;~N ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY
KNOWN AS 201 SOUTH MAIN STREET,MOUNT PROSPECT, ILLINOIS
WHEREAS, WHITE HEN PANTRY, has filed an application for
variations from specified sections of Chapter 14 (Zoning) of the
Village of Mount Prospect for property commonly known as 201
South Main Street (hereinafter referred to as Sub3ect Property);
and
WHEREAS, the Subject Prqperty is legally described as follows:
Lot 3 in Block 1 in Meier's Addition to Mount Prospect
in the Northwest Quarter of Section 12, Township 41
North, Range 11, East of the Third Principal Merldian in
Cook County, Illinois;
and
WHEREAS, Petitioner seeks variations as follows:
Section 14.2102.C to allow a zero foot (0') rear yard
~nstead of the twenty feet (20') required;
section 14.2102.E to allow a zero foot (0') parking
lot setback along the east property line instead of the
required ten feet (10'); and to allow a zero foot (0')
parking lot setback along Main Street and a twenty-
three foot (23') parking lot setback along Prospect
Avenue instead of the required thirty feet (30').
WHEREAS, a public hearing was held on the variations requested
(designated as ZBA Case No. 55-V-88) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 8th day of
August, 1988, pursuant to due and proper legal notice thereof
published in the Mount Prospect Herald on the 25th day of June,
1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village of Mount Prospect have further considered the
variation reHuested and find that it would be in the best
interest of the V~llage to grant the variation reHuested.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are ~ncorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the V~llage
of Mount Prospect hereby grant to the Subject Property the
following variations:
Section 14.2102.C to allow a zero foot (0') rear yard
instead of the twenty feet (20') required;
Section 14.2102.E to allow a zero foot (0') parking
lot setback along the east property lzne instead of the
required ten feet (10'); and to allow a zero foot (0')
parking lot setback along Main Street and a twenty-
three foot (23') parking lot setback along Prospect
Avenue instead of the required thirty feet (30').

SECTION THREE: The variations granted in SECTION TWO herelnabove
are granted subject to:
Petitioner shall participate in the V~llage's shared-
cost program in order to ~nstall brick pavers along
Main Street.
The design of the building elevation shall
architecturally compatible with other storefronts in
the Central Business District, as approved by the'
Department of Planning and Zoning.
The Landscape Plan shall be submitted for the approval
of the Department of Planning and Zoning.
The Petitioner shall grant an easement along the east
property line for underground util~ties.
SECTION FOUR: That, except for the variations granted herein,
all other applicable Village of Mount Prospect Ordinances and
regulations shall remain in full force and effect as to the
Subject Property.
SECTION FIVE: In accordance w~th the provisions of Section
14.604 of Chapter 14 of the V~llage Code, the variations granted
here~n shall be null and void unless permits are issued and
construction begins within a one (1) year period from the date of
passage of th~s Ordinance·
SECTION SIX: That th~s Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provlded by law.
