May 2, 1922.
The President Pro Tem called the meeting to order.
The clerk called the roll all trustees responding present.
Minutes of the meeting of April 24th and April 29th ..were
read and on motion duly made seconded and oarried.approved as
read.
The Treasurer's report as follows was read and same was
on motion duly made, seconded, and parried accepted as read
and ordered placed on file,

It was duly moved by trustee Haas, aeoonded by trustee Heide,
that said bills be pain and the .lsrksbb- dire to issue warrants
for same.

Motion oarried ayes six, nays none.
Thereupon it was duly moved by trustee Heide, seconded by trustee
Jahncke that the President Pro Tem be authorized to sign and the
clerk to oountersign, and issue a warrant in favor of George Wayman
for the sum of ten dollars ($10.00) as compensation for permission
to damp rubbish on his premises.

Thereupon it was duly moved, seconded, and carried that the

It was duly moved, seconded, and carried that said appointment
be concurred in:
Thereupon the clerk read an ordinanoe entitled and ordinance
designating members of the Board. of Trustees of the Village of Mt.
Prospect, Illinois as members of the Board of Local Improvements,
It was duly moved by trustee Jahnoke, seconded by trustee
Meoklenburg that said ordinance be passed.

Thereupon the following letter from the County Supt. of Highways
offieeL read and the plans submitted therewith were examined and the
clerk was directed to speak to the County superintendent in reference
to the last paragraph of said letter in regard to damages they desired
the Village to assume.
"The Honorable Board of Trustees,
Village of Mount Prospect, Ill.
Gentlemen,
I am submitting herewith the plans for the paving of
Section 87 -15D as approved by the State Division of Highways. As a
portion of this improvement lies within the village of Mount•Prospeot
and as they involve some changes there, these plans are submitted to
you for approval.
You understand, of oourse, that we propose the opening
of a new street paralleling the Right of Way of the C & N. W. Ry. for
a portion of the distance through the village. I wish in particular
to call to your attention the following other features of the plans:
The aligment as shown by the speoial sheet from Station
135 to 165 is insisted upon by the state as a condition to their
approval of the plans. This alignment, you will note, will make
neoessary the removing of the shoed at the right at the right of
station 137 -50 between the Mount Prospect Creamery and the garage.
It is believed t at this shed is upon the street at present. It in
probable that a Ithilt of the sidewalk south of the oreamery will
have to be removed also,

Further you will note that our plans requiring the lowering
of the grade at the Elmhurst Road intersection at Station 164 by
approximately two feet. This will make worse and already bad
railroad crossing, but it Gould not be avoided without excessive
filling to the west of this intersection. And we understand that
you have under consideration the closing of this owing in
connection with the paving of Elmhurst Road en Main Street. With
this exception, that portion of this road which is upon the present
,village streets will have a grade that the present village streets
will have a grade that agrees very closely with that of the sidewalks
now in places.
We would be pleased to have you advise us of your action in the
matter and of your willingness to assume responsibility for damages
resulting from the building of the highway according to these plans.

" Thereupon the clerk read the following Contract for drilling
well,
"
Contrast.
THIS AGREEMENT made and entered into this clay, the 20th day of
Appell L D. 1922, by and between W. L. Thorne,Cdstagybusiness under
the tame of W. 10. Thorne Company, of the City of Platteville, Wis.,
hereinafter`fbr eonvbnienee designated as the "oontraotor ", party
the first part, and the Village of Mount Prospect, a Municipal
Corporation in the County of Cook and State of Illinois, hereinafter
for convenience designated as the "Village ", party of the second
part, WITNESSETH:
That said contractor for and in consideration of the payment
to be made to him by said Village as hereinafter set forth, hereby
covenants and agrees to provide all the necessary labor, material,
machinery, tools and other apparatus and other means for the eonstruc..
tion of a bored well and to construct the same, in the Village of
Mount Prospect, Illinois, in all respects in accordance with the
specifications and the proposal of the said contractor, hereto attached
and made a part hereof.
It is further agreed that said well shall be drilled Twelve (12)
inches in diameter or Ten (10) inches in diameter, or part of the
distance Twelve (12) inches in diameter and part of the distance Ten
(10) inches in diameter, as the engineer for said Village may direct,
and that only such parts of said well shall be cased as may be
directed by said engineer and that payment for the work shall be made
according to the size of the well grilled and the amount of casing and
the size thereof at the rates respectively as set forth in the
oontiaetor's bid or proposal hereto attached. And it is further
agreed that the Cook screen specified in the specifications and propo-
s(:: al shall only be furnished when and as directed by said engineer,
and that the rates per foot for the work to be done and material to
be furnished, as set forth in said proposal shall apply, if necessary,
to the depth of Two Hundred (200) feet.

It is further agreed that the oontraottr shall before com-
menoing work under this oontraot, furnish a bond to said Village
in the penal sum of Two Thousand ($2000.00) Dollars, with good
and suffioient seourity to cover the faithful performance
of this oontraot, but that Of said contractor desires to be
relieved from giving such bond, that then the Village shall hold
as seourity for the faithful performance of this contraot, the
oertified check of the oontraotor submitted with his proposal
and that in suoh=evett also, no payments shall be made to the con-
tractor on account of work done or material flunished until the
completion of the work provided for herein, the testing of said
well and the acceptance and approval thereof by the Village, in-
stead of the payments as provided for in said specifications.
Said work shall be completed on or before June 1, 1922;
provided however, that 1Y-the time for the performance or oom-
- pletion of the work be for any reason, either expressly or.t
implication, extended, such expension shall not affect the
validity of this contract or the liability of the sureties upon
any bond that may be given by the contraotor.
It is expressly understocd and agreed that the work shall
be done in a thorough and workmanlike manner under the direction
and to the satisfaction of the said Village and its engineer
in this behalf employed.
Said contractor will be held responsible for all accidents
and hereby agrees to identify and protect the said Village from
all suits, claims and other aotion brought against it, damages
and attorneys' fees which the Village may be put to by reason of
any injury or alleged injury to the person or property of another,
,, inernding the employees of said contraotor in the exeoution of
this contract or the performance of the work or in guarding the
same or for any material used in its proseotition or in its
oonstruotion.
Sho'ald the work under this agreement not be finished within
the time speoified, said oontraotor shall forfeit the sum of Five
(0.00) Dollars per day to said village for liquidated damages
for each and every day which shall elapse after the expiration
of the time herein agreed upon for the oompletion of the work,
which amount shall be retained from the contract price of said
work.
-No part of the work herein provided for shall be sublet or
sub - contracted without the express oonsent of the Village, and
in he case will such consent relieve the contractor from the
obligation herein entered into or from the terms of this agreement.
This contraot shall extend to and be binding upon the suocess-
ors and assigns and upon the heirs, administrators, executors and
legal representatives of the contraotor.
IN WITNESS WHEREOF the said contractor has hereunto set
his hand and seal and the said village has caused this agreement
to be Signed by i» President Pro Tem and attested by its Clerk,
and its corporate seal to be attached hereto, the day and year

Thereupon the matters of installing a crossing South of R. R.
right of way to cement Sidewalk on Emerson St. and repairing
of other crossings and the restricting of buildings and matter
of a Health Board was discussed without taking any action.
