AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1005 CYPRESS DR
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Frank Gerardi, has filed an application for variation
with respect to property commonly known as 1005 Cypress Drive in
the Village of Mount Prospect, Illinois (the "Subject Property");
and
WHEREAS, the Subject Property is described as follows:
Lot 60 in Windsor Estates being a Subdivision part
of the West 1/2 of Sectin 14, Township 41 North,
Range 11, East of the Third Principal Meridian in
Cook County, Illinois;
and
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a twenty-seven and
one-half foot (27 1/2') wide driveway to be built on the Sub]ect
Property, within a zoning district otherwise allowing an eighteen
foot (18') wide driveway pursuant to Section 14.116.C of Article
I of Chapter 14 and a Zero foot (0') front yard setback instead
of the required thirty foot (30') setback to allow parking in the
front yard pursuant to Section 14.1102.A of Article XI of Chapter
14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 3-V-88) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 28th day of
Jaunary, 1988, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 11th day of
January, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.116.C of Article I
and Section 14.1102.A of Artllce XI of Chapter 14 of the Village
Code of Mount Prospect, Illinois, to allow the construction of a
twenty-seven and one-half foot (27 1/2') wide driveway instead of
the permitted eighteen feet (18') and parking pad setback Zero
feet (0') from the front property line instead of thirty feet
(30') in accordance with Exhibit "A" attached hereto and hereby
made a.part hereof, sub3ect to the tapering of the drive from
twenty-seven and one half feet (27.5') at the walk to twenty-one
feet (21') wide at the curb; resurfacing of the entire drive
and installation of landscaping along the North property line.

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: In accordance with the provisions of Section
14.604 this variation shall be null and void unless permits are
issued and construction begins within one (1) year of the passage
of this Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
