with respect to the property commonly known as Old Orchard, in the
Village of Mount Prospect, Illinois (the "Subject Property"); and
WHEREAS, the Sub3ect Property is legally described as follows:
Ail that part of Lot 1 in Old Orchard Country Club
Subdivision being a Subdivision of part of the
Northwest 1/4 of Section 27 and part of the East
1/2 of the Northeast 1/4 of Section 28, both in
Township 42 North, Range 11, East of the Third
Principal Meridian, according to the Plat thereof
recorded as Document No. 21895678, lying Northwest
of a line drawn perpendicular to the Southwesterly
line of Lot 1 and passing through a point 409.96
feet Northwest of the Southeast corner of Lot 1 all
in Cook County, Illinois;
and
WHEREAS, Petitioner seeks a special use for a P.U.D. to allow
development of a 332 unit Arbor Home Condominium project in
accordance with Section 14.704 of Article VII of Chapter 14 of the
V~llage Code of Mount Prospect, Illinois; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 1-SU-88) before the Zoning Board of
Appeals in the V~llage of Mount Prospect on the 7th day of
January, 1988, and again on the 4th day of February, 1988,
pursuant to due and proper notice thereof published ~n the Mount
Prospect Herald on the 16th day of December, 1987; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations in favor of the proposed special use subject
to certain conditions to the President and Board of Trustees of
the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees have given further
consideration to the sa~d request and have determined that the
same meets the standards set forth in Section 14.704 of Article
VII pertaining to special use of sa~ Chapter 14 of the V~llage
Code and have further determined that the granting of the proposed
special use would be in the best interest of the public, provided-
the same are accomplished pursuant to the conditions hereinafter
set forth.
NOW THEREFORE, BE IT ORDAINED B~ THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the V~llage of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a special
use'Planned Unit Development; said Special Use to be developed in

substantial conformity with the following exhibits:
I - Site Plan
II - Engineering Plan
III - Landscape Plan
IV - Conceptual Architectual Design Plan
V - Temporary Model Plan
VI - Sign Plan
VII - Seperation Specification
and other Exhibits submitted by the Petitioner copies of which are
attached hereto and hereby made a part hereof as Exhibit "A", and
further, that sa~d Special Use be in accordance with the
conditions hereinafter provided.
SECTION THREE: The subject ~pecial Use shall be granted upon
the following condition:

That the 1972 Consent Decree, (including Exhibits I-VII)
as amended and as Hereby further amended, a copy of which
is attached hereto and is made a part hereof as Exhibit
"A" shall govern the Development of the Subject Property;
however, where the Consent Decree, as amended, and as
further amended, and attached exhibits are s~lent, the
Ordinances of the Village of Mount Prospect shall apply
and control.
SECTION FOUR: W~th the exception of the special use g~anted
herein, the Subject Property shall comply with all other
applicable Village of Mount Prospect Ordinances and Regulations
pertaining thereto.
SECTION FIVE: Th~s Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form ~n the manner provided by law.
PASSED and APPROVED this 15th day of March ,1988.
