HomeMy WebLinkAboutOrd 5214 10/16/2001ORDINANCE NO 5214 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1002 SOUTH NA-WA-TA AVENUE Passed and approved by the President and Board of Trustees the 16th day of October, 2001 Pubhshed in pamphlet form by authority of the corporate authorities of the Vdlage of Mount Prospect, Ilhno~s, the 17th day of October, 2001 10110//01 ORDINANCE NO 5214 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1002 SOUTH NA-WA-TA AVENUE WHEREAS, Ronald and Joann Schlachter (hereinafter referred to as "Petitioners") have filed a petition for a Variation w~th respect to property located at 1002 South Na-Wa-Ta Avenue (hereinafter referred to as the "Subject Property") and legally descnbed as follows Property Index Number 08-14-219-002 Lot 51 ~n Kaplan Braun's 4th Addition to Mount Prospect Umt #1 being a subd~ws~on of part of the N % of Sec 14, Township 41 North, Range 11 East of the 34 Pnnc~pal Meridian, ~n Cook County, Ill~no~s, and WHEREAS, the Petitioner seeks a Variation to replace an ex~st~ng patio and dnveway, which w~ll exceed the 45% maximum lot coverage allowed by the Mount Prospect Wllage Code, and WHEREAS, a Public Heanng was held on the request for a Vanat~on being the subject of ZBA Case No 28-01 before the Zoning Board of Appeals of the Vdlage of Mount Prospect on the 27t~ day of September, 2001, pursuant to proper legal not~ce hawng been pubhshed ~n the Mount Prospect Journal & Top,cs on the 12t~ day of September, 2001, and WHEREAS, the Zomng Board of Appeals has submitted ~ts findings and recommendation to the President and Board of Trustees of the Vdlage of Mount Prospect, and WHEREAS, the President and Board of Trustees of the V~llage of Mount Prospect have g~ven consideration to the request hereto and have determined that the same meets the standards of the Vdlage and that the grant~ng of the proposed Variation would be ~n the best ~nterest of the Vdlage age 2/2 1002 S Na-Wa~Ta Avenue NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS SECTION ONE The recitals set forth here]nabove are ~ncorporated as findings of fact, by the President and Board of Trustees of the Village of Mount Prospect SECTION TWO The President and Board of Trustees of the Vdlage of Mount Prospect do hereby grant a Vanat~on, as provided ~n Secbon 14 203 C 7 of the Village Code, to allow the replacement of a pabo and driveway, which w~ll exceed the maximum amount of lot coverage allowed by the Mount Prospect Vdlage Code, as shown on the S~te Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A" SECTION THREE' This Ordinance shall be m full force and effect from and after ~ts passage, approval and publ~cabon m pamphlet form ~n the manner prowded by law AYES Comoran, Hoefert, Lohrstorfer, Skowron, Wdks, Zadel NAYS None ABSENT.
