HomeMy WebLinkAboutOrd 5215 10/16/2001ORDINANCE NO 5215 AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY LOCATED AT 303 DOUGLAS STREET Passed and approved by the President and Board of Trustees the 16t~ day of October, 2001 Published ~n pamphlet form by authority of the corporate authorities of the Vdlage of Mount Prospect, Ilhno~s, the 17th day of October, 2001 vwl 10/10/01 ORDINANCE NO 5215 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 303 DOUGLAS AVENUE WHEREAS, Donald Craig (hereinafter referred to as "Pet~boner") has filed a pebbon for a Cond~bonal Use permit w~th respect to property located at 303 Douglas Avenue, (hereinafter referred to as the "Subject Property") and legally described as follows Property Index Numbers 08-10~114-139 08-10-114-140 A Subd~ws,on of that part of the West % of the SW ¼ of the SE ¼ of the NW ¼ of Sec 10, Township 41 North, Range 11 East of the 3rd Pnncipal Mend~an, m Cook County, IL and WHEREAS, the Pebboner seeks a Cond~bonal Use to construct a c~rcular dnveway, and WHEREAS, a Pubhc Heanng was held on the request for the Conditional Use permit being the subject of ZBA Case No 29-01 before the Zomng Board of Appeals of the Vdlage of Mount Prospect .on the 27th day of September, 2001, pursuant to proper legal not~ce hawng been pubhshed m the Mount Prospect Journal & Top~cs on the 12th day of September, 2001, and WHEREAS, the Zoning Board of Appeals has submitted ~ts findings and positive recommendabon to the President and Board of Trustees ~n support of the request being the subject of ZBA 29-01; and WHEREAS, the President and Board of Trustees of the Vdlage of Mount Prospect have g~ven cons~derabon to the request here~n and have determined that the same meets the standards of the Vdlage and that the granbng of the proposed Conditional Use would be ~n the best ~nterest of the Vdlage NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS SECTION ONE The recitals set forth here~nabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect age 2/2 303 Douglas Street SECTION TWO The President and Board of Trustees oftheVdlage of Mount Prospect do hereby grant a Conditional Use, as prowded for in Section 14 203 F,7 of the Village Code, to allow the construction ofa c~rcular driveway, as shown on the S~te Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A" SECTION THREE That the V~llage Clerk ~s hereby authonzed and d~rected to record a certified copy of th~s Ordinance w~th the Recorder of Deeds of Cook County SECTION FOUR Th~s Ordinance shall be ~n full force and effect from and after ~ts passage, approval and pubhcat~on m pamphlet form ~n the manner prowded by law AYES NAYS ABSENT.
