IN THE MUNICIPAL BUILDING, VILLAGE OF
MT. PROSPECT] TUESDAY, MAY 26, 1959
The meeting was called to order at 8:13 P.M. by President
~'~ Lams. Upon roll call, the following trustees answered "Present": roll call
Airey, Ekren, Gaw, Norris and Schlaver. Trustee Casterline absent,
arrived at 9:2C.
All trustees having previously received copies of the
minutes of May l§, Trustee Schlaver, seconded by Trustee Ekren, minutes
moved that the minutes be approved as submitted. The President put
the question, the Clerk called the roll, with the following response:
Ayes, Trustees Airey, Ekren, Gaw, Norris and Schlaver. Absent, Trustee
Casterline. Nays, none. k~hereupon the President declared the motion
carried.
Trustee Gaw, seconded by Trustee Airey, moved that the bills be
approved for the week ending May 26, 1959 as follows:

Board of Appeals, resigning his membership because he is moving out

Dear Ted:
It was about eleven years ago that our family, returning to
the Chicago area from Cleveland, Ohio, selected Mount Prospect as our
new home. Since that time, our family has attended the wonderful
schools in Mount Prospect and have enjoyed their living to the fullest
extent. The community has grown and prospered and~is now known as one
of the finest suburban communities in the Chicagoland area. The tremendous
growth of the Village required considerable planning and a great deal of
hard work and effort on the part of the Village officials, Police Department,
Fire Department, School Board, Planning Commission, Zoning Board of Appeals
and many others. To look back over the accomplishments, it is really a
tremendous history that has been written and every citizen of the Village
of Mount Prospect should be most grateful.
Now, for business reasons, it is necessary for me to move away
from our home and over to Medinah, Illinois. This will probably be about
the 1st of July, so at this time it is necessary for me to submit my
resignation as a member of the Zoning Boa. rd of Appeals.
May I take this opportunity to extend my sincere appreciation
for the opportunity of working in this capacity, and to thank you, all
members of the past a~d present Board of Trustees, for the fine consideration
and cooperation given.
The Village is in excellent hands with the finest type of
people of high character in all positions, and I am sure that it will
continue in that manner for manyyears to come.

Due to the resignation of Mr. Stuart W. Goodenough, who
has served faithfully amd well as a member ef the Zoning Board of
Appeals, I take pleasure in the appointment of Mr. Philip T. Liggett,
418 South Pi~e Street, to fill said vacancy on the Zoning Board of
Appeals.
Your concurrence in this appointment is respectfully
requested.

Truwtee Schlaver, seconded by Trustee Airey, moved that the
Board of Trustees accept ithe resignation of Mr. Stuart Goodenough
with regret, expressing with thanks its commendation for the services
rendered. This motion was carried by acclamation.
Trustee Airey, seconded by Trustee Ekren, moved that the
Board concur in the appointment of Philip T. Liggett to fill the vacant
seat left by Stuart Goedenougb. The President put the question
the Clerk called the roll, with the following response: Ayes, Trustees
A~rey, Ekren, Gaw, Norris and Schlaver. Nays, none. Absent, Trustee
Casterline. Whereupon the President declared the motion carried.
!Petition from home- Clerk Reynolds read a petition from neighbors of the
owners near Country Club, who expressed their interest in ma~utaining the resi-
iCountry Club dential atmosphere ef their area and doubt regarding future proposals
controlling parking, means of enclosure and use of facilities. They ~-~
requested that the Board give deliberate consideration toward accomp-
lishing harmony in the area by insuring that each property owner shall
be assured of maximum use of his property whether it be for business or
as a residence. Mr. Lams assured these people verbally that the Board
would take care to see that their interests were kept in mind, ~and
asked the Clerk to place this petition on file.
Trustee Airey read the following letter from SchavtlJe &
Knuth:

Dear Trustee Airey:
E~closed is a copy of a letter to Mr. Appleby Dec. 29, 1958 concerning
a signed agreement we have with the Village. We understand that
annexation papers for the land mentioned in the agreement have already
been prepared, but are being held up until we are properly reimbursed
for our tru~k se~er line acoordinE to the agreement.
Since we do not know at which meeting this matter may be brought up,
and we are unable to attend each and every Tuesday Beard meeting,
we are sending a copy of this letter to 'each Trustee so that he is
aware of this legal agreement between us amd the _Village. We are
asking each Trustees to respect this agreement in the faithful manner
it was intended and not to pass on annexation of this land until we
have notified the Vill~age in writing that we have received p~oper
reimbursement.

Farm
A parcel of la~d (approximately B2 acres) known as the Herman Busse
farm, lying West of our Sunset Heights Subdivision, is being purchased
by Mr. ~homas Ackerman and Mr. Herman Greisdorf. Most likely, one of
these parties will present this land for annexation to the Village of
Mount Prospect im the near future.
We wish to call your attention to the agreement dated August lB, 1957
between the Village of Mt. Prospect and SchavilJe & Knuth, Inc., con-
corning the "Rreimbursement of pro rate share of construction of combined
tru~k sewer ia Lonmquist Boulevard". A portion of this agreement
read "the Villag~e will consider no petition for annexation or permit
to cormect to the aforesaid sewer system for the 60 acres of land lying
to the West of the Sunset Heights Subdivision and South of Lonnquist
Boulevard unless the~:applicant thereof will first pay to the First Party
(Schavilje & Knuth, Inc.) the sum of $252.49 per acre for all said land
to be annexed to the Village .... .,
When the above mentioned reimbursement has been paid to us, we will
notify the Village immediately in writing. If you should wish to
contact us concerning this matter we may be reached at the followiag
phones after 5:00 P.M.

Trustee Gaw read the Treasurer's Monthly Report for the month
of April, 1959, and moved that this report be accepted and that the
Special Assessment report.be approved and placed on file. Trustee Ekren
seconded this motion, the President put the question and the Clerk
called the roll, with the following response: Ayes, Trustees Airey,
Ekren, Gaw, Norris and Schlaver. Absent, Trustee Casterline.
The fact was brought out that im~ o~ements on Central Read Central Read
are under way. Trustee Norris, seconded by Trustee Airay, moved that 8 CS
the Clerk be authorized and directed to advertise for bids on MFT Sec. 8 CS,
traffic control signals at Central Read and Northwest Highway, ~aid bids
to be received u~til 8 o'clock P.M. (C.S.D.T.) June 9, 1959. The
President put the question, the Clerk called the roll, with the following
response: Ayes, Trustees Airey, Ekren, Norris and Schtaver. Nays,
none. Absent, Casterl~ne. Whereupon the President declared the motion
carried.
Trustee Schlaver stated that he had had a meetiaE with
Mr. Spurway of Carson,. Pirie, Scott & Company about the proposed site Well #6
of Well #6, off Foundry Road, and that it is entirely acceptable to
this company, and that they will convey a deed to the Village 'covering
the well site property. Trustee Schtaver then moved, seconded by Trustee
Ekren, that the plans and specifications for the drilling and development
of Well #6 as prepared by Censoer, Townsend & Associates be accepted
~'~ by the Board. The President put the 'question, the Clerk called the
roll, with the following response: Ayes, Trustees Airey, Ekren, Gaw,
Norris and Schlaver. Absent, Casterline. Whereupon the President declared
the motiom carried.
Trustee Schlaver then moved., seconded by Trustee Norris, that
the Village Manager be authorized and directed to advertise for bids Bids -
under date of Ma~ 28th for the purpose of drilling ~and development of Well #6
Well #6, said bids to be received and publicly opened at 8:00 P.M.,
June 2Brd, at the Mt. Prospect Village Hall, by the Village Board. The
President put the question, the Clerk called the roll, wi~h the following
response: Ayes, Trustees Airey, Ekren, Gaw, Norris amd Schlaver. Absent,
Trustee Casterline. Whereupon the President declared the motion carried.

Mell & Paul' s Trustee Airey read the following report re Case 59-15,

from Board of Appeals
Gentlemen: Case 59-15 - Petitioner, Moll & Paul's Restaurant
This petition is a request for a variation in the fr6nt
building line to allow approximately two foot overhang in front of
the building.
The Board of Appeals cannot grant nor recommend a variation
to permit a structure to extend beyond or overhang a property line;
nor can the Board recommend a change in the property line itself.
It is the consensus 6f the Board of Appeals that the
erectiom of this addition as well as th~ character of the structure
itself is desirable.
There were no objectors.

Trustee Airey also read the memorandum which a ccompamied
the report:
The property line of the lots owned by the petitioner are
inconsistent with the property lines of the other lots on Northwest __
Highway in that they are set back as much as 20 feet farther. In
addition, we understand that the provision for sidewalks along Northwest
Highway are for curb sidewalks, to conform with the Jewel Tea sidewalk.
If the property line of the petitioner's lot were considered
with the property line of the other lots on Northwest Highway, the
petitioner would not need a variation for the overhang, which in the
opinion of the Board i.s a desirable feature of the proposed construction.

Some discussion follow~d, after which Trustee Airey,
seconded by Trustee Schlaver, made the following motion: "That
construction of canopy in front of Mell & Paul's Restaurant as
proposed by Mr. Caltagirone be authorized, said canopy extending
2 feet over property line." Mr. Airey pointed out that this type of
construction is the same as that allowed for a theater mar.quee, or as
in the case of Busse Motors on Main Street.
The President put the question, the Clerk called the roll, with the
following response: Ayes, Trustees Airey, Ekren, Gaw, Norris and
Schlaver. Absent, Casterlime: Whereupon the President declared the
motion carried.
Trustee Casterline arrived at 9:20 P.M.
County Zoning Village Manager Appleby brought up the matter of County
Hearing Zoning Hearing of May 21st, wherein request was made to rezone 62
Elk Grove Twp acres in Elk Grove Township from farming to multi-family residence,
said property bounded on the north by Dempster, south by Toll Road,
]~ring west of Busse Road. Discussion followed, after which Trustee
Airey, seconded by Trustee Schlaver, moved to file objectinn wi~h the
Cook County Board of Appeals on the grounds that there are insufficient
public facilities allowed for the amount of dwelling units proposed.
The President put the question, the Clerk called the roll, with the
following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw,
Norris and Schlaver. Nays, none. Whereupon the President declared the
motion carried.

AN ORDINANCE WHICH PERMITS THE ERECTION
OF A SIGN ON CERTAIN VACANT LOT FOR A
PERIOD OF TWO YEARS OR UNTIL PROPERTY IS SOLD.
Trustee Airey, seconded by Trustee Norris, moved for the passage of
Ordinance #877. The President put the question, the Clerk called the
roll, with the following response: Ayes, Trustees Airey, Casterline,
Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President
declared the motion carried and Ord. ~77 approved.
VillAge Manager Appleby notified the Beard that there are Coumt~:Zon-
two items on the Cook County Zoning Board of Appeals' June Srd agenda ing Agenda -
that concern the village: One is section of land north c~ Foundry North of Foundz
not too far from the Nigh School, to be zoned from farming to & oil tank fa~
business, tavern and amusement district. The other is the oil tank
farm at Elmhurst Road and Oakton. Trustee Airey, seconded by Trustee
Ekren, moved that the Village Manager be authorized to represent the
Village and attend the County Zoning Board hearing on June Brd. This
motion carried by acclamation.'
Village Clerk Reynolds read the following letter from the
Feehanville School Beard of Education:

Dear Sirs::
The following resolution was unanimously passed by the Board of
Education ef School District Number 25:
Since School District Number 26 (Feehanville) is imminently faced with
a four-fold increase in school enrollment in a short period of time the
aid of all governmental authorities concerned is most urgently needed.
The proposed development of Brickman Manor, first addition (1200 resi-
dential units), is before b~th the county and village authorities at
the present time. The bonding power of the school-district is exhausted
and the legal limit on the educational ~evy will be voted upon shortly.
The thirteen classrooms in existence and under construction will be
inadequate to provide for children to come from developments now under
construction. There will be no facilities nor building site for the~
children te come from the proposed development. Neither school facilities
nor operational funds will be available to provide for the expected
enrollment. Tangible aid from the developer is neceseary to take care
of the school needs to be created by this development.
Therefore, it is the resolve of the Board of Education of School District
Number 26 that both the county and village officials be notified of this
situation with a request for serious consideration of the school problem
at all deliberations prier to approval of the project. It is fur~er
requested that this school board be notified of meeting dates on the~
matter so that board representation may be present.

Mr. David McCoy, sDeaking for Brickman, -said that land
and buildings are being offered by Mr. Brickman toward construction
of a school, and that Brickman Builders are anxious to work this
out, and have been in constant contact with the school board.
Village Manager Appleby read the following letter from
A. Scully & Sons, regarding Randview Highlands Subdivision:

Scully & Sons Village of Mt. Prospect, Ill.
Dear Mr. Appleby:
We are the contractors for the installation of sewer and water
mains for Brickman Home Builders in the Randview Highlands Sub-
division, Unit No. 2. Due to an ~nfortunate combination of
circumstances in ordering mmterial for this work, we incorrectly
installed a 6" water main in Fairview Street between Highland Street
and Foundry Road, where a 10" water main was called for on the plan.
This was an honest mistake on our part. Due to the fact that the
pipe was delivered to the site and the work installed on a Saturday,
the Inspector was not working and unfortunately we did not contact
him.
In discussing this with Consoer, Townsend & Associates they advise
that the Village wants the 6" main removed and the 10" main installed
to conform with the plan. I would be very willing to rectify this
error by removing this main and replacing it except that there are
46 building service taps made to it which makes it a very difficult
and expensive job as each tap has to be removed and retapped into the
new main.
In order to provide a 10" water main at Foundry Road for future
Village expansion we offer to install the 10" water main in Forest --
Avenue, which is one street west of Fairview Avenue where a 6"
main is required by the plans and further to install a 10" water main
in Foundry Road between Forest and Fairview. We believe that this
will have the same effect as the originally planned installation.
We have installed considerable underground utilities in Mt. Prospect
over the years, always without complaint or serious error. We
sincerely regret this unintentional omission on our part and reguest
the best consideration by the Village of our proposal for rectifying
this error.

Re: Randview Highlands Subdivision, Unit ~2

Per your request, we are offerin~ below the following comment in
regard to the letter to you from Achille Scully & Sons dated
May 15, 1959 relating to the w~ter main in Fairview Avenue between
Highland Avenue and Foundry Road on the referenced project:
We believe the facts as stated in the letter from
the Contractor to be correct as we know them.
As regards the feasibility of rectifying this error
as requested by the Contractor, we advise as follows:

The water main in Fairview Avenue on this project
was made of 10" size when this project was designed
by this office to provide adequate supply facilities
at Foundry Road on the contingency that armexation
of areas north of Foundry Road would someday occur.
Since the supply main in Highland Avenue is of 12"
size from Forest Avenue easterly to Well No. 5, it is
nOS a critical factor that the placing of this 10"
main be in Fairview Avenue. The 10" main could be
placed in either Eastwood Avenue, Prospect Manor Avenue,
Fairview Avenue, or Forest Avenue and accomplish the
same objective as above stated. From the hydraulics
standpoint, in our opinion, the results obtained from
the contractor's proposed routing would be equal to
tha~ produced by the original layout.
We trust the above is in accordance with your request. Please advise
if there are any questions in this regard.

made the following motion: "That the request as stated in A. Scully's deny reques~
letter cf May 15th be denied, and that the Village Manager be
directed to so inform him; and that 10" main be installed according
to the original plans and specifications." Trustee Airey seconded
this motion, the President put the question, and the Clerk called the
roll, with the following response: Ayes, Trustees Airey, Casterline,
Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President
declared the motion carried.
Village Manager Appleby read a letter from the Park Board Parking on
asking for the co-operation of th~ Village regarding resolution passed Council
by the Park Board which asks that public parking be prohibited over Trail
and along the south line of Ceu~cil Trail, constituting the north
boundary of the public park owned by Mt. Prospect Park District,
between the east line of See GwunAvenue and the west line of
Elmhurst Avenue.
Trustee Schlaver, seconded by Trustee Airey, moved that
the Village Manager be instructed to have signs prohibiting parking
along Council Trail as requested by the Park District in their
resolution dated May 20, 1959. The Presid~t put the question, the
ClePk called the roll, with the following response: Ayes, Trustees
Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none.
Whereupon the President declared the motion carried.
Mr. Appleby mentioned that the Park District was interested
in the Village group hospitalization insurance, and that it was Hospitalizatio
possible to i~clude them with no extra paper work on the part of Insurance
the Village. Trustee Casterline, seconded by Trustee Gaw, then Park District
moved that the Park District employees be invited to participate
in the Village hospital insurance program, at no expense to the
Village, subject to the approval of the Village Attorney. The
~.~ President put the question, the Clerk called the roll, with the
following response: Ayes, Trustees Airoy, Casterline, Ekren, Gaw,
Norris and Schlaver. Nays., none. Whereupon the President declared
the motion carried.
Trustee Airey, seconded by Trustee Casterline, moved for
