AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY
KNOWN AS 100 SOUTH SCHOOL STREET
WHEREAS, St. Paul Evangelical Lutheran Congregation (hereinafter
referred to as Petitioner) has filed an application for variations
from certain provisions of Chapter 14 of the Village Code of Mount
Prospect, Illinois, for property commonly known as 100 South School
Street (hereinafter referred to as Subject Property), legally
described as:
Lots 4, 5, 6, 7 and 8 in Busse's Subdivision being a
Subdivision of Block 7 (except the south 196 feet
thereof) in Busse and Wille's Resubdivision in Mount
Prospect, in the West Half of Section 12, Township 41
North, Range 11, East of the Third Principal Meridian,
also, the south 196 feet of Block 7, Lot "A" (except
the South 255 feet) Block 8 in Busse and Wille's
Resubdivision in Mount Prospect in the West Half of
Section 12, Township 41 North, Range 11, East of the
Third Principal Meridian,
and
WHEREAS, Petitioner seeks variations from Chapter 14 (Zoning
Ordinance) of the Village Code of Mount Prospect as follows:
Section 14.102.B.4 to allow the existing 1,366 square foot
parsonage building to remain as an accessory structure, rather
than the permitted 120 square feet;
Section 14.1102 to allow a floor area ratio of .40% instead
of the permitted .35%;
Section 14.1102.E to allow a maximum lot coverage of 54%
instead of the permitted 45%;
Section 14.1104.A to allow a thirty foot (30') building height
instead of the permitted twenty-four feet;

Section 1102.B.2 to allow a seventeen foot (17') exterior yard
on the west property line instead of the required twenty feet;

Section 14.1102.B.2 to allow a zero foot exterior side yard
on the east property line for a parking lot instead of the 20
feet required;

Section 14.1102.C to allow a zero foot rear yard for a parking
lot instead of the required twenty-five feet; and
Section 14.1102.B.1 to allow a zero foot interior side yard
setback for a parking lot instead of the required ten feet.
WHEREAS, a public hearing was held on the variation requested being
the subject of ZBA Case No. 40-V-89 before the Zoning Board of
Appeals of the Village of Mount Prospect on the 13th day of July,
1989, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 27th day of June, 1989; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the

Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variations
requested and have determined that the same satisfies the standards
set forth in Section 14.605 of Article VI of Chapter 14 of the
Village Code and the Board of Trustees further find that it would
be in the best interests of the Village to grant the variations as
specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees
of Mount Prospect hereby grant to the Subject
following variations:

SECTION THREE: Except for the variations granted herein, all other
applicable provisions of Chapter 14 (Zoning Ordinance) of the
Village of Mount Prospect shall remain in full force and effect as
to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted
herein shall be null and void unless permits are issued and
construction begins within one (1) year from the date of passage
of this Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
