AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 1431 BONITA AVENUE
WHEREAS, William and Meagan Cotten (hereinafter referred to
as Petitioners) have filed an application for variations from the
following provisions of Chapter 14 of the Village Code of Mount
Prospect, Illinois, for property commonly known as 1431 Bonita
Avenue (hereinafter referred to as Subject Property), legally
described as follows:
Lot 6 in Kathcon Subdivision, being a resubdivlslon of part of
Lot "K" in Kirehoff Subdivision of the Northwest Quarter of
the Northwest Quarter and the North 10 Chains of the Southwest
Quarter of the Northwest Quarter of Section 11, Township 41
North, Range 11 East of the Third Principal Meridian,
according to the plat thereof recorded July 20, 1987 as
Document No. 87400753, in Cook County, Illinois
and
WHEREAS, the Petitioner seeks variations from the following
provisions of Chapter 14:
Section 14.116.A - to allow a circular driveway;
Section 14.116.C
to allow a maximum driveway width of
30 feet at the garage, tapering to 21 feet
at the property line;
Section 14.102.B.2 -
Section 14.1102.A -
to allow a maximum garage size of 643
square feet for a 3 car garage;
to allow a 20 foot front yard; and
Section 14.1102.A - to allow 46% lmpervious lot surface
coverage in the front yard.
and
WHEREAS, a public hearing was held on the variations requested
being the subject of ZBA Case No. 19-V-88 before the Zonlng Board
of Appeals of the Village of Mount Prospect on the 21st day of
April, 1988,, pursuant to due and proper notice thereof published
in the Mount Prospect Herald on the 5th day of April, 1988; and
WHEREAS, the Zoning Board of ADpeals has submitted its
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect and the President and
Board of Trustees of the Village have given further consideration
to the variations requested and have determined that the same
satisfies the standards set forth in Section 14.605 of Artlcle VI
of Chapter 14 of the Village Code and the Board of Trustees further
find that it would be in the best interest of the Village to grant
the variations as specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recltals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.

SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variations, as modified and amended by the Petitioner, as follows:
1. Section 14.116.A to allow a circular driveway;
2. Section 14.116.C to allow a maximum driveway width of 30
feet at the garage tapering to 21 feet at the lot line;
3. Section 14.102.B.2 to allow a maximum garage size of 643
sqaure feet for a three car garage;
4. Section 14.1102.A to allow a 20 foot front yard; and
5. Section 14.1102.A to allow a 37% impervious lot surface
coverage in the front yard.
SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
ProDerty.
SECTION FOUR: In accordance with the Drovisions of
Section 14.604 the variations being the subject of this Ordinance
shall be null and void unless permits are issued and construction
begins within one (1) year of the passage of this Ordinance for any
portion of the property.
SECTION FIVE: This Ordinance shall be
