AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
LOCATED WITHIN THE KATHCON SUBDIVISION
WHEREAS, Gregory Miller (hereinafter referred to as
Petitioner) has f~led an application for variations from the
provls~ons of Chapter 14 of the Village Code of Mount Prospect,
Illinois,as set forth hereinbelow, for properties commonly known
as 1451, 1447, 1443, 1439, 1435, 1427, 1423 and 1419 Bonita Avenue
(hereinafter referred to as Subject Properties), legally described
as follows:
Lots 1, 2, 3, 4, 5, 7, 8 and 9 in Kathcon Subdivision, being a
resubdivis~on of part of Lot "K" in Kirchoff Subdivision of
the Northwest Quarter of the Northwest Quarter and the North
10 Chains of the Southwest Quarter of the Northwest Quarter of
Section 11, Township 41 North, Range 11 East of the Third
Principal Meridlan, according to the plat thereof recorded
July 20, 1987 as Document No. 87400753, in Cook County,
Illinois
and
WHEREAS, the Petitioner seeks variations from Section 14.116.A
to allow construction of circular driveways on the Subject
Properties, from Section 14.116.C to allow driveway widths of 30
feet tapering to 21 feet at the property lines and from Section
14.102.B.2 to allow the construction of three car garages not to
exceed 650 square feet in size; and
WHEREAS, a public hearing was held on the variations requested
being the sub3ect of ZBA Case No. 20-V-88 before the Zoning Board
of Appeals of the V~llage of Mount Prospect on the 21st day of
April, 1988, pursuant to due and proper notice thereof published
in the Mount Prospect Herald on the 5th day of April, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted 1ts
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect and the President and
Board of Trustees of the Village have given further consideration
to the variations requested and have determined that the same
satisfies the standards set forth in Section 14.605 of Article VI
of Chapter 14 of the Village Code and the Board of Trustees further
find that it would be ~n the best ~nterest of the Village to grant
the variations as specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the V~llage of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Properties

the variations, as modified and amended by the Petitioner, from
Section 14.102.B.2 to allow a three car garage not to exceed 650
square feet and from Section 14.116.C to allow driveway widths of
thirty feet (30') tapering to twenty-one feet (21') at the property
lines on each lot being the sub3ect of this Ordinance.
SECTION THREE: Except for the variations granted here~n, all
other apDllcable V~llage of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
ProDerty.
SECTION FOUR: In accordance with the provisions of Section 14.604 t
variations being the subject of this Ordinance shall be null and vold
unless permits are issued and construction begins within one (1) year of
the passage of this Ordinance for any portion of the property.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after ~ts passage, approval and publication in pamphlet form
the manner provided by law.
