AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY
KNOWN AS 400 WEST CENTRAL ROAD IN MOUNT PROSPECT, ILLINOIS
WHEREAS, JOHN LINCZMEIER (hereinafter referred to as Petitioner),
has filed an application for variations from specified sections
of Chapter 14 (Zoning) of the village of Mount Prospect for
property commonly known as 400 West Central Road (hereinafter
referred to as Subject Property); and
WHEREAS, the subject Property is legally described as follows:
Lot Four (4) and Lot Five (5) in block twnety-four (24)
· n Prospect Manor, being a subdivision of part of the
south three quarters (3/4) of the West Half (1/2) of the
West Half (1/2) of Section 34, Township 42 North, Range
11 East of the Third Principle Meridian as per plat
thereof recorded March 6, 1926 as document number
9199191; and
WHEREAS, Petitloner seeks variations from Section 14.2002.E to
allow a zero foot (0') setback from the Central Road right-of-
way instead of the required 30 feet; Section 14.3016.C to allow
the continuation of an existing driveway 16 feet wide; Section
14.3021 to permit a bumper stop instead of the required
permimeter curbing; Section 14.3012 to permit a loading space 12'
x 12' instead of the required 12' x 35'; and, Section 14.3012 to
allow 9 parking spaces lnstead of the required 12 parking spaces;
and
WHEREAS, a public hearing was held on the variation request
(designated as ZBA Case No. 54-V-88) before the Zoning Board of
Appeals of the Vlllage of Mount Prospect on the 25th day of
August, 1988, pursuant to due and proper legal notice thereof
published in the Mount Prospect Herald on the 8th day of August,
1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village of Mount Prospect have further considered the
variation requested and find that it would be ~n the best
interest of the Village to grant the variation requested.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are lncorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of · the V~llage
of Mount Prospect hereby grant to the Sub3ect Property the
following variations:
1. Section 14.2002.E to allow a zero foot (0') setback
from the Central Road right-of-way instead of the
required 30 feet;
2. Section 14.3016.C to allow the continuation of an
existing driveway 16 feet wide;
3. Section 14.3021 to permit a bumper stop instead of the
required permlmeter curbing;

4. Section 14.3012 to permit a loading space 12' x 12'
instead of the required 12' x 35'; and
Section 14.3012 to allow 9 parking spaces instead of
the required 12 parking spaces.
SECTION THREE: That the variations authorized by this Ordinance
are subject to the following condition:
That the Petitioner install landscaping at the base of
the existing free-standing sign. Said landscaping
plan to be approved by the Planning and Zoning
Department.
SECTION FOUR: That, except for the variations granted herein,
all other applicable Village of Mount Prospect Ordinances and
regulations shall remain in full force and effect as to the
Subject Property.
SECTION FIVE: In accordance with the provisions of Section
14.604 of Chapter 14 of the Village code, the variations granted
herein shall be null and void unless permits are issued and
construction begins within a one (1) year period from the date of
passage of this Ordinance.
SECTION SIX: That th~s Ordinance shall be ~n full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
