AN ORDINANCE AMENDING ORDINANCE NO. 3364
GRANTING A SPECIAL USE FOR PROPERTY COMMONLY
KNOWN AS 1020 EAST RAND ROAD
WHEREAS, the Shell Oll Company, (hereinafter referred to as
Petitioner) has filed an application for an amendment to Ordinance
No. 3364 which Ordinance granted a special use to expand the existing
commercial premises commonly known as 1020 East Rand Road (hereinafter
referred to as Sub3ect Property), the legal description of the Sub3ect
Property is attached hereto and hereby made a part hereof as Exhibit
"A"; and
WHEREAS, the Petitioner seeks an amendment to permit the
enclosure of the existing portico on the north side of the building
resulting in an additional 258 square feet to this structure; and
WHEREAS, public hearings were held on the request being the
sub3ect of ZBA Case No. 13-SU-88 before the Zoning Board of Appeals of
the Village of Mount Prospect on the 25th day of February, 1988 and
April 28, 1988 pursuant to due and proper notice thereof published in
the Mount Prospect Herald on the 8th day of February, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect and the President and Board
of Trustees of the Village have given further consideration to request
and have determined that the same satisfies the standards set forth
in Section 14.704 of Article VII of Chapter 14 of the Village Code and
the Board of Trustees further find that it would be in the best
interest of the Village to grant the request specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees of
the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby amend Ordinance No. 3364 thereby granting to
the Subject Property the special use requested herein to permit the
enclosure of an existing portico area on the north side of the
building, resulting in an increased floor space of an additional 258
square feet, as Indicated on the site plan attached hereto and hereby
made a part hereof as Exhibit "B". The amendment granted herein shall
be conditioned upon the owner installing landscaping on the northwest
corner of the property as previously agreed prior to permits being
issued.
SECTION THREE: Except for the amendment to Ordinance No. 3364 in
the form of a special use as granted herein, all other applicable
Village of Mount Prospect Ordinances and Regulations shall remain in
full force and effect as to the Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after 1ts passage, approval and publication in pamphlet form
in the manner provided by law.
