AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1402 SAUK LANE
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Pamela C. Tobie, has filed an application for variation
with respect to property commonly known as 1402 Sauk Lane in the
Village of Mount Prospect, Illinois (the "Subject Property"); and
WHEREAS, the Subject Property is legally described as follows:
Lot 106 in Woodvlew Manor Unit No. 1, being Subdivision in
the North 1/2 of the Northeast 1/4 of Section 25, Township
42 North, Range 11, East of the Third Principal Meridian in
Cook County, Illinois;
and
WHEREAS, Petitioner seeks a variation from Section 14.102.B.2 to
allow an accessory structure on the Subject Property to be
located one and one-half feet (1' 6") from the side property
line and a variation from Section 14.102.B.1 to permit a
separation of slx inches (6") between an accessory building and
the principal structure within a zoning district otherwise
requiring at least ten feet (10') from a principal structure and
a setback of five feet (5') from an interior lot line pursuant to
Section 14.102 of Article I of Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 23-V-88) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 28th day of
April, 1988, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the llth day of
April, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to deny the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.606 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the variations requested.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth herelnabove are
Incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variations requested with respect to Section 14.102.B.1 of
Article I of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow an accessory structure to be located slx
inches (6") from the principal structure and a interior lot line
setback of one and one-half foot (1' 6") from the lot line in
accordance with the slte plan attached hereto and hereby made a
part hereof as Exhibit "A", provided that all other requirements

of the Inspection Services Department regarding fire safety and
storage of materials within said shed shall be strictly
prohibited.
SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect
~rom and after its passage, approval and publication in pamphlet
form in the manner provided by law.
