AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY
COMMONLY KNOWN AS 415 WEST CAMP MC DONALD ROAD
AND INCORPORATED INTO THE LEXINGTON HOME DEVELOPMENT
WHEREAS, Lexington Development Corporation (hereinafter referred
to as Petitioner) has filed a petition for a Special Use with
respect to property commonly known as 415 West Camp McDonald Road
(hereinafter referred to as the subject Property); and
WHEREAS, the Subject Property is legally described as follows:
The North 300 feet of the West 160.00 feet of the East
910.00 feet of the East 1/2 of the Northeast 1/4 of
Section 28, ToWnship 42 North, Range 11, East of the
Third Principal Meridian in Cook County, Illinois;
and
WHEREAS, Petitioner seeks a speclal Use for the Subject Property
and to incorporate same into the Planned Unit Development
previously granted to the Lexington Development Corporatlon,
being the subject of Ordinance No. 3910 adopted by the President
and Board of Trustees of the v~llage of Mount Prospect on March
15, 1988, which inclusion would increase the acreage of the
previously approved Planned unit Development and would also
increase the permitted number of arbor homes from 332 to 344
units; and
WHEREAS, a public hearing was held on the request for special Use
(designated as ZBA Case No. 53-SU-88) before the Zoning Board of
Appeals of the village of Mount Prospect on the 25th day of
August, 1988, pursuant to proper legal notice having been
published in the Mount Prospect Herald on the 8th day of August,
1988; and
WHEREAS, the Zoning Board of Appeals has submitted ~ts findings
and recommendations in favor of the proposed Special Use to the
President and Board of Trustees; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have given further consideration to the requests
herein and have determined that the same meets the standards of
the Village and that the grantlng of the proposed Special Use
would be ~n the best interest of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are
incorporated as findings of fact by the President and Board of
Trustees of the V~llage of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the village
of Mount Prospect do hereby grant to the subject Property a
Special Use ~n the nature of a Planned Unit Development.
SECTION THREE: That Ordinance No. 3910 is hereby amended to
include the sub3ect Property in the development being the subject
of Ordinance No. 3910 and do authorize all exhibits made a part
of Ordinance No. 3910 to be amended thereby reflecting the
additional acreage and increasing the number of units from 332
un,ts to 344 units. Nothing contained in this Ordinance shall

be deemed to increase the density or reduce the parking ratio
previously agreed to and incorporated in the Amendment to the
Consent Decree being the subject of Ordinance No. 3911.
SECTION FOUR: That the 1972 Consent Decree, as amended, being
the subject of Ordinance No. 3911, shall be amended to reflect
the Special Use granted herein.
SECTION FIVE: With the exception of the Special Use granted
hereln, the Subject Property shall comply with all other
applicable Vlllage of Mount Prospect Ordinances and regulations
perta~ning thereto.
SECTION SIX: This Ordinance shall be in full force and effect
from and after its passage, approval and publication ~n pamphlet
form ~n the manner provided by law.
