ORDINANCE NO. 3968 AN ORDINANCE CONCURRING WITH THE RECOMMENDATION OF THE ZONING BOARD OF APPEALS RELATIVE TO ~' PROPERTY COMMONLY KNOWN AS 902 - 918 WHITEGATE WHEREAS, owners of property being the subject of Zoning Board of Appeals Case No. 30-V-88 (hereinafter referred to as Petitioners) have filed an application for a variation from Section 21.601.C.2 of Chapter 21 of the Vlllage Code of Mount Prospect, Illinois, for property commonly known as 902 - 918 Whitegate Drive (hereinafter referred to as Subject Property), legally described as follows: Lots 1 through 9 in Town We Go Park,Inc. 4th Addition being a subdivision in the North Half of Section 11, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois and WHEREAS, the Petitioners seek a variation from Section 21.601.C.2 which limits the height of a fence abutting an arterial roadway to 6 feet to permit a fence 8 feet ~n height; and WHEREAS, a public hearing was held on the var~atlons requested being the subject of ZBA Case No. 30-V-88 before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of May, 1988, and the 9th day of June, 1988, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of May, 1988; and WHEREAS, the decision of the Zoning Board of Appeals is final in th~s ~nstance; and WHEREAS, an appeals from the decision of the Zoning Board of Appeals was filed with the Director of Planning and Zoning, which appeals requires consideration by the Village President and Board of Trustees; and WHEREAS, the V~llage President and Board of Trustees did consider the appeal to the decision of the Zoning Board of Appeals · n ZBA Case No. 30-V-88 and determined that it would be in the best ~nterests of the residents and Village to concur with the recommendation of the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Sub3ect Property a variation from Section 21.601.C.2 to allow a 6 foot high fence uniform in height established at the curb line of Central Road. In areas where the grade of the land requires additional height in order to maintain the uniform height of 6 feet, the Petitioners are permitted the additional height up to 8 feet. SECTION THREE: That after the construction of the fence authorized by this Ordinance, Petitioners shall furnish to the Director of Planning and Zoning an "as built" drawing of the fence demonstrating that no portion of the fence is taller than eight feet (8') nor higher than SlX feet (6') above the curb level of Central Road. age 2 of 2 ZBA 30-V-88 SECTION FOUR: Except for the variatlons granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication pamphlet form in the manner provided by law.
