Minutes of regular meeting of the President and Board of
Trustees of the Village of Mount Prospect, Illinois, held in the
Village Hall in said Village on Tuesday, the 5th day of March,A.D.
1935, at the hour of eight o'clock P.M.
The meeting was called to order by President Meyn and on
call of the roll the following were found to be present: Mr. .
Herman F. Meyn, President, and Messrs. Alvin Beigel, Dudley W.
Budlong, Arvid Carlson, Walter Niebuhr and Edwin Wille, Trustees.
Absent: Herman Haas.
Thereupon the President declared the meeting duly organ-
,
ized for the transaction of business.
The first business to come before the meeting was the
reading of the minutes of the last meeting, and on motion made,
seconded and carried, said minutes were approved as read.
The Treasurer presented his monthly report on the general
funds, and on motion by Mr. Beigel, seconded by Mr. Wille, the
report was ordered filed.
The Village Treasurer also presented his report on the
standing of the special assessment accounts, and on motion made
by Mr. Wille, seconded by Mr. Niebuhr, this report was ordered
filed.
Application by the Public Service Company for permit to
repair gas pipe at 14 N. Busse Avenue, under sidewalk, was pre -
sented and on motion by Mr. Budlong, seconded by Mr. Beigel, such
permit was granted.
It was moved by Mr. Budlong that the Fire Department of
the Village be reimbursed to the extent of $100.00 for money loaned
to the Village. The motion was seconded and the roofl was called
with the following result:
Messrs. Beigel, Budlong, Niebuhr and Wille voting aye.
No one voting nay. Thereupon the President declared the motion
carried.
It was moved by Mr. Budlong, and the motion was seconded,
that a discount of 50% be granted to business men on business
license fees, if application is made and license fee paid before
August 1, 1935. The roll was called with the following result:

No one voting nay. Thereupon the motion was declared carried.

Mr. Beigel moved that the foregoing bills be paid, and
the motion was seconded by Mr. Wille and the roll called with
the following results: 3
Messrs. Beigel, Budiong, Niebuhr and Wille voting aye.
No one voting nay. Thereupon the President declared the motion
carried.
On motion made, seconded and carried on roll call the
Village Clerk was instructed to give proper notice of the annual
tillage election to be held on April 16, 1935, for the election
of a President, six trustees, and a Village Clerk.
Mr. Beigel presented the following resolution and moved
its adoption:
"WHEREAS there has been heretofore filed with the
Village a petition asking that the Village install a
water softener in connection with its water works system,
THEREFORE BE IT RESOLVED that the following proposi-
tion be voted on at the next annual election, to be held
on April 16, 1935; namely:
'Shall the Village of Mount Prospect provide
for and install a water softener in connection
with its waterworks system, the cost of which,
adequate for the needs of the Village, being
estimated to be approximately ft15,000.00 ?r
IT IS FURTHER RESOLVED that said proposition be placed
C on a separate ballot and that the Village Clerk be
directed to give notice of such proposition in con-
nection with notice of said election."
The motion for the adoption of said resolution was
seconded by Mr. Wille and on call of the roll was unanimously
carried.
The attorney for the Village, Mr. H. J. Thal, reported that
the plans and specifications for the contemplated improvements to
the waterworks system had been approved by the Federal Emergency
Administration of Public Works, and that the next step to be taken
in this matter would be the advertising for bids to do the work.
Thereupon Mr. Carlson presented the following resolution and moved
its adoption:

"WHEREAS the Board of Trustees of the Village of Mount
Prospect did on the 7th day of November, A.D.1934, at an ad-
journed regular-meeting of the President and Board of Trustees
of this Village, pass an ordinance entitled:
IAN ORDINANCE AUTHORIZING THE CONSTRUCTION OF
IMPROVEMENTS AND EXTENSIONS TO THE WATERWORKS
SYSTEM OF THE VILLAGE OF MOUNT PROSPECT, PRO-
VIDING FOR THE ISSUE OF $14,500 WATER REVENUE
BONDS OF SAID VILLAGE FOR THE PURPOSE OF DEFRAY-
' ING THE COST OF CONSTRUCTION OFT SUCH IMPROVEMENTS
AND EXTENSIONS TO THE SAID WATERWORKS SYSTEM, PRE-
SCRIBING ALL DETAILS OF SAID BONDS AND PROVIDING
FOR THE COLLECTION, SEGREGATION AND DISTRIBUTION
OF THE REVENUES OF THE WATERWORKS SYSTEM OF SAID
VILLAGE FOR THE PURPOSE OF PAYING THE COST OF OPER-
ATION AND MAINTENANCE THEREOF, PROVIDING AN ADEQUATE
DEPRECIATION FUND THEREFOR AND PAYING THE PRINCIPAL
OF AND INTEREST ON SAID WATER REVENUE BONDS!,
which ordinance was approved by the President. of said Village on
said 7th day of November, 1934; and 3
WHEREAS said ordinance was published,as required by law,
in the Mount Prospect Herald, a secular newsppper published and
having a general circulation in the Village of Mount Prospect; and,
WHEREAS afterwards a petition was filed with the Clerk of
this Village, containing the signatures of the required number of
voters, asking that the construction of the improvements and addi-
tions to the municipal waterworks system, and the issuance of water
revenue bonds, as provided for in and by said ordinance be sub-
mitted to the legal voters of said Village; and,
WHEREAS, pursuant to such petition the President and •
Board of Trustees of this Village caed a special election, to be
held on the 31st day of January, 1933 for the purpose of submiting
to the voters of this Village said question; and
WHEREAS such election was held on said 31st day of January,
193 ,9, and the proposition to make said improvements and additions
to the municipal waterworks system and the issuance of water revenue
bonds, as provided for in said ordinance, was carried by a majority
of the votes cast at said special election; and,

and, WHEREAS said ordinance is now in full force and effect;
WHEREAS the plans and specifications for the doing of
said work, prepared by Messrs. Consoer, Townsend & Quinlan,
engineers, for this Village, have been approved by the public
authorities whose approval is required, and this Village desires
. to proceed with all possible speed with the making of said im-
provement;
NOW, THEREFORE, BE IT RESOLVED That said plans and
specifications be approved and ordered filed with the Clerk of
this Village, and that the President of this Village be and he
is hereby instructed to adv,rtise for sealed proposals for the
construction of said improvements and extensions to said water -.
works system, which advertisement for such sealed proposals shall
be substantially in the following form:
ADVERTISEMENT FOR BIDS
VILLAGE OF MOUNT PROSPECT, ILLINOIS.
ADVERTISEMENT
Sealed proposals addressed to the President and Board of Trustees
of Mount Prospect, Illinois, for a concrete reservoir and Pumping
Station, for improvements and extension of the Waterworks System
will be received until 8 o'clock P.M., Central Standard Time on
March 29th, 1935, at the Village Hall and will then be publicly
opened and read.
The bid shall be for all labor, materials and equipment for a
250,000 gallon concrete reservoir and a pumping station. Also,
an alternate bid will be submitted on a 312,000 gallon concrete
reservoir and pumping station.
Contractors will be paid in cash solely and only from funds to
be received from a loan and grant from the Federal Emergency
Administration of Public Works.
The payments for all work under these contracts is to be made
from a loan and grant secured from the Federal Administration
of Public Works. Therefore, all requirements of the Federal
Government for such construction must be complied with, as well
as all requirements of the contract and specifications.
Attention of Bidders is called to the necessity of compliance
with Bulletin No. 2 Revised as of March 3, 1934 of the Federal
Emergency Administration of Public Works and particularly to the
minimum wage rates incorporated therein, which for this District
are for Skilled Labor $1.20 per hour and for common labor $0.50
per hour. All bidders shall sign and submit with their bids a
certificate of Compliance with N.R.A. on U.S.Government Form
No. P.W.A.61, Revised March 1934, which is attached herewith.
Without exception, no bid will be considered unless accompanied
by the bidder's Certificate of Compliance, U.S. Government Form
P.W.A. 61, Revised March 1934, to the effect that the bidder is r
complying with and will continue to comply with each applicable
Code of Fair Competition, or, in the absence of such Code or
Codes, with the President's Reemployment Agreement. Copies of
this Certificate Will be included with the "Instructions to
Bidders."
BIDDERS
Each bidder shall be skilled and regularly engaged in the class
of work bid.upon. He shall carefully examine the location select -
ed for the work, and make himself familiar with the drawings and
specifications,of_the_san. before submitting. his proposal, in
order that no mi shall exist in regard to the nature
and character of the work to be done. No bids will be considered
from bidders who are unable to show that they have actually per -
formed work of a similar character to that on which they are
bidding.
Each bidder shall carefully fill out in detail the experience
and equipment questionnaire provided in the proposal. In addition,
any bidder when requested shall later fill out in detail and make
a sworn statement to the financial questionnaire provided in the
proposal. Such information will be utilized in formulating a re-
port as to the history, reputation, organization and capacity for
satisfactory and faithful performance of work of a similar
character of the bidder, and.not otherwise made public.
COMPLETION OF WORK
The bidder to whom a contract is awarded will be required to
satisfactorily complete the entire contract within three (3)
calendar months after starting the work in accordance with the
terms of the contract.
BIDS RECEIVED
Proposals shall be made on the form of proposal „and contract
- attached °hereto
CERTIFIED CHECK & BOND
Each bidder shall at the'time of filing his proposal deliver
therewith a certified check, drawn to the order of the Treasurer
of the Village of Mount Prospect, Illinois, for $1,300.00.
The bidder to whom a contract is awarded shall execute and de-
liver to the Village of Mount Prospect, Illinois, a written
contract in the form attached hereto, within five (5) days after
notice of the fact that a contract has been awarded to such
bidder.
Said bidder shall also, at the time of executing and delivering
said contract, execute and deliver to the Village of Mount
Prospect, Illinois, a bond in the sum of the full amount of the
contract, with an approved Surety Company or Trust Company as
surety, conditioned upon the faithful performance of'the work in
accordance with the contract and as security for the payment of
labor and materials furnished. Also, a Labor Bond shall be
executed at the time of signing the contract.
The costs of executing the bonds and contract, including all
notarial fees and expenses, are to be paid by the Contractor
ti? to whom the contract is awarded.
If the bidder to whom a contract is awarded shall fail to sign
and execute said contract and bond, then the aforesaid certified
check shall become forfeited to the Village of Mount Prospect,
Illinois, and shall be considered as liquidated damages.
The certified checks of unsuccessful bidders may be held until
the contract is approved, when they will be within
three (3) days thereafter.
ACCEPTANCE OR REJECTION OF BIDS
The Village of Mount Prospect, Illinois, reserves the right to
reject any or all proposals or to .accept any bid deemed most
advantageous for the Village.
WITHDRAWAL OF BIDS
No bid will be allowed to be withdrawn for any reason whatever
after it has been deposited with the Village Clerk.
SECURING PLANS & SPECIFICATIONS
Plans, specifications, forms of contract and proposal blanks may
be obtained from the Village Clerk at Mount Prospect, Illinois,
or at the offices of Consoer, Townsend & Quinlan, Inc., Engineers,
1322 Engineering Building, Wells Street and Wacker Drive, Chicago,
Illinois. A set of plans and specifications may be obtained for
'►'�'' use in making up a bid by depositing Ten (110.00) Dollars. Five
($5.00) Dollars of this deposit will be refunded if the plans and
specifications are returned in good condition within two (2) weeks
after the date of receiving bids.

BE IT FURTHER RESOLVED that the advertisement for -such .
sealed proposals shall be made in the Mount Prospect Herald, a
secular newspaper published in the Village of Mount Prospect, ;.
Illinois, and that such proposals be received until eight o'clock
P.M., Central Standard Time on the 29th day of March, A.D.1935,
at the Village Hall in said Village; at which time and place they
will then be publicly opened and read ".

The motion for the adoption of said resolution was
seconded by Trustee Budlong and the roll was called with the
following result:

Mr. Niebuhr voting aye,
Mr. Wille voting aye.
No one voting nay.
Total ayes - 5 - Total nays 0.
Thereupon President Meyn declared the motion for the
adoption of said resolution carried.
• Mr. Thal, attorney for the Village, reported that
•
pursuant to recent instructions, he had employed, on behalf of
the Village, one Gustav Seedorf, to examine all the records in
the office of the County Clerk relating to special assessments
returned delinquent to the County Treasurer, on which orders of
withdrawal at sale had been issued, and to determine how much
money was in the hands of the County Clerk belonging to the
Village as a result of payments of delinquent and withdrawn
special assessments; that the compensation of said Seedorf
was the customary commission of 2% on all such moneys -found to
be due, and Mr. Thal further reported °that such' examination had
been completed and that it was found that there was on hand the
sum of $10,148.35, far which he had a check, payable to the order
of the Village, together with a list of the parcels of land on
which said payments had been made, together with the installment
and warrant number of each payment.
Mr. Thal turned the check over to the ;Village, with the
suggestion that Mr. aeedorf' s fee for services, amounting to
$202.97, be approved and opdered paid.

hereupon it was moved by Mr. Budiong that the bill of
Gustav Seedorf for $202.97 being 2% of the amount of said check,
be approved, and that the same be paid out of general-funds of
said Village, and that such geaera1 fund be later on reimbursed
out of the costs and penalties collected and included in said check.
The motion for the adoption of such motion was seconded
by Mr. Carlson and the roll was called with the following result:
Messrs. Beigel, Budiong, Carlson, Niebuhr and Wille voting aye. A

There being no further business to come before the
meeting, same on motion made by Mr. Beigel, seconded by Mr. Carlson
