AN ORDINANCE PROHIBITING ENCROACHMENTS WITHIN
THE STATE OF ILLINOIS RIGHTS-OF-WAY
OF ELMHURST ROAD AND OAKTON STREET
WHEREAS, the State of Illinois, acting by and through its
Department of Transportation, is desirous of improving the
traffic signals at Elmhurst Road and Oakton Streets; and
WHEREAS, a portion of the sub3ect Improvement is located wlthln
the corporate boundaries of the V~llage of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that the best ~nterest of the
V~llage and its residents would be served by participating in
this improvement.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That no person, firm, corporation or other entity
shall install, place, maintain or construct any structure that
encroaches upon the State of Illinois r~ghts-of-way of Elmhurst
Road or Oakton Street located within the corporate boundaries of
the Village of Mount Prospect.
SECTION TWO: That the Village Clerk of the Village of Mount
Prospect is hereby authorized and directed to attach a copy of
this Ordinance to the Agreement dated .Tithe ~ , 1988,
by and between the State of Illinois and the Village of Mount
Prospect relative to the improvement of the traffic signals at
Elmhurst Road and Oakton Street.
SECTION T~REE: That th~s Ordinance shall be ~n full force and
effect from and after its passage and approval in the manner
provided by law.
