PROSPECT, TUESDAY, JUNE 16, 1959 The meeting was called to order at 8:15 P.M. by President Lams. Upon roll call, the following trustees ansered "Present": Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Absent, none. Ail trustees having previously received copies of the minutes of June 9th, Trustee Casterline, seconded by Trustee Gaw, moved that the minutes be approved as submitted. The President put the question minutes and the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw and Norris. Trustee Schlaver passed, because he did not attend the previous meeting. President Lams declared the motion carried. Trustee Gaw, seconded by Trustee Ekren, moved that the bil~s for the week ending June 16, 1959 be approved as follows: General $10,605.06 Library 855.96 Water 8,029.60 bills $19,490.62 The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris an0 Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Norris referred to Mr. J. A. Weber's request of the previous week which was referred to the Street Committee, asking for vacation of utility easement between Lots 10 and 17 of J. A. Weber's Vacation of Addition. Trustee Norris stated that the Village Engineers recommend easement, that sewer s.ervin~ Lots 1 to 9 be relayed so that the sewer .~erving Weber Propert Lots 1 to 9 would empty into the interceptor on Lincoln rather than into the sewer on the easement proposed to be vacated. Trustee Norris, seconded by Trustee Ekren, then moved that the request of Joseph Weber. for the vacation of the utility easement between Lots 10 and 17 of J. A. Weber's Addition be granted provided Mr. Weber reconstructs the sewer serving Lots 1 to 9 in said addition so that it will empty into the intercepting sewer on Lincoln Street, and that Mr. Weber pay the cost of preparing the recording the legal documents necessary to accomplish the vacation. Mr. Weber announced at once that he was glad to do this, also that this plan is less costly than the former one. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Schlaver, seconded by Trustee Norris, then moved that the Village Attorney be instructed to prepare the necessary ordinance to vacate the easement as approved by the Board of Trustees with respect to J. A. Weber's Addition. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays., none. Whereupon the President declared the motion carried. Trustee Norris, seconded by Trustee Gaw, moved for the adoption of Resolution 20-59: Res. 20-59 Arterial A RESOLUTION DESIGNATING THE FOLLOWING STREETS Streets AS ARTERIAL, SUBJECT TO THE APPROVAL OF THE ILLINOIS DEPARTMENT OF PUBLIC WORKS & BUILDINGS Ioka Ave. from Prospect to Council Trail Milburn Ave. from Pine to Ioka Pine St. from Milburn to Prospect June 16, 1959 The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Caster!ine, Ekren~, Gaw, Norris and Schlaver. Trustee Norris, seconded by Trustee Ekren, moved for the adoption of Resolution 22-59: Res. 22-59 EFT Street A RESOLUTION DESIGNATING THE FOLLOWING STREET Improvement TO BE IMPROVED UNDER MOTOR FUEL TAX LAW: Council Trail from Emerson to Elm The President tmt the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Schlaver explained that a serious water shortage has Well ~4 developed because Well #4 is beinE pulled due to causes which will repair not be known until the entire well is cleared of machinery. This is causing a strain on the remaining two wells. Trustee Schlaver, seconded by Trustee Ekren, moved for passage of proposed Ordinance #8?8: Ord. #578 AN ORDINANCE ALLOWi~G THE VILLAGE MANAGER Water restrictions TO IMPOSE RESTRICTIONS ON THE USE OF WATER DURING FAILURE OF WELLS OR WATER SHORTAGE The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Schlaver, seconded by Trustee Ekren, made the following motion: "That the Board concur with the recommendation No Sprinkling of the Village Manager to ban sprinkling forthwith as long as the water shortage emergency exists". The President put the question, the Clerk called the roll, ~ith the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Schlaver, seconded by Trustee Norris, moved that the Village Manager be directed to mail to all water users as soon as possible a notice of the ban on sprinkling. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Norris, Ekren, Gaw and Schlaver. Nays, none. Whereupon the President declared the motion carried. June 16, 1959 Trustee Casterline brought up the subject cf the inter- section at Busse Avenue, Wille Street and Northwest Highway. In One-way street 195~ an ordinance was passed making the block on Busse between on Busse betwee MAin and Northwest Highway omo way to the west. T~i~ cannot be Main & NW Hiway controlled without cutting down the intersection at Wille, Busse, and Northwest Highway. He then passed around a sketbh showing how this might be done, stating that the cost is estimated to be only about $250~, and that if this plan did not work out the controls could easily be removed. Wille Lumber Compare, the largest merchant on the corner, has no objection. It was agreed that this plan be left in Committee, meanwhile consulting Chief Whittenberg and allowing the business men affected a chance to be heard. Trustee Airey, seconded by Trustee Norris, moved for the passage of proposed Ordinance #679: Ord. 679 Annexation of AN ORDINANCE ANNEXING COUNTRY CLUB Country Club PROPERTY WHICH IS AT PRESENT OUTSIDE property THE VILLAGE LIMITS and also moved that the Clerk and President be directed to sign the plat~ cf annexation. Trustee Airey, seconded by Trustee Gaw, moved for the passage of Ord. #680: Ord. 680 AN ORDINANCE AMENDING ORD. 6?5 WITH RESPECT St. Paul' s ~TO SETBACK LINES FOR ST. PAUL'S LUTHERAN CHURCH The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Airey read the following report and memorandum on Zoning Case #S9-18: Zoning Case REPORT #59-18 CASE 59-18 Heard June S, 1959 Petitioner:Edw. P. Clarke Robert Lanfranchi This was a request to amend the zoning ordinance to allow rezoning of property fr~m R~l to B-2, located at lO1 North Forest Avenue. For dental offices. Vote to deny request, 6-0. MEMORANDUM CASE 59-18 The disapproval on this case follows the past decisions of not permit- ting business offices to be mixed with residential. This spot zoning wot~ld not benefit the Village or the adjacent home owners. S/ E. F. Martin, Chairman N. L. Corny, Acting Sec'y Trustee Airey, seconded by Trustee Schlaver, moved that %he Board of Trustees concur in the findings of the Zonin~ Board of Appeals in regard to Case #59-18. Whereupon the President declared the motion carrried. June 1~, 1959 Trustee Airey read the following report regarding Case 59-17, residences in industrially zoned districts: Case 59-17 ResidenCes Case 59-17 in Heard June 5, 1959 Industrially- Petitoner, Village of Mt. Prospect zoned Attorney, Robert Downing districts Request to amend zoning ordinance so as to prevent residential units from being permitted in industrially zoned areas as ~llows: I-District Sec. 8~ Subsect~.o.n B Residential units, except for residential apartments housing a caretaker or watch_man employed on the premises and their families, provided such residential apartments do not in number exceed one family living unit for each 2400 sq. ft. of lot area. This portion of the petition passed by vote of 5-0. Trustee Airey, seconded by Trustee Oaw, moved that the Board of Trustees concur in the recommendation of the Zoning Board regardir~ Sec. 8, Subsectic~ B, I-District, and authorize the attorney to prepare the necessary ordinance in this respect. Trustee Airey read the second half of the report of the Zoning Board regarding Case 59-17: Request for ~mendment allowing certain types of residential units in areas zoned for business, excluding all other types of residential zoning as follows: Sec. 7.1, Subsection 1 B-1 District Residential apartments, if located above the first floor and above a permitted business use as provided in the various "B" districts of this ordinance, provided such apartments do not exceed one family living unit for each 2400 sq. ft. of lot area. This portion of the petition did not pass; vote to deny request, 4-2. S/ E. F. Martin, Chairman N. L. Gorny, Acting Sec'y After some discussion, this part of the report from the Zoning Board was referred to the Judiciayy Committee for further study. Ethel~ Busse - Case 59-13 Mr. Chester Busee arose from the audience and asked if he would be permitted to continue building on his property inasmuch as the pertinent ordinance had not yet been passed. Trustee Airey, seconded by Trustee Norris, moved that construction be authorized to proceed under the temporary building permit issued to Chester Buese. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. June 16, 1959 Trustee Airey presented plat of First Addition to Bluett's Fairview Bluett's Fairview Gardens outside Village limits, which has Gardens 1st Addn. been approved by the Plan Commission and made the following motion, seconded by Trustee Gaw: "That the Village President and Clerk be authorized to sign plat of subdivision of First Addition to Bluett's Fairview Gardens". The President put the question and the motion carried by acclamation. President Lams read petition from residents in the 500 and 600 blocks on South William Street in which they asked Petition to repair that the contractor, Santucci, be held responsible for resur- So. William St. facing this street in such a manner that it will be in the same state of good repair from curb to curb as it was prior to excavation, that patch surfacing is not satisfactory, and ~urther that this work commence immediately due to the severe dust constantly raised by the unimproved street. They requested that the Village take the necessary steps to expedite this work. Trustee Schlaver asked to clear up misunderstanding re- garding meeting between Village Board and representatives of Zoning meeting Des Plaines, stating that Mt. Prospect has been willing to meet with DesPlaines an~ time to discuss proposed limits and zoning in the zones of overlapping influence. Village Manager Appleby was asked to contact Mayor Behrel of Des Plaines to arrange for a meeting between representatives of his city and our Chairmen of the Plan and Judiciary Committees and Chairman of the Z~ning Board of Appeals. Mr. Lams brought up the subject of parking on Prospect Avenue east of Emerson Street, saying he was ih'~favor of parallel parking on the north side of Prospect, and that he thought there would be no problems regarding diagonal parking on the south side. However, no parking lines will be painted until the improvements are in. Trustee Norris, seconded by Trustee Airey, moved for adjournment, and the meeting regularly adjourned at 10:18 P.M.
