AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 1618 DOGWOOD LANE
WHEREAS, Bernard J. McCudden (hereinafter referred to as
Petitioner) has filed an application for a variation from Section
21.902 of Chapter 21 and from Section 14.102.B.1 of Chapter 14 of
the Village Code of Mount Prospect, Illinois, for property commonly
known as 1618 Dogwood Lane (hereinafter referred to as Subject
Property), legally described as follows:
Lot 906 in Brickman Manor First Addition, Unit 8, being a
subdivision in the East 1/2 of the Southeast 1/4 of
Section 26, Township 42 North, Range 11 East of the Third
Principal Meridian, in Cook County, Illinois
and
WHEREAS, the Petitioner seeks a variation from Section
21.902 which requires a side yard of 7-1/2 feet to permit 4-1/2
feet from the s~de lot line and from Section 14.102.B.1 which
requires a 10 foot separation between an accessory building and
principal structure to permit a separation of 6 feet; and
WHEREAS, a public hearing was held on the variations requested
being the subject of ZBA Case No. 40-V-88 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 23rd day of
June, 1988,, pursuant to due and proper notice thereof published
in the Mount Prospect Herald on the 6th day of June, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect and the President and
Board of Trustees of the Village have given further consideration
to the variations requested and have determined that the same
satisfies the standards set forth in Section 14.605 of Article VI
of Chapter 14 of the Village Code and the Board of Trustees further
find that it would be in the best interest of the Village to grant
the varIations as specified here~n.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Sub3ect Property a
variation from Section 21.902 to allow a side yard of 4-1/2 feet
rather than the required 7-1/2 feet and a varlatlon from Section
14.102.B.1 to allow a separation of 6 feet between an accessory
building and the principal structure rather than the required 10
feet.

SECTION THREE: Except for the variations granted herein, all
other applicable V~llage of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Sub3ect
Property.
SECTION FOUR: In accordance with the provisions of
Sectlon 14.604 the variations being the sub3ect of this Ordinance
shall be null and void unless permits are ~ssued and construction
begins wlthln one (1) year of the passage of this Ordinance for any
portion of the property.
