AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 401 MAN A WA
WHEREAS, Peter and Phyllis Ewert (hereinafter referred to as
Petitioners) have filed an application for a variation from Section
14.1102.C of Chapter 14 of the Village Code of Mount Prospect,
Illinois, for property commonly known as 401 Man A Wa Trail
(hereinafter referred to as Subject Property), legally described as
follows:
Lot 14 in Block 29 in Prospect Park Country Club Subdivision,
being a subdivision of the Southeast 1/4 of Section 11 and the
South 15 acres of the East 1/2 of the Northeast 1/4 of sa~d
Section 11, all in Township 41 North, Range 11, East of the
Third Principal Meridian, except that portion of said Lot 14
described as follows: Commencing at the East corner of said
Lot; running thence Southwesterly along the Southeasterly line
thereof, 109.80 feet to the South corner of said Lot, thence
running Northeasterly 55.65 feet to a point 6.84 feet
Northwesterly (measured normally) from said Southeasterly line
of said Lot, thence Northeasterly 54.96 feet to point of
beginning in Cook County, Illinois
and
WHEREAS, the Petitioner seeks a variation from Section
14.1102.C which requires a rear yard of twenty five feet (25'); and
WHEREAS, a public hearing was held on the variations requested
being the sub3ect of ZBA Case No. 35-V-88 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 9th day of
June, 1988,, pursuant to due and proper notice thereof published
in the Mount Prospect Herald on the 23rd day of June, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect and the President and
Board of Trustees of the Village have g~ven further consideration
to the variations requested and have determined that the same
satisfies the standards set forth in Section 14.605 of Article VI
of Chapter 14 of the Village Code and the Board of Trustees further
find that ~t would be in the best ~nterest of the Village to grant
the variations as specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth herelnabove are
incorporated herein as findings of fact by the Presldent and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property a
variation from Section 14.1102.C to allow a rear yard of fifteen
feet (15') rather than the required twenty-five feet (25').

SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: In accordance with the provisions of
Section 14.604 the variations being the sub3ect of this Ordinance
shall be null and void unless permits are Issued and construction
begins within one (1) year of the passage of this Ordinance for any
portion of the property.
SECTION FIVE: This Ordinance shall be
effect from and after its passage, approval
