AN ORDINANCE ~MENDING THE ZONING MAP WITH
RESPECT TO THE ZONING OF CERTAIN PROPERTY IN
A R-X SINGLE-FAMILY RESIDENCE DISTRICT
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Home by Hemphill has filed an application to rezone
certain portions of property hereinafter described from the R-l,
R-2 Residence D~strict, and a B-3 Bus~ness District to an R-3
Residence D~strict as provided in Article XXII of Chapter 14 of
the Village Code of Mount Prospect, Illinois; and
WHEREAS, the property is commonly known as Northwest Hwy at Elm
Street ~n the Village of Mount Prospect, Illinois (the "Subject
Property"); and is legally described as follows:
Attached Exhabit "A";
and
WHEREAS, said rezoning request as for the purpose of developing
a townhome project under the Village Tax Increment F~nancang
Program.
WHEREAS, a public hearing was held on the variation request
(desagnated as Case No. ZBA 4-Z-88) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 21st day of
January, 1988, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 30th day of
December, 1987; and
,WHEREAS, the Zoning Board of Appeals has submitted its findangs
and recommendations to the Presadent and Board of Trustees of the
Village of Mount Prospect to allow the requested rezoning; and
WHEREAS, this Board has considered the findings and
recommendations of the Zoning Board of Appeals and does hereby
determine it to be in the best interests of the Village to grant
the requested rezoning.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as flndings of fact by the President and
Board of Trustees of the Vallage of Mount Prospect.
SECTION TWO: The official zoning map pertaining to Chapter 14
entitled "Zoning" of the Vallage Code of Mount Prospect,
Illinois, as amended, is hereby further amended by reclassifying
certain portions of the R-l, R-2, and B-3 Distracts to an R-3
Residence Distract, which is legally described as above.
SECTION THREE: This rezoning shall be conditioned upon the
redevelopment of the parcel an accordance w~th the limitations
set forth in the redevelopment agreement executed by the Village
of Mount Prospect and Home by Hemphill on February 2, 1988.
SECTION FOUR: This rezoning shall be conditioned upon the
redevelopment of the parcel in accordance with the Exhabits
presented at the Zoning Board of Appeals hearings on January 21,
1988.

SECTION FIVE: This rezonlng shall be conditioned upon the
submission and approval of F~nal Engineering plans and final
landscape planting plans satisfactory to the Village staff.
SECTION SIX: Except for the changes stated herein all other
codes of the V~llage of Mount Prospect shall apply to the Subject
Property ~n their entirety.
SECTION SEVEN: This Ordinance shall be ~n full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.

line extended to the centerline of-Evergreen Avenue; thence west
along said centerl[ne of Evergreen Avenue to the extension of the
east line of Lot C in the Resubdivision of Lots 2 through 6 in
the subdivision of Block 10 in said Busse and Wille's Resub-
division in Mount Prospect according to the plat thereof recorded
3/16/1918 as Torrens Doc. 81952; thence south along said east
line extended and east line of said Lot "C" to the east-
southeasterly corner of said Lot "C"; thence southwest along the
