AN ORDINANCE AMENDING CHAPTER 13
ENTITLFD, "ALCOHOLIC LIQUOR DEALERS" OF 'tHE
VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS
TO ADD THE CLASS "Z"__LICENSE CLASSIFICATION
WHEREAS, pursuant to the provisior~s of Ordinance No. 3814,
establishing the Class "Z" License Classification said Class "Z"
L,cense Classification was to
on May 1, 1988; and
WHEREAS, on April 28,
expire at twelve o'clock (12:00) a.m.
1988, the Appellate Court of
Illinois, First Judicial District, Fourth Division, entered an
order, over the Village's objection, allowing the Snuggery Pub, Inc.
(the then l~cense of the Village's sole Class "Z" License) to
continue operating its business until four o'clock a.m. pending
appeal; and
WHEREAS, the effect of the April 28th court order is to
continue the Class "Z" l=cense classification pending appeal of Case
NO. 87-2163 nothwithstanding the provlslons of Ordinance 3814; and
WHEREAS, the Village is compelled to act in a manner
consistent w~th the Appellate Court's Order;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
AS FOLLOWS:

SECTION ONE: Chapter 13 entitled "Alcoholic Lzguor
of the Village Code of Mount Prospect, Illinois (1981)
is hereby further amended as follows:

A. By amending Sectzon 13.106 entxtled, "L~censes and
Permits" of said Chapter 13 to change subsection A.1
thereof by addlng a Class "Z" license classification, to be
placed in alphabetical order within said subsection to read
as follows:
"CLASS "Z" license, for issuance to restaurants
maintaining a separate lounge area as an incidental
and accessory use, which shall authorize the licensee
to sell and offer for sale at retail, in the
restaurant portion of the premises specified ~n such
license, alcoholic liquor for consumption on sa~d
premises only w~th meals, and in the lounge portion
of the premises specified in such license, alcoholic
liquor for consumption on said premises, with or
w~thout the service of food. The premises licensed
herein shall be primarily devoted to the preparation,
cooking and serving of meals and the lounge area shall
contain less than 40% of the floor area of the
premises and shall not b~ divided ~nto three or more
locations w~thin said premises. Full food service,
including dinner and/or luncheon menus, shall be
offered st all times while alcoholic liquor is served."
B. BI' amunding Section 13.106 entitled, "Ltcen.'.'es and Permits"
of said Chapter 12 to chapqc subsection A.t thereof to read:
"]. Each ~uch licensee shall pay an annual fee
such license in the amounL set forth below:
Class A $2,500,00
Class B $2,000,00
Class C $2,000,00
Class P $ 750,00
Class E $2,000,00
Class F $2,000,00
Class G $ 750,00

C. By amending Sectzon 13.107 entitled, "Licenses and Ps,mits'°
of satd Chapter 13 to chan~e subsection A.2 hereof to read:
"Section 13,107. Number of Licenses:
Four (4) Class A Licenses
Two (2) Class S Lzcenses
Nine (9) Class C Licenses
Two (2) Class P Licenses
Two (2) Class E Licenses
One (1) Class F Licenses
One (1) Class G Licenses
One (1) Class H Licenses
One (1) Class M Licenses
One (1) Class P Licenses
Sixteen (16) Class R Lzcenses
Fifteen (15) Class S Licenses
One (1) Class V Licenses
Seven (7) Class W Licenses
One (1) Class Z License"
D. By amending Section 13.115 entitled 'Closxng Hours;
Closing" of saxd Chapter 13 to read:

It shall be unlawful for licensees holding a
Class Z liquor license created under the terms of
this Chapter to sell or offer for sale any
alcoholic liquor at retail in the Village or to
permit any person to consume any alcoholic liquor
ill or on any premises for which a license
providing for consumption on the premises has
been issued pursuant to this Chapter 13 between
four o'clock' (4:00) A.M. and eleven o'clock
(11:00)-A.M. on Monday through Sunday, inclusive,
pending further order of the Appellate Court of
Illinois in Case NO. 87-2163.
~ECTION TWO: The Class "Z" license classification
is created pursuant to the requirements of Chapter 24,
7-1-44 of the 111inols Revised Statutes, as amended.

SECTION THREE: That this Ordinance shall be in full force and
effect from and ~fter its passage, apDroval and publication in the
manner provided by law.
