AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 321 N. RUSSEL STREET
WHEREAS, Lawrence James Hauser (hereinafter referred to as
Petitioner) has filed an application for a variation from Section
14.1102.B.1 of Chapter 14 of the Village Code of Mount Prospect,
Illinois, for property commonly known as 321 N. Russel Street
(hereinafter referred to as Sub3ect Property), legally described as
follows:
Lot 61 in H. Roy Berry Company's F~rst Addition to Castle
Heights, being a subdivision of the South 1/2 of the Southeast
1/4 of the Northwest 1/4 and the North 95.02 feet of the East
1/2 of the Southwest 1/4, all in Section 34, Townshlp 42
North, Range 11, East of the Third Princ~ap Meridian, in Cook
County, Illinois
and
WHEREAS, the Petitioner seeks a varlatlon from Section
14.1102.B which requires a side yard of 5-1/2 feet to permit a
2-1/2 foot side yard; and
WHEREAS, a public hearing was held on the variations requested
being th~ sub3ect of ZBA Case No. 46-V-88 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 28th day of
July, 1988,, pursuant to due and proper notice thereof published
· n the Mount Prospect Herald on the llth day of July, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect and the President and
Board of Trustees of the Village have given further consideration
to the variations requested and have determined that the same
satlsfies the standards set forth in Section 14.605 of Article VI
of Chapter 14 of the Village Code and the Board of Trustees further
f~nd that ~t would be in the best interest of the V~llage to grant
the variations as specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are
· ncorporated herein as f~ndings of fact by the President and Board
of Trustees of the V~llage of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property
variation from Section 14.1102.B to allow a side yard of 2-1/2
rather than the required 5-1/2 feet, for the purpose of
constructing a wood deck.

SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Sub3ect
Property.
SECTION FOUR: In accordance with the provisions of
Section 14.604 the variations being the sub3ect of thls Ordinance
shall be null and void unless permlts are issued and construction
begins within one (1) year of the passage of this Ordinance for any
portion of the property.
SECTION FIVE: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
